With the consent of<br \/>\n\tlearned advocates appearing for both the sides, the appeal is<br \/>\n\tfinally heard.\n<\/p>\n<p>The<br \/>\n\tpresent appeal is preferred against the order dated 8.5.2008 passed<br \/>\n\tby the learned Single Judge of this Court in Special Civil<br \/>\n\tApplication No. 7145\/2008 whereby the Learned Single Judge declined<br \/>\n\tto interfere in the proceedings of inquiry including that of<br \/>\n\tsuspension.\n<\/p>\n<p>This<br \/>\n\tCourt had on 14.5.2008 passed the following order in Civil<br \/>\n\tApplication No.6069\/2008:\n<\/p>\n<p>\u00fdSNotice<br \/>\nto the opponents returnable on 16th June, 2008.\n<\/p>\n<p>\tPending<br \/>\nthe Appeal, there shall be ad-interim stay of the further<br \/>\nimplementation and operation of the order of suspension dated 28th<br \/>\nApril, 2008 on condition that the applicant will, within 15 days from<br \/>\ntoday, give an undertaking to this Court to the effect that<br \/>\nhenceforth the applicant will perform his duties regularly and<br \/>\ndiligently. Copy of the undertaking will be given to the opponent<br \/>\nno.1 Chief Officer, Keshod Nagarpalika.\n<\/p>\n<p>Registry<br \/>\nwill send the writ forthwith.\u00fd\u00fd<\/p>\n<p>In<br \/>\n\tthe present Letters Patent Appeal, following order was passed :\n<\/p>\n<p>\t\u00fdSNotice<br \/>\n\tto the respondents returnable on 16th June, 2008.\n<\/p>\n<p>The<br \/>\nappellant will, on or before the returnable date deposit a sum of Rs.<br \/>\n1,500=00 by way of cost of this Appeal in the registry of this Court.<br \/>\nThe appellant will scrupulously attend to the disciplinary<br \/>\nproceedings initiated against him.\n<\/p>\n<p>The<br \/>\nRegistry will issue the writ forthwith.\u00fd\u00fd<\/p>\n<p>Learned<br \/>\n\tCounsel for the respondent Municipality states before the Court that<br \/>\n\tpursuant to the interim order passed on 14.5.2008, the suspension<br \/>\n\torder has been revoked and the appellant is taken on duty and he<br \/>\n\tfurther states that if pending the inquiry, the suspension is<br \/>\n\tcontinued as revoked, the Municipality has no objection for such<br \/>\n\tpurpose. However, he submitted that the Municipality may be at<br \/>\n\tliberty to continue with the inquiry proceedings in accordance with<br \/>\n\tlaw.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tPaul, learned Counsel appearing for the appellant however, contended<br \/>\n\tthat for one day absence, such a serious action is taken and it was<br \/>\n\tfurther submitted on behalf of the appellant that the Municipality<br \/>\n\tis desirous of applying pressure tactics under the guise of the<br \/>\n\tpresent inquiry and therefore, he submitted that for one day<br \/>\n\tabsence, if the major penalty is imposed upon the petitioner,<br \/>\n\tirreversible situation may arise though it is not a case for<br \/>\n\timposition of major penalty.\n<\/p>\n<p>Having<br \/>\n\tconsidered the facts and circumstances of the case, it appears that<br \/>\n\twhen the suspension is already revoked and the Municipality has no<br \/>\n\tobjection for continuation of the said position, the inquiry can<br \/>\n\tproceed in accordance with law. At the inquiry, appellant original<br \/>\n\tpetitioner may raise all contentions as may be available in<br \/>\n\taccordance with law.
