Dinesh Kumar &amp; Ors.\n\n\nDATE OF ORDER : - 12.9.2008\n\n\n          HON'BLE MR. PRAKASH TATIA, J.\n<\/pre>\n<p>Mr. Farzand Ali, for the appellant.<\/p>\n<p>     Heard learned counsel for the appellant.<\/p>\n<p>     The learned tribunal has found that according to the<\/p>\n<p>claimant the accident occurred on 16th Oct., 2004. The FIR<\/p>\n<p>was lodged on 22nd Oct., 2004. In the FIR, driver&#8217;s name<\/p>\n<p>was given as Dinesh and scooter number was shown as<\/p>\n<p>RJ9-2M 6545. The tribunal found that the FIR was lodged<\/p>\n<p>after concocting the story, but even then subsequently, the<\/p>\n<p>same was also changed.\n<\/p>\n<p>     The tribunal has considered the evidence in detail and,<\/p>\n<p>thereafter, reached to the conclusion that the appellant<\/p>\n<p>failed to prove the accident from the vehicle in question and<\/p>\n<p>rejected the claim petition.     Looking to the totality of the<\/p>\n<p>facts, I need not to refer the facts in detail.\n<\/p>\n<p>                                                  SBCMA No.1319\/2008<br \/>\n                          Dhanna Lal @ Dhanraj Vs.
