\nMr.P. J. Yagnik, learned advocate for the applicant and Mr.Pandya,
\nlearned APP for the respondent-State.\n<\/p>\n
2.0\tThis
\napplication is successive bail application seeking regular bail under
\nsection 439 of the Code of Criminal Procedure, 1973  in connection
\nwith FIR registered with Mansa Police Station, Dist Gandhinagar
\nbearing I-CR No.28 of 2011 for the offence punishable under sections
\n302, 364, 120(b) 34 of I.P.C. and under Section 135 of Bombay Police
\nAct.\n<\/p>\n
3.0\tMr.Yagnik
\n, learned advocate for the applicant has submitted that any offence
\ninvolving or implicating the applicant under section 302 of IPC is
\nnot made out. He also submitted that according to the allegations
\ncontained in charge sheet the applicant had left the place after he
\ncame along with the deceased. Furthermore, according to the
\nsubmission made by learned advocate for the applicant, the
\nco-accused, against whom serious allegations directly involving him
\nin the offence of causing death of deceased are made, has been
\nreleased by the Court (Coram: Anant S. Dave, J.) vide order dated
\n23.09.2011 passed in Criminal Misc. Application No.12531 of 2011 and
\nthat, therefore, on the ground of parity also applicant may also be
\nreleased on bail since the allegation against the present applicant
\nare not as direct as in case of the person which has been released on
\nbail as stated earlier. He also submitted that investigation is over
\nand charge sheet has been filed and considering the fact that no
\ndirection allegation against the present applicant is made, applicant
\nmay be enlarged on bail.\n<\/p>\n
4.0\tThe
\napplication is opposed by Mr.Pandya, learned APP, who has submitted
\nthat this is successive bail application and therefore it may not be
\nentertained. He also submitted that looking to the gravity of
\noffence, role played by the applicant is very serious and therefore
\nplea of parity may not be accepted and the applicant may not be
\nreleased on bail and the application deserves to be rejected.\n<\/p>\n

\nHaving heard the learned counsel for both the sides and considering
\nthe facts and circumstances of the case as well as the documents and
\nother material produced on record of this case, charge sheet is
\nfiled, investigation is over, and since the co-accused has already
\nbeen released on bail vide order dated dated 23.09.2011 passed in
\nCriminal Misc. Application No.12531 of 2011, this application is
\nallowed and the applicant is directed to be released on regular bail.\n<\/p>\n
6.0\tHence,
\nthis application is allowed. It is directed that the present
\napplicant in connection with I-CR No.28 of 2011 registered with Mansa
\nPolice Station, Dist Gandhinagar be released on bail, in respect of
\nthe offences alleged against him in this application, on his
\nexecuting and furnishing a bond of Rs.20,000\/- (Rupees: Twenty
\nThousand Only) with two solvent sureties of like amount, by the
\nconcerned Police Officer, and on condition that he shall:-\n<\/p>\n
\t(a)\tnot
\ntake undue advantage of or abuse the liberty;\n<\/p>\n
\t(b)\tnot
\nact in manner injurious to the interest of the\tprosecution;\n<\/p>\n
\t(c)\tmaintain
\nlaw and order;\n<\/p>\n
\t(d)\tnot
\nleave the State of Gujarat without prior permission of \tthe Sessions
\nCourt concerned;\n<\/p>\n
\t(e)\tfurnish
\nthe address of his residence at the time of execution \tof bond and
\nshall not change the residence without prior \tpermission of the
\nSessions Court\/this Court;\n<\/p>\n
\t(f)\tsurrender
\nhis passport, if any, to the lower court within 4 \tdays from the date
\nof this order;\n<\/p>\n
\t(g)\tmark
\nhis presence at the concerned Police Station on every \tfirst and
\nfifteenth day of every month, between 11.00 a.m. to 3.00
\n\tp.m.;\n<\/p>\n
\t(h)\tnot
\nto enter district Gandhinagar till the trial is without \tprior
\n\tpermission of the Sessions Court, but for making his \tpresence and
\nattending the Court in connection with this case the \tapplicant will
\nbe free to enter the limits for a period to the extent \tnecessary and
\nwill leave the limits of  Gandhinagar district \timmediately after the
\ncase is adjourned;\n<\/p>\n
7.0\tThe
\nauthorities will release the applicant only if he is not required in
\nany other offence for the time being.\n<\/p>\n
8.0\tIf
\nbreach of any of the above condition is committed the Sessions Judge
\nconcerned will be free to issue warrant or take any appropriate
\naction in the matter.\n<\/p>\n
9.0\tBail-bond
\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n
10.0\tAt
\nthe trial, the trial Court shall not be influenced by the
\nobservations, which are purely, prima facie, tentative and
\npreliminary nature and have been made only for the purpose of
\nexamining prayer for bail pending the trial. The Court shall arrive
\nat its own conclusion independently on the basis of the evidence and
\nother aspects of the case.\n<\/p>\n
11.0\tRule
\nis made absolute to the aforesaid extent. Direct Service is
\npermitted.\n<\/p>\n
