Mathur &amp; Lokeshwar Singh Panta\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<\/p>\n<p>O R D E R<br \/>\n[Arising out of S. L. P. (C) No.2280 of 2006]<\/p>\n<p>\tSpecial leave granted.\n<\/p>\n<p>\tAs the only point on which the notice was issued related<br \/>\nto the desirability of disposing of the Second Appeal in terms<br \/>\nof Section 100 of the Code of Civil Procedure, 1908 [in short<br \/>\n`the Code&#8217;] without formulating the substantial question of law<br \/>\nby the High Court of Judicature, Andhra Pradesh at<br \/>\nHyderabad, it is not necessary to deal with the factual aspects<br \/>\nin detail.\n<\/p>\n<p>\tThe respondent-Patibanda Soma Sundara Rao filed a suit<br \/>\nfor cancellation of the sale deed dated 21.12.1981, executed by<br \/>\nhis father in favour of the appellant-Chilakamarthi Mohana<br \/>\nRao and another sale deed dated 21.12.1981 in favour of the<br \/>\nminor son of the appellant and for consequential possession of<br \/>\nthe properties involved in the said two sale deeds.  During the<br \/>\npendency of the suit, the parties had agreed to refer the matter<br \/>\nto an Arbitrator.  The Arbitrator made an Award (Ex. A2) and<br \/>\nsubmitted the same before the trial court.  The appellant took<br \/>\nan objection that the Award of the Arbitrator is fraudulent and<br \/>\nhe had never agreed to the terms and conditions incorporated<br \/>\nin the Award.  The trial court, while recording the compromise<br \/>\nin terms of the said Award, decreed the suit declaring the sale<br \/>\ndeed executed in favour of the appellant as sham transaction<br \/>\nand accordingly cancelled the same.  Aggrieved by the<br \/>\nimpugned judgment of the trial court, the appellant-defendant<br \/>\nNo.1 filed First Appeal before the 1st Additional Senior Civil<br \/>\nJudge, Vijaywada.  The First Appellate Court, while<br \/>\nappreciating the entire evidence, allowed the appeal and set<br \/>\naside the decree and judgment of the trial court.  The<br \/>\nrespondent preferred the Second Appeal No. 650 of 2003<br \/>\nagainst the judgment of the First Appellate Court.  By the<br \/>\nimpugned judgment, the High Court allowed the appeal, set<br \/>\naside the judgments of both the courts below and remanded<br \/>\nthe suit to the trial court for fresh disposal within a period of<br \/>\none year from the date of receipt of a copy of the judgment.<br \/>\n\tHence, this appeal by special leave.\n<\/p>\n<p>\tThough various points were urged by learned counsel for<br \/>\nthe appellant, it is not necessary to go into those aspects in<br \/>\nview of the limited notice issued in the present appeal.<br \/>\n\tMr. B. Sridhar, learned counsel for the appellant,<br \/>\nsubmitted that the High Court was not justified in disposing of<br \/>\nthe Second Appeal without formulating the substantial<br \/>\nquestion or questions of law as mandated by Section 100 of<br \/>\nthe Code.\n<\/p>\n<p>\tMr. K. Shivraj Choudhuri, learned counsel for the<br \/>\nrespondent, submitted that though the High Court has not<br \/>\nformulated the questions of law, as required, yet on analyzing<br \/>\nthe evidence, it concluded that the view expressed by the<br \/>\ncourts below were not tenable in law.\n<\/p>\n<p>\tSection 100 of the Code deals with `Second Appeal&#8217;.  A<br \/>\nperusal of the impugned judgment passed by the High Court<br \/>\ndoes not show that any substantial question of law has been<br \/>\nformulated or that the Second Appeal was heard on a question<br \/>\nof law, if any, so formulated.  That being so, the judgment<br \/>\ncannot be sustained.\n<\/p>\n<p>\tIn Ishwar Dass Jain v. Sohan Lal [(2000) 1 SCC 434],<br \/>\nthis Court in para 10 has stated thus: (SCC p.441)<br \/>\n&#8220;10. Now under Section 100 CPC, after the<br \/>\n1976 Amendment, it is essential for the High<br \/>\nCourt to formulate a substantial question of<br \/>\nlaw and it is not permissible to reverse the<br \/>\njudgment of the first appellate court without<br \/>\ndoing so.&#8221;\n<\/p>\n<p>\tYet again in Roop Singh v. Ram Singh [(2000) 3 SCC<br \/>\n708], this Court has expressed that the jurisdiction of a High<br \/>\nCourt is confined to appeals involving substantial question of<br \/>\nlaw.  Para 7 of the said judgment reads: (SCC p.713)<br \/>\n&#8220;7. It is to be reiterated that under Section 100<br \/>\nCPC jurisdiction of the High Court to entertain<br \/>\na second appeal is confined only to such<br \/>\nappeals which involve a substantial question of<br \/>\nlaw and it does not confer any jurisdiction on<br \/>\nthe High Court to interfere with pure questions<br \/>\nof fact while exercising its jurisdiction under<br \/>\nSection 100 CPC.  That apart, at the time of<br \/>\ndisposing of the matter the High Court did not<br \/>\neven notice the question of law formulated by<br \/>\nit at the time of admission of the second<br \/>\nappeal as there is no reference of it in the<br \/>\nimpugned Judgment.  Further, the fact-finding<br \/>\ncourts after appreciating the evidence held<br \/>\nthat the defendant entered into the possession<br \/>\nof the premises as a batai, that is to say, as a<br \/>\ntenant and his possession was permissive and<br \/>\nthere was no pleading or proof as to when it<br \/>\nbecame adverse and hostile.  These findings<br \/>\nrecorded by the two courts were based on<br \/>\nproper appreciation of evidence and the<br \/>\nmaterial on record and there was no<br \/>\nperversity, illegality or irregularity in those<br \/>\nfindings.  If the defendant got the possession of<br \/>\nsuit land as a lessee or under a batai<br \/>\nagreement then from the permissive<br \/>\npossession it is for him to establish by cogent<br \/>\nand convincing evidence to show hostile<br \/>\nanimus and possession adverse to the<br \/>\nknowledge of the real owner.  Mere possession<br \/>\nfor a long time does not result in converting<br \/>\npermissive possession into adverse possession<br \/>\n<a href=\"\/doc\/1924102\/\">(Thakur Kishan Singh v. Arvind Kumar<\/a>  (1994)<br \/>\n6 SCC 591).  Hence the High Court ought not<br \/>\nto have interfered with the findings of fact<br \/>\nrecorded by both the courts below.&#8221;\n<\/p>\n<p>\tThe position has been reiterated in <a href=\"\/doc\/1320146\/\">Kanhaiyalal v.<br \/>\nAnupkumar<\/a> [(2003) 1 SCC 430], <a href=\"\/doc\/650341\/\">Chadat Singh v. Bahadur<br \/>\nRam &amp; Ors.<\/a> [(2004) 6 SCC 359]; <a href=\"\/doc\/1915593\/\">Sasikumar &amp; Ors. v.<br \/>\nKunnath Chellappan Nair &amp; Ors.<\/a> [(2005) 12 SCC 588].<br \/>\n\tUnder the circumstances, the impugned judgment dated<br \/>\n02.11.2005 passed by the High Court of Judicature, Andhra<br \/>\nPradesh at Hyderabad, is set aside.  We remit the matter to<br \/>\nthe High Court for disposal of Second Appeal No.650 of 2003<br \/>\nin accordance with law.
