Justice M.L.JOSEPH FRANCIS\n\n Dated :25\/09\/2009\n\n O R D E R\n          K.M.JOSEPH &amp; M.L.JOSEPH FRANCIS, JJ.\n        ------------------------------------------------------\n                 W.P.(Crl. )No.384 of 2009-S\n           ----------------------------------------------\n         Dated, this the 25th day of September, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>K.M.Joseph, J.\n<\/p>\n<p>            The prayer in this writ petition is to issue a writ of<\/p>\n<p>Habeas Corpus directing respondents 2 to 8 to produce the<\/p>\n<p>son of the petitioner before this Court.<\/p>\n<p>            2. Today when the matter came up we heard the<\/p>\n<p>learned counsel for the petitioner and learned Government<\/p>\n<p>Pleader.   The alleged detenue was present before us. When<\/p>\n<p>we questioned him, he would say that he was not under<\/p>\n<p>detention of respondents 6 to 8 which is the allegation in the<\/p>\n<p>writ petition.   Admittedly, the alleged detenue is aged 22<\/p>\n<p>years and he is a major. Learned counsel for the petitioner<\/p>\n<p>submits that there is a marriage in the temple with the<\/p>\n<p>daughter of 8th respondent who is a minor.<\/p>\n<p>            In view of the fact that there is no detention as<\/p>\n<p>such as alleged, we do not propose to permit the petitioner to<\/p>\n<p><span class=\"hidden_text\">WPCRL.384\/2009                -2-<\/span><\/p>\n<p>pursue the writ petition.
