Justice P.Q.BARKATH ALI\n\n Dated :04\/05\/2010\n\n O R D E R\n                         P.Q.BARKATH ALI, J.\n                         ====================\n                         B.A.No.2639 of 2010\n                    ===============================\n                  Dated this the 4th day of May, 2010.\n\n                               O R D E R\n<\/pre>\n<p>       This is a bail application filed by the accused in Crime<\/p>\n<p>No.120 of 2009 of Aryanad Excise Range in Thiruvananthapuram<\/p>\n<p>District under Section 439 Cr.P.C.\n<\/p>\n<p>       2.    The allegation against the petitioner is that on<\/p>\n<p>10.4.2010 at 1:15 p.m she was found in possession of 1.4 litres<\/p>\n<p>of illicit liquor near Madathara junction, Anad muri. Petitioner<\/p>\n<p>was arrested on the spot and she is in remand thereafter.<\/p>\n<p>Judicial First Class Magistrate-I, Nedumangad rejected her bail<\/p>\n<p>application.\n<\/p>\n<p>       3.    It is alleged in the petition that the petitioner is<\/p>\n<p>innocent of the offence alleged against her, that she is falsely<\/p>\n<p>implicated in this case and if released on bail she is prepared to<\/p>\n<p>abide by any condition that may be imposed by this Court.<\/p>\n<p>       4.    Notice given to the learned Public Prosecutor. Heard<\/p>\n<p>the counsel for the petitioner and the learned Public Prosecutor.<\/p>\n<p>Petition is opposed by the learned Public Prosecutor.<\/p>\n<p>       5.    For the following reasons, I am inclined to grant bail to<\/p>\n<p>the petitioner.    Petitioner is a lady aged 45. She is in remand<\/p>\n<p>B.A.No.2639 of 2010               ::2::\n<\/p>\n<p>from 10.4.2010 onwards. Learned Public Prosecutor submitted<\/p>\n<p>that investigation in this case is almost over.         Under these<\/p>\n<p>circumstances, I feel that the petitioner can be released on bail,<\/p>\n<p>but, subject to conditions.\n<\/p>\n<p>     In the result, the bail application is allowed. Petitioner shall<\/p>\n<p>be released on bail on executing a bond for Rs.25,000\/- with two<\/p>\n<p>solvent sureties for like sum each to the satisfaction of the JFCM-<\/p>\n<p>I, Nedumangad on the following conditions.<\/p>\n<p>        1)     Petitioner shall report before the investigating<\/p>\n<p>               officer on all Mondays between 10:00 a.m and<\/p>\n<p>               11:00 a.m.<\/p>\n<p>        2)     Petitioner shall not commit similar offence<\/p>\n<p>               while on bail.\n<\/p>\n<p>        3)     Petitioner shall not interfere with the<\/p>\n<p>               investigation or intimidate the witnesses.<\/p>\n<p>        4)     Petitioner shall not leave the jurisdiction of<\/p>\n<p>               the lower court without prior permission.<\/p>\n<p>                                                  P.Q.BARKATH ALI,<br \/>\n                                                      Judge.\n<\/p>\n<p>bkn\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Jubairiya Beevi vs State Of Kerala on 4 May, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 2639 of 2010() 1.
