     The     tenant against whom an order of eviction was<\/p>\n
concurrently passed on the grounds of arrears of rent and bona<\/p>\n
fide need for own occupation is the petitioner in this revision<\/p>\n
under Section 20.    The respondents sought to evict him on the<\/p>\n
ground under clause (ii) of sub section (4) of Section 11 of Act 2<\/p>\n
of 1965 also.   But the Rent Control Court ordered eviction only<\/p>\n
on the ground of arrears of rent and bona fide need for own<\/p>\n
occupation. The eviction under section 11(4)(ii) was concurrently<\/p>\n
declined by the Rent Control Court and the Appellate Authority<\/p>\n
and we do not find any infirmity about that decision of the<\/p>\n
authorities below. As for the eviction order passed under the<\/p>\n
ground of arrears of rent, it is agreed by both sides that as of<\/p>\n
now no rent is in arrears and there is an agreement that order<\/p>\n
of eviction under Section 11 (2) (b) can be vacated      invoking<\/p>\n
powers under Section 11 (2)(c). Accordingly, we vacate the<\/p>\n
order of eviction passed under Section 11 (2) (b).<\/p>\n

     2. The need projected by the landladies, who are four in<\/p>\n
number, in the RCP was that their husbands are            presently<\/p>\n
without any job or avocation and that they want to carry on<\/p>\n
business in the petition schedule room as well as in the three<\/p>\n
other rooms in the larger building of which the petition schedule<\/p>\n
room is a part.   We are informed that the tenants in the other<\/p>\n
rooms have already vacated.      Bona fides of the need projected<\/p>\n
was disputed by the revision petitioner, who contended also<\/p>\n
that he is entitled for the protection of the second proviso to sub<\/p>\n
section (3) of Section 11. The Rent Control Court consolidated<\/p>\n
the RCPs and tried them jointly. Before the Rent Control Court,<\/p>\n
the  third petitioner in the RCP and her husband got themselves<\/p>\n
examined respectively as      PW1 and PW2.       On behalf of the<\/p>\n
tenants, RW1 the tenant in RCP No. 58\/2004 was examined.<\/p>\n
The Rent Control Court on appreciating the evidence came to the<\/p>\n
conclusion that the need projected by the landladies was bona<\/p>\n
fide and that the tenants were unsuccessful in proving that they<\/p>\n
are entitled for the protection of the second proviso to        sub<\/p>\n
section (3) of Section 11. The Appellate Authority concurred<\/p>\n
with all the conclusions of the Rent Control Court and confirmed<\/p>\n

the order of eviction passed under Section 11 (3).<\/p>\n
      3. In this revision under section 20, various grounds are<\/p>\n
raised challenging the correctness of the order of the Rent<\/p>\n
Control Court and the Judgment of the Appellate Authority. We<\/p>\n
have heard the submissions of Sri. Liju M.P., learned counsel for<\/p>\n
the    revision petitioner and those of Sri.C.Vathsalan, learned<\/p>\n
counsel for the respondents.\n<\/p>\n
      4. Sri.Liju M.P. Learned counsel for the revision petitioner<\/p>\n
submitted that the plea of the landladies is that their husbands<\/p>\n
were     without any employment or avocation and that          the<\/p>\n
building in question     is required so that they can conduct<\/p>\n
businesses. But the evidence of PW1 and PW2 is to the effect<\/p>\n
that the     husbands of at least three of the landladies are<\/p>\n
presently having business ( business in copra, steel and plywood)<\/p>\n
at Thalassery- their home town.       The learned counsel also<\/p>\n
submitted that it is very unlikely that the husbands of the<\/p>\n
landladies, who are presently put up at Thalassery in the family<\/p>\n
house together, will come over to Kottayam          which is at a<\/p>\n
distance of more than 300K.M.for doing business. According to<\/p>\n
the learned counsel, the finding of the authorities below that the<\/p>\n

evidence is to the effect that husbands of     the landladies are<\/p>\n
presently without    employment     or business is the result of<\/p>\n
misreading of evidence by those authorities. Sri.Liju read over<\/p>\n
to us the evidence of PW1 and PW2 and also that of RW1.<\/p>\n
      5.    Sri.C.Vathsalan,    learned    counsel      for    the<\/p>\n
respondents\/landladies would forcefully resist all the submissions<\/p>\n
of Sri.Liju. He would support the order of the Rent Control Court<\/p>\n
and the judgment of      the Appellate Authority on the various<\/p>\n
reasons stated therein. He submitted that in this jurisdiction<\/p>\n
under Section 20 of Act of 1956, this court is not expected to<\/p>\n
reappraise the evidence. According to him, the evidence adduced<\/p>\n
by PW1, PW2 and RW1 has been properly appreciated by the<\/p>\n
authorities below. He also submitted that the revision petitioner<\/p>\n
did not adduce even formal counter evidence to the evidence<\/p>\n
adduced by the landladies.\n<\/p>\n
      6. We have very anxiously considered the rival submissions<\/p>\n
addressed at the Bar. We have gone through the pleadings and<\/p>\n
we have gone through the testimonies of PW1, PW2 and RW1.<\/p>\n
We are unable to agree with the authorities below that PW1 and<\/p>\n
PW2 have given convincing evidence to the effect that the<\/p>\n

husbands of the four landladies are presently without any<\/p>\n
employment or avocation for life. The evidence at the most is to<\/p>\n
the effect that     husband of PW1(PW2) who was presently<\/p>\n
running a hotel in Andra Pradesh is presently unemployed.       For<\/p>\n
the husbands of the other landladies, what we notice from the<\/p>\n
evidence is that their husbands are presently having some<\/p>\n
business at Thalassery- their home town.      This is an aspect of<\/p>\n
which the more authentic evidence can be given by those<\/p>\n
husbands only. We feel that non examination of the husbands of<\/p>\n
the landladies other than PW1 is a material omission in the<\/p>\n
evidence of the landladies in this case.   We are of the view that<\/p>\n
on the facts and circumstances     of the case, an opportunity can<\/p>\n
be given to the landladies to examine the husbands of the<\/p>\n
other three landladies also. The power of the Rent Control<\/p>\n
Appellate Authority   to hold enquiry in terms of the statutory<\/p>\n
provisions is co terminus with that of the Rent Control court<\/p>\n
itself. Since the RCP is an old one, we are of the view that in<\/p>\n
this case, the Appellate Authority itself can be directed to permit<\/p>\n
the respondents to examine the husbands of the landladies 1, 2<\/p>\n
& 4.\n<\/p>\n

      7. We notice that the petition schedule building is situated<\/p>\n
at Pulimood junction which is commercially a vantage point in<\/p>\n
the Kottayam Municipal town and that the monthly          rent of<\/p>\n
Rs.600\/- presently being paid by the revision petitioner is very<\/p>\n
low. We are, therefore, of the view that the rent payable by the<\/p>\n
revision petitioner can be prospectively enhanced subject to<\/p>\n
fixation of fair rent by the Rent Control Court at the instance of<\/p>\n
either of the parties.\n<\/p>\n
      8. Result of the above discussion is as follows;<\/p>\n
                 i). The   judgment of the Appellate<\/p>\n
           Authority is set aside.\n<\/p><\/blockquote>\n
                 ii).   The appeal is remanded to the<\/p>\n
           Appellate Authority. The Appellate Authority<\/p>\n
           is directed to permit the landladies to<\/p>\n
           examine the husbands of the landladies 1,<\/p>\n
           2 and 4 as further witness on their side.<\/p>\n<\/blockquote>\n
           They are also permitted to produce       any<\/p>\n
           other documentary evidence which may<\/p>\n
           support their case that the husbands of the<\/p>\n
           landladies   are  presently   without    any<\/p>\n

          employment.       If  further    evidence   is<\/p>\n
          adduced by the landladies, the revision<\/p>\n
          petitioner also should be permitted by the<\/p>\n
          Appellate Authority to adduce         counter<\/p>\n
          evidence.\n<\/p><\/blockquote>\n
                Iii). The Appellate Authority will take<\/p>\n
          fresh decision in the matter on the basis of<\/p>\n
          the evidence already on record and further<\/p>\n
          evidence,    which may be adduced, at the<\/p>\n
          earliest and at any rate within two months<\/p>\n
          of the parties entering appearance before<\/p>\n
          the Appellate Authority pursuant to this<\/p>\n
          judgment.\n<\/p><\/blockquote>\n
                iv). The revision petitioner shall pay<\/p>\n
          the rent to the respondents\/landladies      at<\/p>\n
          the rate of Rs.1500\/- per month with effect<\/p>\n
          from 1\/1\/2010.\n<\/p><\/blockquote>\n
       7. We make it clear that the above fixation of rent is<\/p>\n
tentative and will be subject to regular fixation of fair rent by the<\/p>\n
Rent Control Court if either of the parties are aggrieved. Parties<\/p>\n

are directed to enter appearance before the Rent Control<\/p>\n
Appellate Authority 15\/1\/2010.\n<\/p>\n
    Transmit the entire records forthwith to the Rent Control<\/p>\n
