4\/    13\/04\/2011               Heard learned counsel for the petitioner and for<\/p>\n
                     the opposite parties.\n<\/p>\n
                               A supplementary show cause has been filed on<\/p>\n
                     behalf of the Director, Bihar Rashtrabhasha Parishad and<\/p>\n
                     on behalf of Special Secretary, Department of H.R.D.<\/p>\n
                               The petitioner came to this Court in C.W.J.C.<\/p>\n
                     No.11959\/99 with a claim to be considered for promotion.<\/p>\n
                     He was directed to represent. On his representation<\/p>\n
                     followed termination in violation of law,     set aside in<\/p>\n
                     C.W.J.C. No. 1060\/08. The order of the Court is stated to<\/p>\n
                     have been served on the respondents on 11.1.2010,<\/p>\n
                     wrongly typed as 11.1.2009). The present application was<\/p>\n
                     then filed on 25.2.2010. On 19.1.2011 four weeks time<\/p>\n
                     was granted to the opposite parties to file show cause<\/p>\n
                     indicating that further adjournment may only be granted<\/p>\n
                     upon imposition of costs. That failed to deter the opposite<\/p>\n
                     parties by assisting the Court in timely dispensation of<\/p>\n
                     justice. On 9.3.2011 the Court granted further time<\/p>\n
                     subject to payment of costs of Rs.1000\/- regarding an
\n                   2<\/span><\/p>\n
explanation in the show cause for the delay in filing of the<\/p>\n
reply, fixing liability and recovering the cost from the<\/p>\n
delinquent concerned.\n<\/p>\n
          The show cause by the Special Secretary does<\/p>\n
not deny the assertion of the petitioner that he submitted<\/p>\n
a copy of the order of the Court on 11.1.2010, but<\/p>\n
acknowledges only the reminder given by the petitioner on<\/p>\n
1.2.2010. It then states that several letters and reminders<\/p>\n
were given to the Opposite Party No.5, the Director, Bihar<\/p>\n
Rashtrabhasha Parishad by the Department of H.R.D.<\/p>\n
Finally, Opposite Party No.5 informed that he has<\/p>\n
deposited the costs and joining of the petitioner has been<\/p>\n
accepted on 4.4.2011.\n<\/p>\n
          The show cause on behalf of Opposite Party No.5<\/p>\n
states that after the petitioner represented with a copy of<\/p>\n
the order of the Court, he recommended the same to the<\/p>\n
Department of H.R.D. for necessary action and approval.<\/p>\n
The Department of H.R.D. advised him to file an L.P.A.<\/p>\n
There is no statement what happened thereafter. The<\/p>\n
Department of H.R.D. never informed him of the filing of<\/p>\n
any contempt application but he was informed of the<\/p>\n
same for the first time on 3.3.2011. He then revoked the<\/p>\n
termination of the petitioner.\n<\/p>\n
          The Special Secretary and the Director quite<\/p>\n
obviously are at loggerheads with each other in a
\n                   3<\/span><\/p>\n
desperate attempt not to invite the wrath of the Court on<\/p>\n
whom responsibility be fixed for the delay in filing of the<\/p>\n
show cause.\n<\/p>\n
          Learned counsel for the petitioner submits that<\/p>\n
the joining given on 11.1.2010 has been accepted in the<\/p>\n
aforesaid manner only on 4.4.2011. The Court fails to<\/p>\n
understand what approval was Opposite Party No.5<\/p>\n
granting to the joining of the petitioner. It was an order of<\/p>\n
the Court. There was no occasion for Opposite Party No.5<\/p>\n
to sit over the order of the Court as a superior authority to<\/p>\n
accept or not to accept the joining of the petitioner. He<\/p>\n
was required to do so on 11.1.2010 itself, the day the<\/p>\n
order of the Court was brought to his attention by the<\/p>\n
petitioner.\n<\/p>\n
          The   Court   was   satisfied   that   the   Special<\/p>\n
Secretary and the Director both were liable for imposition<\/p>\n
of heavy costs not only for wasting the time of the Court,<\/p>\n
but harassing a citizen in the background of the<\/p>\n
controversy and even after the orders of the Court. The<\/p>\n
Court, however, refrains from doing so.<\/p>\n
          The Court however does consider it proper and<\/p>\n
necessary to notice the manner in which the officials of<\/p>\n
the State who are reposed power in trust by the State to<\/p>\n
act in the best interest of the State fritter away the<\/p>\n
resources of the State in frivolous litigations which is
\n                    4<\/span><\/p>\n
virtually defenceless. The power does not inhere in the<\/p>\n
Officer. It inheres in the chair.\n<\/p>\n
          The present is a classic case how officials of the<\/p>\n
State resort to every nook and corner of the legal arena to<\/p>\n
deny justice to a citizen. Frivolous actions ensure that<\/p>\n
timely justice is denied which virtually amounts to<\/p>\n
denying justice under the old adage “justice delayed is<\/p>\n
justice denied”.\n<\/p>\n
          The Court put a question to the counsel for the<\/p>\n
Special Secretary and the Director as to why in the<\/p>\n
peculiar facts and circumstances of the case the petitioner<\/p>\n
should not be directed payment of salary from 11.1.2010<\/p>\n
to 3.4.2011 not from the coffers of the State, but from<\/p>\n
their salary. The joint submission was for time to seek<\/p>\n
instructions.\n<\/p>\n
          This Court directs the Principal Secretary, in<\/p>\n
light of the present discussion contained in the order to<\/p>\n
grant a personal hearing to the Special Secretary and the<\/p>\n
Director in a joint sitting with them and then fix and<\/p>\n
determine liability on both or either of them as the case<\/p>\n
may be for the salary of the petitioner from the period<\/p>\n
dated 11.1.2010 to 3.4.2011, to be complied with within a<\/p>\n
maximum period of three months from the date of<\/p>\n
receipt\/production of a copy of this order before the<\/p>\n
Principal Secretary.\n<\/p>\n
                       5<\/span><\/p>\n
              The petitioner, if so advised, may represent for<\/p>\n
     the original relief of promotion for which he had earlier<\/p>\n
     approached the Court, but ended up with termination.<\/p>\n
              The contempt proceedings stand disposed.<\/p>\n
