          Petitioner filed C.M.P.4045\/2009<\/p>\n
before Judicial First Class Magistrate-I,<\/p>\n
Kochi for a “no objection certificate”                     for<\/p>\n
issuance of passport as he was shown as an<\/p>\n
accused in crime No.306\/2007 of Thoppumpady<\/p>\n
police  station,          though            a      final  refer<\/p>\n
report was filed on 17\/4\/2008 itself. By<\/p>\n
Ext.P7 order, the           petition was dismissed.<\/p>\n
This petition is filed under Articles 226<\/p>\n
and  227  of     Constitution                  of    India for<\/p>\n
quashing Ext.P7 order and for a direction<\/p>\n
to the third respondent, Regional Passport<\/p>\n
Officer  to     issue           an        Indian       passport<\/p>\n
notwithstanding       the            pendency         of  crime<\/p>\n
No.306\/2007. Case of the petitioner is that<\/p>\n
Wpc 394\/2010               2<\/span><\/p>\n
though he was shown as one of the accused in<\/p>\n
crime No.708\/2006,       crime No.711\/2006 and<\/p>\n
Crime No.972\/2004 of Central Police Station<\/p>\n
and      crime    No.1865\/2005       and   crime<\/p>\n
No.535\/2009 of      Baliapattam  police station<\/p>\n
and    crime    No.124\/2009  of  Ernakulam  Town<\/p>\n
South       Police   Station,   Chief   Judicial<\/p>\n
Magistrate,     Ernakulam     granted  him    no<\/p>\n
objection certificates in crime No.708\/2006,<\/p>\n
711\/2006 and      972\/2004  and Judicial First<\/p>\n
Class      Magistrate-I,  Ernakulam  granted  no<\/p>\n
objection certificate in crime No.1865\/2005<\/p>\n
and     Judicial   First   Class  Magistrate-II,<\/p>\n
Kannur granted      no objection certificate in<\/p>\n
crime     No.535\/2009   and  Additional    Chief<\/p>\n
Judicial Magistrate,      Ernakulam  granted no<\/p>\n
objection certificate in crime No.124\/2009.<\/p>\n
But learned Magistrate by Ext.P7 order alone<\/p>\n
did not issue a no objection certificate. It<\/p>\n
Wpc 394\/2010              3<\/span><\/p>\n
is contended     that  learned Magistrate has<\/p>\n
illegally     refused  to  grant  no  objection<\/p>\n
certificate by Ext.P7 order.\n<\/p>\n
           2. Learned counsel appearing for the<\/p>\n
petitioner     and  learned  Public  Prosecutor<\/p>\n
were heard.\n<\/p>\n
           3. Section 6(2) of the Passport Act<\/p>\n
provides that Subject to the provisions      of<\/p>\n
the Act, Passport authority shall refuse to<\/p>\n
issue a passport or travel        document for<\/p>\n
visiting any foreign country under clause(c)<\/p>\n
of Sub Section 2 of Section 5 of any one or<\/p>\n
more of the ground       provided under clause<\/p>\n
(a)     to  (i).   Under  clause  (f)  if  the<\/p>\n
applicant is alleged to have committed an<\/p>\n
offence      pending before   a criminal court<\/p>\n
in India, passport shall not be issued as<\/p>\n
provided under Sub Section 2 of Section 5.<\/p>\n
\n\nSection 22 empowers     the Central Government,\n\nWpc 394\/2010               4<\/span>\n\n\nif   it     is  of  the    opinion  that  it  is\n\nnecessary      or   expedient  in   the   public\n\n<\/pre>\n
interest so to do, by notification in the<\/p>\n
official      gazette and   subject to the said<\/p>\n
conditions       it may specify    in the said<\/p>\n
notification, exempt any person or class of<\/p>\n
persons      from the operation of all or any of<\/p>\n
the provisions of the Act or Rules made<\/p>\n
thereunder. In exercise of the said power,<\/p>\n
as    per    notification  dated  25\/8\/1993  the<\/p>\n
Ministry      of   External  Affairs,   exempted<\/p>\n
citizens of India against whom proceedings<\/p>\n
in respect of an offence alleged to have<\/p>\n
been committed by them      are pending before a<\/p>\n
criminal court       and who    produce   orders<\/p>\n
from the court concerned permitting them to<\/p>\n
depart from India from the         operation of<\/p>\n
clause (f) of Sub Section 2 of Section 6,<\/p>\n
subject to the conditions in clauses (a) to<\/p>\n
Wpc 394\/2010              5<\/span><\/p>\n
(d). By the said notification irrespective<\/p>\n
of    the    provisions  of  Section  6(2)(f),<\/p>\n
passport can be issued to an applicant on<\/p>\n
the conditions provided in the notification.<\/p>\n
Schedule III      of Passport Act provides for<\/p>\n
the passport application form. Clause (17)<\/p>\n
therein     relates  to  criminal proceedings.<\/p>\n
Under sub clause (b), an applicant has to<\/p>\n
reveal      whether  there  is   any  criminal<\/p>\n
proceedings pending against him before any<\/p>\n
court in India and if so, details of the<\/p>\n
court, case number and relevant Sections of<\/p>\n
law are to be shown. Under clause (c) if<\/p>\n
answer       to sub clause (b) is ‘yes’,   the<\/p>\n
applicant has to furnish       a non objection<\/p>\n
certificate from     the  competent court for<\/p>\n
grant of passport. It is in view of the said<\/p>\n
provisions,     petitioner  has   applied  for<\/p>\n
getting no objection certificate from the<\/p>\n
Wpc 394\/2010             6<\/span><\/p>\n
learned Magistrate.\n<\/p>\n
           4. Ext.P7 order itself shows that<\/p>\n
Assistant Public Prosecutor reported to the<\/p>\n
learned Magistrate that prosecution has no<\/p>\n
objection       for  issuing    no   objection<\/p>\n
certificate.     The order   also shows   that<\/p>\n
though petitioner is shown as an accused in<\/p>\n
crime No.306\/2007     of   Thoppumpady police<\/p>\n
station, a final refer report has already<\/p>\n
been submitted on 17\/4\/2008 stating that    it<\/p>\n
is a false case. Though    a protest complaint<\/p>\n
was filed by the de facto complainant before<\/p>\n
the learned Magistrate and it is pending, no<\/p>\n
offence was so far taken cognizance. In such<\/p>\n
circumstances,     though petitioner is shown<\/p>\n
as    an    accused in  crime  No.306\/2007 of<\/p>\n
Thoppumpady police     station, when a refer<\/p>\n
report has already been submitted in that<\/p>\n
crime after investigation before the court,<\/p>\n
Wpc 394\/2010              7<\/span><\/p>\n
though protest complaint was filed,      as no<\/p>\n
offence     is   so  far   taken    cognizance,<\/p>\n
technically there cannot be any objection<\/p>\n
to the petitioner to get a passport. In such<\/p>\n
circumstances, learned      Magistrate was not<\/p>\n
justified in        refusing   to  issue a  no<\/p>\n
objection certificate on the grounds shown<\/p>\n
in Ext.P7 order. Question whether original<\/p>\n
passport which had expired long back, was<\/p>\n
irrecoverably lost      or  not   is  not very<\/p>\n
relevant for the purpose of issuing a no<\/p>\n
objection     certificate.   What   is  to   be<\/p>\n
considered by the learned Magistrate is only<\/p>\n
whether     presence   of  the   petitioner  is<\/p>\n
necessary for the purpose of the enquiry or<\/p>\n
trial in the case. I find no reason to<\/p>\n
refuse to grant a no objection certificate<\/p>\n
to the petitioner.\n<\/p>\n
           Petition is allowed. Ext.P7 order is<\/p>\n
Wpc 394\/2010           8<\/span><\/p>\n
quashed. Judicial First Class Magistrate-I,<\/p>\n
Kochi is directed to issue a no objection<\/p>\n
certificate   to the   petitioner  in  crime<\/p>\n
No.306\/2007 of Thoppumpady police station as<\/p>\n
sought for in C.M.P.4045\/2009. It is for the<\/p>\n
third respondent to issue the passport to<\/p>\n
the petitioner in accordance with law.<\/p>\n
