Therefore, the application is dismissed as not pressed so<br \/>\n\tfar as applicant No. 1 is concerned. This application is treated to<br \/>\n\thave been survived only in respect of applicant No.2.\n<\/p>\n<p>Rule.\n<\/p>\n<p>\tMr. Kodekar, learned APP waives service of Rule on behalf of<br \/>\n\trespondent State. By consent, Rule is fixed forthwith.\n<\/p>\n<p>The<br \/>\n\tapplicant &#8211; accused No. 2, who has been arrested in I.CR. No.<br \/>\n\t165 of 2010 registered with Sabarmati Police Station for the<br \/>\n\toffences punishable under Sections 306 and 114 of the Indian Penal<br \/>\n\tCode  has moved this Court under Section 439 of the Code of Criminal<br \/>\n\tProcedure for seeking bail pending trial.\n<\/p>\n<p>The<br \/>\n\taccused moved the application being Criminal Misc. Application No.<br \/>\n\t553 of 2010 before the concerned Sessions Court, which came to be<br \/>\n\trejected on 13.5.2007.\n<\/p>\n<p>Looking<br \/>\n\tto averments in the FIR and facts as it is reflected in the order of<br \/>\n\tthe Sessions Court, this Court is of the considered view that the<br \/>\n\tapplicant No. 2 deserves to be admitted to bail for the following<br \/>\n\treasons:\n<\/p>\n<p>Looking<br \/>\n\tto the age of accused-applicant No. 2, who happens to be the<br \/>\n\tmother-in-law and role attributed to her and looking to all the<br \/>\n\tconsiderations enlisted in Section 437 of the Code of Criminal<br \/>\n\tProcedure, she deserves to be enlarged on bail .\n<\/p>\n<p>The<br \/>\n\tprosecution has not voiced any grievance or expressed any<br \/>\n\tapprehension that she is likely to flee from justice, if she is<br \/>\n\treleased on bail.\n<\/p>\n<p>The<br \/>\n\tprosecution have also not expressed any grievance or apprehension<br \/>\n\tthat she is capable of tempering with evidences or influencing the<br \/>\n\twitnesses, if she is released on bail.\n<\/p>\n<p>The<br \/>\n\tSessions Court has not appreciated these aspect and therefore, the<br \/>\n\tsaid order deserves to be quashed and set aside and accordingly, it<br \/>\n\tis quashed and set aside.\n<\/p>\n<p>The<br \/>\n\taforesaid observations are made only for the purpose of examining<br \/>\n\tthe prayer for bail pending trial. These observations are<br \/>\n\tprima-facie and shall have no bearing whatsoever upon the trial and<br \/>\n\tthe trial Court shall not be influenced by it in any way and come to<br \/>\n\tits own conclusion after analyzing the evidence that may be led<br \/>\n\tduring the trial.\n<\/p>\n<p>Considering<br \/>\n\tthe submissions made on behalf of the parties and having regard to<br \/>\n\tthe circumstances and facts of the case, the application is partly<br \/>\n\tallowed and the applicant No. 2 is ordered to be released on bail in<br \/>\n\tconnection with Crime Register No.I-165 of 2010 of Sabarmati Police<br \/>\n\tStation on her executing a bond of Rs.5,000\/- (Rupees Five Thousand<br \/>\n\tonly) with one surety of the like amount to the satisfaction of the<br \/>\n\tlower Court and subject to the conditions that she shall :\n<\/p>\n<p>\t(a)\tnot<br \/>\n\ttake undue advantage of her liberty or \tabuse her liberty:\n<\/p>\n<p>\t(b)\tnot<br \/>\n\tact in a manner injurious to the \tinterest of the prosecution:\n<\/p>\n<p>\t(c)\tmaintain<br \/>\n\tlaw and order;\n<\/p>\n<p>\t(d)\tnot<br \/>\n\tleave the State of Gujarat without the \tprior permission of the<br \/>\n\tSessions Court \tconcerned;\n<\/p>\n<p>\t(e)\tfurnish<br \/>\n\tthe address of her residence at the \ttime of execution of the bond<br \/>\n\tand shall not \tchange the residence without prior \tpermission of<br \/>\n\tthis Court;\n<\/p>\n<p>\t(f)\tsurrender<br \/>\n\ther passport, if any, to the lower \tCourt within a week.\n<\/p>\n<p>\t7.<br \/>\n\tIf breach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or to take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\t8.<br \/>\n\tBail before the lower Court having jurisdiction to try the case.\n<\/p>\n<p>\t9.<br \/>\n\t Rule is made absolute.
