He<br \/>\n\tsubmitted that provisions of section 306 of Indian Penal Code would<br \/>\n\tnot be attracted as they are residing separately. He submitted that<br \/>\n\tin any case present application may be allowed when the charge sheet<br \/>\n\thas been filed.\n<\/p>\n<p>\tMs.Mini<br \/>\n\tNair, learned Additional Public Prosecutor resisted the application<br \/>\n\tand submitted that suicide note has been recovered from the<br \/>\n\tdeceased.\n<\/p>\n<p>\tHaving<br \/>\n\theard Mr.R.J.Goswami learned advocate for the applicants and<br \/>\n\tMs.Nair, learned APP and having considered the nature of offence,<br \/>\n\tmanner in which it is alleged to have been committed, role<br \/>\n\tattributed and also considering the suicide note, this Court is of<br \/>\n\tthe opinion that present application deserves to be allowed as now<br \/>\n\tthe charge sheet has been filed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicants are ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.44\/2010 at<br \/>\n\tShamlaji Police Station, Dist.Sabarkantha on their executing a bond<br \/>\n\tof Rs.5,000\/- (Rupees Five Thousand Only) each with one solvent<br \/>\n\tsurety each of the like amount to the satisfaction of the lower<br \/>\n\tCourt and subject to the conditions that they shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\ntheir presence before concerned Police Station on 1st<br \/>\nMonday of every month of English calender between 11:00 AM to 2:00<br \/>\nPM, till trial commences; qua applicants no.1 and 3 only;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of their residence to the Investigating Officer and also<br \/>\nto the Court at the time of execution of the bond and shall not<br \/>\nchange their residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\ntheir passport, if any, to the lower Court, within a week.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute to the aforesaid extent.
