Justice R.BASANT\n\n Dated :05\/01\/2007\n\n O R D E R\n                                     R.BASANT, J\n\n                          ------------------------------------\n\n                              Crl.M.C.No.47 of 2007\n\n                          -------------------------------------\n\n                    Dated this the  5th day of January, 2007\n\n\n                                         ORDER\n<\/pre>\n<p>       The   petitioner   is   the   2nd  accused   in   a   prosecution,   inter   alia,<\/p>\n<p>under  Section  452   and  326  read  with  149  I.P.C.    The petitioner was<\/p>\n<p>not available for trial.   There was a case and a counter case.   Parties<\/p>\n<p>appear to have settled the dispute.  The co-accused have already been<\/p>\n<p>tried and acquitted.   The petitioner who  was employed  abroad  could<\/p>\n<p>not   appear   before   the   learned   Magistrate.     The   petitioner   has   now<\/p>\n<p>come to know of the pendency of the split up case against him.<\/p>\n<p>       2.      The learned counsel for the petitioner submits that in view<\/p>\n<p>of the judgment of acquittal of the co-accused as per the judgment, a<\/p>\n<p>copy   of   which   is   produced   as   Annexure-A1,   the   proceedings   against<\/p>\n<p>him also may be quashed.  It is submitted that in that prosecution, all<\/p>\n<p>relevant   witnesses   have   turned   hostile   to   the   prosecution   and   no<\/p>\n<p>incriminating evidence was tendered before the learned Magistrate in<\/p>\n<p>such prosecution against any accused.\n<\/p>\n<\/p>\n<p>       3.      It   is   now   trite   and   the   decision   in  <a href=\"\/doc\/1958014\/\">Moosa   v.   Sub<\/p>\n<p>Inspector of Police<\/a>  [2006(1) KLT 552] by the Full Bench makes the<\/p>\n<p>position   crystal   clear   that   the   hostility   of   the   witnesses   in   the   trial<\/p>\n<p>against   the   co-accused   is   by   itself   not   a   satisfactory   or   sufficient<\/p>\n<p>reason to persuade the Court to invoke the powers under Section 482<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.47 of 2007                       2<\/span><\/p>\n<p>Cr.P.C.  In fact, to a pointed query by this Court, it is conceded that as<\/p>\n<p>the petitioner has been named as an accused in the F.I.R.  The powers<\/p>\n<p>under Section 482 Cr.P.C cannot obviously be invoked to concede any<\/p>\n<p>premium   to   persons   who   perjure   before   court   or   in   favour   of   the<\/p>\n<p>accused   persons     who   ensure   such   perjury.     I   am,   in   these<\/p>\n<p>circumstances, satisfied that this is certainly not a fit case where the<\/p>\n<p>extraordinary inherent jurisdiction available under Section 482 Cr.P.C<\/p>\n<p>can   or   ought   to   be   invoked.     Such   jurisdiction   is   to   be   invoked<\/p>\n<p>sparingly and in exceptional cases in aid of justice.<\/p>\n<p>       4.     The   learned   counsel   for   the   petitioner   alternatively<\/p>\n<p>contends that he will be in a position to satisfy the learned Magistrate<\/p>\n<p>that   no   non   compoundable   offence     is   committed   and   that   all   the<\/p>\n<p>compoundable   offences   allegedly   committed   have   already   been<\/p>\n<p>compounded.     Of   course,   it   will   be   open   to   the   petitioner   to   appear<\/p>\n<p>before   the   learned   Magistrate   and   contend   at   the   stage   of   Section<\/p>\n<p>239\/240   Cr.P.C  that charges  need be framed   only  for  compoundable<\/p>\n<p>offences.     Such   contention   must   certainly   be   considered   by   the<\/p>\n<p>learned Magistrate on merits.\n<\/p>\n<\/p>\n<p>       5.     Finally the learned counsel for the petitioner submits that<\/p>\n<p>a   direction   may   be   issued   under   Section   482   Cr.P.C   to   the   learned<\/p>\n<p>Magistrate   to   release   the   petitioner   on   bail   when   he   appears   before<\/p>\n<p>the learned Magistrate and applies for bail.   It is for the petitioner to<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.47 of 2007                     3<\/span><\/p>\n<p>appear   before   the   learned   Magistrate   and   to   explain   to   the   learned<\/p>\n<p>Magistrate the circumstances under which he could not earlier appear<\/p>\n<p>before the learned  Magistrate.     I have  no reason  to  assume  that the<\/p>\n<p>learned Magistrate would not consider such application on merits, in<\/p>\n<p>accordance   with   law   and   expeditiously.     Every   court   must   do   the<\/p>\n<p>same.     No   special   or   specific   direction   appears   to   be   necessary.<\/p>\n<p>Sufficient   general   directions   have   already   been   issued   in  <a href=\"\/doc\/147290035\/\">Alice<\/p>\n<p>George   v.   The   Deputy   Superintendent   of   Police<\/a>   [2003(1)   KLT<\/p>\n<p>339].\n<\/p>\n<\/p>\n<p>         6.    This   Crl.M.C   is,   in   these   circumstances,   dismissed.
