DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 01\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tLearned APP, waives service of notice of Rule for respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.I 35\/2010 with Jasdan Police Station, District Rajkot for the<br \/>\n\toffences punishable under Sections 408, 407, 120-B, 34 etc. of the<br \/>\n\tIndian Penal Code.\n<\/p>\n<p>Learned<br \/>\n\tcounsel appearing for the applicant submits that now the<br \/>\n\tinvestigation is over and charge sheet is filed and co-accused are<br \/>\n\tenlarged on bail.  Learned counsel further submits that considering<br \/>\n\tthe nature of allegations, role attributed to the applicant, bail<br \/>\n\tmay be granted in exercise of powers under section 439 of the Code.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP for the respondent &#8211; State.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case and<br \/>\n\tconsidering the nature of allegations<br \/>\n\tcoupled with the fact that charge sheet is filed,  without<br \/>\n\tdiscussing the evidence in detail, prima facie, this Court is of the<br \/>\n\topinion that this is a fit case to exercise the discretion to<br \/>\n\tenlarge the applicant on bail.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith first information report registered at C.R. No.I 35\/2010 with<br \/>\n\tJasdan Police Station, District Rajkot on executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five thousand only) with one surety of the like<br \/>\n\tamount to the satisfaction of the trial Court and subject to the<br \/>\n\tconditions that he shall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\tpassport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\tpresence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>The<br \/>\n\tAuthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
