(CJ)\nMATHEW, KUTTYIL KURIEN\nALAGIRISWAMI, A.\nGOSWAMI, P.K.\nSARKARIA, RANJIT SINGH\n\nCITATION:\n 1975 AIR 1005\t\t  1975 SCC  (3)\t 30\n\n\nACT:\nThe  Maintenance of Internal Security Act,  1971--Ss.  3(1),\n13--Constitution  of India, Art. 22 (7)\t (b)--Detention\t for\nmaximum\t period--Validity of detention--Application of\tmind\nas to the period of detention.\n\n\n\nHEADNOTE:\nThe  petitioner\t challenged the order of  detention  on\t the\nground\tthat the autho. rities fixed the maximum  period  of\ndetention  without applying their mind as to, the period  of\ndetention.\nHELD  : (i) The order of detention does not suffer from\t any\nconstitutional\tinfirmity.   The  authorities  have  applied\ntheir mind while detaining for the maximum period  mentioned\nin  the statute.  This Court has held in ragu Shaw v.  State\nof West Bengal that the maximum period mentioned in  section\n13  of the Act as amended by section 6(d) of the Defence  of\nIndia  Act,  1971, is a. constitutionally  valid  provision.\n[484B; 483G]\nFagu Shaw v. The State of West Bengal, A.I.R. 1974 S.C.\t 613\nfollowed..\n\n\n\nJUDGMENT:\n<\/pre>\n<p>ORIGINAL JURISDICTION : Writ Petition No. 2053 of 1973.<br \/>\nPetition under Article 32 of the Constitution of India,<br \/>\n Shiv Pujan Singh, for the petitioner.\n<\/p>\n<p>The Judgment of the Court was delivered by<br \/>\nRAY, C.J. The petitioner in a writ petition under Article 32<br \/>\nof&#8217; the Constitution challenges the order of detention dated<br \/>\n15 March, 1973.\n<\/p>\n<p>The order is : &#8216;in exercise of the powers conferred by\tsub-<br \/>\nsection\t (1) read with sub-section (2) of section 3  of\t the<br \/>\nMaintenance  of Internal Security Act &#8220;hereinafter  referred<br \/>\nto as the Act&#8221; directing the petitioner to be detained&#8221;.<br \/>\nThe petitioner challenges the order on the ground that it is<br \/>\nthe  duty  of the authority to fix the period  of  detention<br \/>\nafter\tcarefully  examining  the  circumstances   requiring<br \/>\ndetention.  The petitioner submits that the authorities haye<br \/>\nbodily lifted the section fixing the maximum period  without<br \/>\napplying their mind as to the period of detention.<br \/>\nThis  Court  in Fagu Shaw etc. v. The State of\tWest  Bengal<br \/>\nA.I.R. 1974 S.C. 613 held that the maximum period mentioned&#8217;<br \/>\nin  section 13 of the Act as amended by section 6(d) of\t the<br \/>\nDefence\t of  India Act, 1971- is  a  constitutionally  valid<br \/>\nprovision.\n<\/p>\n<p>That  section states that the maximum period for  which\t any<br \/>\nperson can be detained in pursuance- of any detention  which<br \/>\nhas been confirmed under section 12 shall be 12 months\tfrom<br \/>\nthe date of detention or until the expiry of the Defence  of<br \/>\nIndia Act whichever later.\n<\/p>\n<p><span class=\"hidden_text\">484<\/span><\/p>\n<p>This Court construed section 13 of the Act to be valid\twith<br \/>\n,reference  to Article, 22(7)(b) of the\t Constitution.\t The<br \/>\nmaximum\t period\t under Article 22(7)(b) can  be\t fixed\twith<br \/>\nreference  to the duration of an emergency.. The  expiry  of<br \/>\nthe Defence of India Act is dependent upon the revocation of<br \/>\nemergency.  The duration of maximum period of detention with<br \/>\nreference  to an event like the cessation of the  period  of<br \/>\nemergency is not indefinite.\n<\/p>\n<p>The  order of detention in the present case does not  suffer<br \/>\nfrom  any  constitutional  infirmity.The  authorities\thave<br \/>\napplied\t their mind. The authorities have detained  for\t the<br \/>\nmaximum period mentioned in the, statute.\n<\/p>\n<p>     The petition is dismissed.\n<\/p>\n<pre>     K.B.N.
