Justice R.BASANT\n\n Dated :20\/06\/2007\n\n O R D E R\n                                  R.BASANT, J\n\n                       = = = = = = = = = = = = =\n\n                           Crl.M.C.No.778 Of 2007\n\n                      = = = = = = = = = = = = = =\n\n\n                    Dated this the 20th day of June, 2007\n\n\n                                      ORDER\n<\/pre>\n<p>       The learned counsel for the petitioners prays, the learned Public<\/p>\n<p>Prosecutor does not oppose the said prayer and I am satisfied that in<\/p>\n<p>the   light   of   the   decision   in  <a href=\"\/doc\/1188125\/\">State   of   Kerala   and   Others   v.   Unni<\/a><\/p>\n<p>[2007(1) KLT 151 (S.C) ], this prosecution in which the only allegation<\/p>\n<p>is   that   the   percentage   of   Ethyl   Alcohol   in   toddy   exceeds   the<\/p>\n<p>permissible   figure   cannot   be   sustained.     This   Crl.M.C   is,   in   these<\/p>\n<p>circumstances,   allowed.
