      In   this application petitioner prayed for quashing the order<\/p>\n
      dated 19.2.2004 passed by Chief Judicial Magistrate, Dhanbad whereby<\/p>\n
      and whereunder he took cognizance of the offence against the petitioners<\/p>\n
      under the Payment of Gratuity Act, 1972.\n<\/p>\n
      2             It is submitted by learned counsel for the petitioners that the<\/p>\n
      petitioners are not the employer as defined under         section 2(f) of the<\/p>\n
      Payment of Gratuity Act therefore, no offence made out against them. It is<\/p>\n
      further submitted that the gratuity had already been paid to the employees,<\/p>\n
      thus in that circumstances also, no offence is made out. It is submitted that<\/p>\n
      the order by which the cognizance has been taken is an abuse of the<\/p>\n
      process of court, thus the same cannot be sustained by this Court.<\/p>\n
      3.            On the other hand, learned counsel for the opposite party, Mr.<\/p>\n
      M. Khan, submits that as per section 2(f)(iii) of Payment of Gratuity Act any<\/p>\n
      person who is in the ultimate control over the affairs of the mines, whether<\/p>\n
      called Manager, Managing Director or by any other name, is the employer.<\/p>\n
      It is further submitted that petitioner no. 1 is the Director (Technical)<\/p>\n
      B.C.C.L., and petitioner no. 2 is the Chief General Manager Kustore Area of<\/p>\n
      B.C.C.L It is also submitted that the petitioners are in ultimate control over<\/p>\n
      the affairs of East Bhagatdih Colliery of B.C.C.L, therefore they are<\/p>\n
      employer as defined under section 2(f)(iii) of the Payment of Gratuity Act. It<\/p>\n
      is further submitted that from the supplementary affidavit filed by the<\/p>\n
      petitioners it is clear that the gratuity has not been paid to the ex-employees
\n                                 2<\/span><\/p>\n
within 30 days from the date it becomes payable. Accordingly, it is<\/p>\n
submitted that the petitioners contravened the provisions of section 7(iii) of<\/p>\n
the Payment of Gratuity act, which is punishable under section 9 of the Act.<\/p>\n
Hence the court below rightly took cognizance against these accused<\/p>\n
persons.\n<\/p>\n
4.             Having heard the submission, I have gone through the record<\/p>\n
of the case. It is an admitted position that East Bhagatdih Colliery is owned<\/p>\n
by B.C.C.L, a Government Company. It is also admitted position that<\/p>\n
petitioner no. 1 is Director (Technical) B.C.C.L whereas petitioner no. 2 is<\/p>\n
Chief General Manager of Kustore area of B.C.C.L. It is also admitted that<\/p>\n
East Bhagatdih Colliery comes under the Kustore area of B.C.C.L .In the<\/p>\n
counter affidavit filed by O.P. No. 2 it has been stated at para 8 that<\/p>\n
petitioner no. 2 is the Disciplinary Authority, passing the bill and issuing<\/p>\n
cheques for payment etc. It is also stated that petitioner no. 1 has the<\/p>\n
ultimate control over all the affairs of mines of B.C.C.L, and is also<\/p>\n
allocating funds for the proper running of said mines and projects. No<\/p>\n
rejoinder to said counter affidavit has been filed. Thus the aforesaid<\/p>\n
statement made in the counter affidavit remain undisputed by the<\/p>\n
petitioners.\n<\/p>\n
5.             Section 2(f) defines employer. As per section 2(f)(iii), which is<\/p>\n
applicable in this case, any person, who, or the authority which, has ultimate<\/p>\n
control over the affairs of the mines, whether called Manager, Managing<\/p>\n
Director or by any other name is the employer.\n<\/p>\n
6.             As noticed above, the B.C.C.L. is the Government Company<\/p>\n
and the petitioner no. 1 is Director (Technical), whereas petitioner no. 2 is<\/p>\n
Chief General Manager of that company. As stated in the counter affidavit,<\/p>\n
which remain un-controverted, petitioner nos. 1 and 2 have the ultimate<\/p>\n
control of the affaires of mines falling in their jurisdiction. They are the<\/p>\n
person who allocates funds for the proper running of the mines and\/or<\/p>\n
projects. They have also powers to take disciplinary action against any<\/p>\n
employee. Petitioner no. 2 has power to issue cheque for payment etc.
\n                                             3<\/span><\/p>\n
            Under the said circumstance, I find that petitioner nos. 1 and 2 are        in<\/p>\n
            ultimate control of the affairs of East Bhagatdih Colliery of B.C.C.L, Hence<\/p>\n
            they are employer as defined under section 2(f)(iii) of the Payment of<\/p>\n
            Gratuity Act. Thus the first contention of learned counsel for the petitioners<\/p>\n
            that the petitioners are not employer is hereby rejected.<\/p>\n
            7.            In the complaint petition the date of retirement of employees,<\/p>\n
            whose gratuity had not been paid, has been mentioned. It further appears that<\/p>\n
            the complainant had inspected the establishment on 20.2.2003 and found that<\/p>\n
            the gratuity of altogether 15 employees has not been paid, though they retired<\/p>\n
            on different dates either in the year 2001 or 2002. Thus, on the date of<\/p>\n
            inspection made by the complainant there was delay of more than 1 to 2<\/p>\n
            years in payment of gratuity.\n<\/p>\n
            8.            The supplementary affidavit filed by the petitioners shows that<\/p>\n
            the gratuity paid in the year 2003-2004, starting from the month of October<\/p>\n
            2003 till the April’2004. Thus the petitioners also admit in their<\/p>\n
            supplementary affidavit that the gratuity has been paid after 30 days, when<\/p>\n
            it becomes due. In the supplementary affidavit it is not mentioned that<\/p>\n
            gratuity has been paid with interest as provided under section 7(3A) of Act.<\/p>\n
            Thus there is also contravention of section 7(3A) of Payment of Gratuity Act.<\/p>\n
            9.            Under the said circumstance, I find that prima facie there is a<\/p>\n
            contravention of section 7(iii) of the Gratuity Act, which is punishable under<\/p>\n
            section 9(ii) of the Payment of Gratuity Act.\n<\/p>\n
            10.           In view of the aforesaid discussion, I find that the court below<\/p>\n
            had rightly took cognizance against the petitioner along with others for the<\/p>\n
            offences under the payment of Gratuity Act.\n<\/p>\n
            11.           In the result, I find no merit in this application, the same is<\/p>\n
            dismissed.\n<\/p>\n<\/p>\n
