Singh learned counsel for the petitioner and<br \/>\nSri A. C. Tripathi, learned Standing Counsel.<br \/>\nBy means of present petition, the petitioner is challenging<br \/>\nthe levy of transit fee, which is being demanded by the<br \/>\nrespondents. The case of the petitioner is that he is<br \/>\ntransporting coal, which is not forest produce. It is also the<br \/>\ncase of the petitioner that he is not transporting the product<br \/>\nthrough forest, therefore, the demand of transit fee is not<br \/>\njustified.\n<\/p>\n<p>learned counsel for the petitioner submitted that the decision<br \/>\nof this Court in the case of Kanhaiya Singh and another Vs.<br \/>\nState of U.P. and others has been challenged before the<br \/>\nApex Court in Special Leave to Appeal. In Special Leave to<br \/>\nAppeal (Civil) No. 11367 of 2007 Kanhaiya Singh and<br \/>\nanother Vs. State of U.P. and others, the realization of<br \/>\ntransit fee has been stayed but the said order has been<br \/>\nsubsequently modified by the Apex Court on 10.12.2008 and<br \/>\nApex Court directed to maintain a separate account. In the<br \/>\nlight of the aforesaid orders, this Court while entertaining the<br \/>\nwrit petition has passed the order dated 4.3.2009 directing<br \/>\nthe respondents to maintain a separate account in respect of<br \/>\nthe money collected from the petitioners towards transit fee<br \/>\non various forest produce brought within the territories of the<br \/>\nState of U.P. but the realization of transit fee has not been<br \/>\nstayed. He submitted that against the said order Special<br \/>\nLeave to Appeal (Civil) No. 11923 of 2009 has been filed.<br \/>\nThe Apex Court has entertained the petition on 15.5.2009<br \/>\nand connected the matter with Special Leave to Appeal<br \/>\n(Civil) No. 11367 of 2007 Kanhaiya Singh and another Vs.<br \/>\nState of U.P. and others and till the final disposal of the<br \/>\nmatter, recovery proceeding has been stayed. In view of the<br \/>\naforesaid order passed by the Apex Court, he submitted that<br \/>\nin the present case the recovery proceeding be stayed.<br \/>\nSri A.C. Tripathi, learned Standing Counsel submitted that<br \/>\nthe interim order may be passed in the light of the order<br \/>\n passed by the Apex Court.\n<\/p>\n<p>In view of the above, we pass the following order:<br \/>\n&#8220;Learned Standing Counsel prays for and is granted four<br \/>\nweeks time to file counter affidavit. Rejoinder affidavit may<br \/>\nbe filed within two weeks thereafter.\n<\/p>\n<p>List thereafter.\n<\/p>\n<p>Till the next date of listing, the recovery of transit fee against<br \/>\nthe petitioner shall remain stayed.
