Justice R.BASANT\n\n Dated :30\/10\/2008\n\n O R D E R\n                           R.BASANT, J.\n                        ----------------------\n                     Crl.M.C.No.3478 of 2008\n                    ----------------------------------------\n             Dated this the 30th day of October 2008\n\n                               O R D E R\n<\/pre>\n<p>     The petitioner and the fourth respondent face allegations in<\/p>\n<p>a crime registered alleging the offence punishable under Section<\/p>\n<p>392 I.P.C.    The crux of the allegations is that the de facto<\/p>\n<p>complainant who had voluntarily got into a car and had travelled<\/p>\n<p>along with the accused persons was allegedly robbed of a gold<\/p>\n<p>chain which he had in his possession. Crime was registered.<\/p>\n<p>Investigation is in progress. In the course of the investigation,<\/p>\n<p>parties have settled their disputes. They have come before this<\/p>\n<p>court to apprise the court of the fact that the disputes having<\/p>\n<p>been settled between them, they may be saved of the<\/p>\n<p>unnecessary and undeserved trauma of continuance of the<\/p>\n<p>proceedings. The petitioner had initially arrayed only the third<\/p>\n<p>respondent, that is the de facto complainant as a party. Later, in<\/p>\n<p>the course of the proceedings, the fourth respondent\/first<\/p>\n<p>accused has also been arrayed as party. The third respondent<\/p>\n<p>has entered appearance through counsel.                     He has filed an<\/p>\n<p>affidavit to confirm that he has settled his disputes with both the<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3478\/08              2<\/span><\/p>\n<p>accused persons.      The fourth respondent has not entered<\/p>\n<p>appearance. In these circumstances, the counsel pray that the<\/p>\n<p>extraordinary inherent jurisdiction under Section 482 Cr.P.C as<\/p>\n<p>enabled by the dictum in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of<\/p>\n<p>Punjab<\/a> [2008 AIR SCW 2287] and Nikhil Merchant v.<\/p>\n<p>Central Bureau of Investigation [2008(3) KLT 769(SC)]<\/p>\n<p>may be invoked to bring to premature termination the<\/p>\n<p>proceedings initiated by the registration of crime No.425\/2008.<\/p>\n<p>      2.    Notice was given to the learned Public Prosecutor.<\/p>\n<p>The learned Public Prosecutor does not oppose the application.<\/p>\n<p>The learned Public Prosecutor submits that the State has no<\/p>\n<p>objection against quashing of proceedings. The dispute is one<\/p>\n<p>which is purely personal and private between the parties. The<\/p>\n<p>friends were travelling in a car and consumed alcohol.       The<\/p>\n<p>incident occurred in the course of such activity between the<\/p>\n<p>friends.    In these circumstances, the State has no objection<\/p>\n<p>against quashing of further proceedings in that crime, submits<\/p>\n<p>the learned Public Prosecutor.\n<\/p>\n<p>      3.    Having considered all the relevant circumstances, I<\/p>\n<p>am satisfied that the parties have voluntarily and willingly<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3478\/08               3<\/span><\/p>\n<p>settled all their disputes and that the third respondent has<\/p>\n<p>compounded the offences allegedly committed by the petitioner<\/p>\n<p>and the fourth respondent herein.\n<\/p>\n<p>      4.    The learned Public Prosecutor further confirms that<\/p>\n<p>the accused persons are not involved in any similar offence. The<\/p>\n<p>dispute between the parties appear to be purely private and<\/p>\n<p>personal one. No public interest or interest of public justice is<\/p>\n<p>involved also.     The proceedings can hence be brought to<\/p>\n<p>premature termination by invoking the jurisdiction under Section<\/p>\n<p>482 Cr.P.C as enabled by the dictum in Madan Mohan and<\/p>\n<p>Nikhil Merchant (Supra).<\/p>\n<pre>\n\n      5.
