We have heard learned counsel for the parties.\n<\/p>\n<p>3.   This  appeal by special leave arises from the order  of<br \/>\nthe Allahabad High Court in CMWP No. 2669 of 1990 dated 11 &#8211;<br \/>\n11-  1992.  The admitted facts are that one  Hariram  Yadav,<br \/>\nwhile  working\tas  clerk,  went on  leave.   In  the  leave<br \/>\nvacancy,  the respondent came to be appointed  till  Hariram<br \/>\nYadav joined the duty.\tBy resolution dated 28-12-1986,\t the<br \/>\nManaging  Committee resolved that even after  Hariram  Yadav<br \/>\njoins duty on 1-5-1987, the service of the respondent  would<br \/>\nbe continued uninterruptedly.  It is stated in the  counter-<br \/>\naffidavit  filed  in  this Court that the  approval  of\t the<br \/>\nDistrict  Inspector  of Schools was also  obtained  in\tthat<br \/>\nbehalf.\t  But no supporting material has been placed  before<br \/>\nus.   The valid appointment of the non-teaching staff  of  a<br \/>\nprivate\t aided\tinstitution  to\t be  valid,  should  be\t  in<br \/>\naccordance  with the relevant rules.  Since the validity  of<br \/>\nthe appointment of the additional clerk is not in issue,  we<br \/>\nneed deal with the matter in depth.\n<\/p>\n<p><span class=\"hidden_text\">467<\/span><\/p>\n<p>4.   Be that as it may, the crucial question is whether\t the<br \/>\nschool\tof  the respondent can claim  reimbursement  of\t the<br \/>\nsalary\tof  such clerk from the Government?   The  U.P\tHigh<br \/>\nSchools\t and Intermediate Colleges (Payment of\tSalaries  of<br \/>\nTeachers  and Other Employees) Act, 1971 (24 of 197 1)\t(for<br \/>\nshort &#8216;the Act&#8217;), regulates the payment of the salary by the<br \/>\nGovernment.   Section  9  is relevant in  that\tbehalf.\t  It<br \/>\nprovides  that\tno institution shall create a  new  post  of<br \/>\nteacher or other employee except with the previous  approval<br \/>\nof the Director or such officer as may be empowered in\tthat<br \/>\nbehalf\tby  the Director.  Admittedly, no  steps  have\tbeen<br \/>\ntaken  by the Management to have obtained prior approval  of<br \/>\nthe Director or any other authorised officer for creation of<br \/>\nthe  additional\t post of clerk.\t The prior approval  of\t the<br \/>\nDirector  or the empowered officer is a condition  precedent<br \/>\nand  mandatory,\t for  creation of an additional\t post  of  a<br \/>\nteacher\t or other employee.  The reason behind Section 9  is<br \/>\nthat prior to grant of aid the Government had before it\t the<br \/>\nrelevant  data of the posts for which the grant of  aid\t was<br \/>\nsanctioned.  To make the Government to reimburse the  salary<br \/>\nof  an\tadditional teacher or an  employee,  the  Government<br \/>\nshould\thave similar relevant material and data to  have  it<br \/>\nduly  verified and decision taken to grant sanction  of\t the<br \/>\nadditional post.  The inspecting and reporting officers\t are<br \/>\nenjoined  to make personal inspection and submit the  report<br \/>\nof  the existing correct facts.\t The dereliction of duty  or<br \/>\nincorrect  or  false reports would be  misconduct  entailing<br \/>\nthem  to  disciplinary action for dismissal from  the  posts<br \/>\nheld  by  them.\t  Therefore, the  failure  to  obtain  prior<br \/>\napproval disentitles the Management to obtain  reimbursement<br \/>\nof the salary of such teacher or other employee.\n<\/p>\n<p>5.   Shri Pramod Swarup, learned counsel for the respondent,<br \/>\nplaced\t before\t us  the  direction  issued  by\t the   State<br \/>\nGovernment  for\t creation  of an additional  post  when\t the<br \/>\nstrength of the students exceeds 1100.\tIt is his contention<br \/>\nthat  since the strength of the students has been more\tthan<br \/>\n1100, the creation of additional clerk has become  necessary<br \/>\nand that, therefore, the Management has resolved to  appoint<br \/>\nthe  respondent\t as an additional clerk.  We  are  concerned<br \/>\nwith the creation of the additional post, may be, due to the<br \/>\nincrease  in the strength of students.\tWhat is material  is<br \/>\nwhether\t prior\tapproval of the Director  or  the  empowered<br \/>\nofficer has been obtained before creating that post.  It  is<br \/>\nnot  the case of the respondent or the Management that\tsuch<br \/>\nprior  approval had been obtained or given by the  competent<br \/>\nofficer.  Therefore, so long as prior approval had not\tbeen<br \/>\ngiven,\tthough the respondent might have been  appointed  by<br \/>\nthe  Management, the Government is not obliged to  reimburse<br \/>\nthe  salary paid to such clerk.\t The Management has to\tbear<br \/>\nthe expenditure from its own resources without claiming\t any<br \/>\nreimbursement\tfrom  the  Government.\t The   High   Court,<br \/>\ntherefore,  has\t committed  grievous error  of\tlaw  in\t not<br \/>\nadverting  to  this crucial question and allowing  the\twrit<br \/>\npetition directing the Government to create the post and  to<br \/>\nmake  the  payment of the salary etc.\tThe  directions\t are<br \/>\nwholly illegal and legally unsustainable.\n<\/p>\n<p><span class=\"hidden_text\">468<\/span><\/p>\n<p>6.it  is  stated and brought to our notice that a  post\t has<br \/>\nbeen  created  by the Government pursuant  to  the  impugned<br \/>\norder  passed  by the High Court.  But the  Government\thave<br \/>\nalso stated therein that it was subject to the result in the<br \/>\nappeal.\t In that view, the creation of the post would not be<br \/>\nan  advantageous  feature that favours the  respondent.\t  If<br \/>\nthere  is any increase in the strength and sanction  of\t the<br \/>\npost  is  needed,  it  is open to  the\tManagement  to\ttake<br \/>\nappropriate steps as per law.\n<\/p>\n<p>7.   Accordingly, the order of the High Court is set  aside.<br \/>\nThe  civil  appeal  is allowed.\t The  writ  petition  stands<br \/>\ndismissed.
