Justice K.T.SANKARAN\n\n Dated :21\/12\/2009\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                       B.A. NO. 7506 OF 2009\n             ------------------------------------------------------\n           Dated this the 21st day of December, 2009\n\n                                O R D E R\n<\/pre>\n<p>      This is an application for bail under Section 439 of the Code of<\/p>\n<p>Criminal Procedure. The petitioner is the accused in O.R.No.112 of<\/p>\n<p>2009 of Ezhukone Excise Range, Kollam District.<\/p>\n<p>      2. The offence alleged against the petitioner is under Section<\/p>\n<p>55(a) and (i) of the Abkari Act.\n<\/p>\n<\/p>\n<p>      3. The prosecution case is that on 5.12.2009, the petitioner<\/p>\n<p>was found engaged in the sale of Indian Made Foreign Liquor. A<\/p>\n<p>quantity of 4.45 litres of Indian Made Foreign Liquor was seized from<\/p>\n<p>the possession of the petitioner. The petitioner was arrested on<\/p>\n<p>5.12.2009 and he was remanded to judicial custody.<\/p>\n<p>      4. It is submitted by the learned counsel for the petitioner that<\/p>\n<p>the petitioner is not involved in any other case of similar nature.<\/p>\n<p>      5. Taking into account the facts and circumstances of the<\/p>\n<p>B.A. NO. 7506 OF 2009<\/p>\n<p>                                       :: 2 ::\n<\/p>\n<p>case, the duration of the judicial custody undergone by the petitioner,<\/p>\n<p>the nature of the offence and the present stage of investigation, I am<\/p>\n<p>of the view that bail can be granted to the petitioner.<\/p>\n<p>      6. The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.15,000\/- with two solvent sureties for the like amount to<\/p>\n<p>the satisfaction of the Judicial Magistrate of the First      Class &#8211; I,<\/p>\n<p>Kottarakara, subject to the following conditions:<\/p>\n<blockquote><p>       a)    The petitioner shall report before the investigating officer<br \/>\n             between 9 A.M.        and 11 A.M. on all Mondays, till the<br \/>\n             final report is filed or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>       b)    The petitioner shall appear before the investigating<br \/>\n             officer for interrogation as and when required;\n<\/p><\/blockquote>\n<blockquote><p>       c)    The petitioner shall not try to influence the prosecution<br \/>\n             witnesses or tamper with the evidence;\n<\/p><\/blockquote>\n<blockquote><p>       d)    The petitioner shall not commit any offence or indulge in<br \/>\n             any prejudicial activity while on bail;\n<\/p><\/blockquote>\n<blockquote><p>       e)    In case of breach of any of the conditions mentioned<br \/>\n             above, the bail shall be liable to be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>       The Bail Application is allowed as above.<\/p><\/blockquote>\n<p>                                                       (K.T.SANKARAN)<br \/>\n                                                             Judge<br \/>\nahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court John M. vs State Of Kerala Represented By The on 21 December, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7506 of 2009() 1.
