Justice M.SASIDHARAN NAMBIAR\n\n Dated :30\/09\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.4007 of 2010\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioner,  the   first  accused  in   S.C.No.<\/p>\n<p>263\/2010 on the file of Assistant Sessions Court,<\/p>\n<p>Koyilandy, filed this petition under Section 482 of<\/p>\n<p>Code of Criminal Procedure to quash the proceedings<\/p>\n<p>contending that continuation of the proceedings is<\/p>\n<p>only an abuse of process of the court.<\/p>\n<p>    2. Learned counsel appearing for the petitioner<\/p>\n<p>was heard.\n<\/p>\n<p>    3. Though learned counsel appearing for the<\/p>\n<p>petitioner persuaded me to appreciate the evidence<\/p>\n<p>and find that the case of the first accused cannot<\/p>\n<p>be  accepted  in   view  of  his   sworn  statement<\/p>\n<p>recorded, it is not for this Court to appreciate<\/p>\n<p>the  evidence   at  this   stage   and  quash   the<\/p>\n<p>proceedings as sought for, when petitioner is at<\/p>\n<p>liberty to raise all the contentions before the<\/p>\n<p>learned  Sessions  Judge  and  seek   an order   of<\/p>\n<p><span class=\"hidden_text\">CRMC 4007\/10               2<\/span><\/p>\n<p>discharge under Section 227 of Code of Criminal<\/p>\n<p>Procedure.    Learned  counsel then  submitted  that<\/p>\n<p>presence of the petitioner may be dispensed with<\/p>\n<p>for the purpose of claiming an order of discharge<\/p>\n<p>under Section 227 of Constitution of India.<\/p>\n<p>     Petition is disposed granting liberty to the<\/p>\n<p>petitioner to raise all the contentions raised<\/p>\n<p>herein and seek an order of discharge under Section<\/p>\n<p>227 of Code of Criminal Procedure.
