Vide\u00a0order\u00a0dated\u00a014\u00a0December\u00a02009\u00a0the\u00a0Commissioner\u00a0of\u00a0Income\u00a0<br \/>\nTax \u00a0 provided \u00a0 point \u00a0 wise \u00a0 information \u00a0 to \u00a0 the \u00a0 appellant \u00a0 against \u00a0 which\u00a0<br \/>\nappellant\u00a0preferred\u00a0appeal\u00a0dated\u00a09\u00a0February\u00a02010\u00a0before\u00a0first\u00a0appellate\u00a0<br \/>\nauthority\u00a0&#8211;\u00a0CC\u00a0IT,\u00a0Ludhiana.\n<\/p>\n<p>4.       The\u00a0CCIT,\u00a0Ludhiana\u00a0vide\u00a0his\u00a0order\u00a0of\u00a025\u00a0February\u00a02010\u00a0informed\u00a0<br \/>\nthe\u00a0appellant\u00a0that\u00a0the\u00a0CIT\u00a0is\u00a0the\u00a0appellate\u00a0authority\u00a0for\u00a0any\u00a0order\u00a0passed\u00a0by\u00a0<br \/>\nthe \u00a0 officer \u00a0 under \u00a0 his \u00a0 administrate \u00a0 control \u00a0 as \u00a0 per \u00a0 instructions \u00a0 dated \u00a0 7\u00a0<br \/>\nSeptember \u00a0 2007 \u00a0 passed \u00a0 by \u00a0 the \u00a0 office \u00a0 of \u00a0 the \u00a0 Chief \u00a0 Commissioner \u00a0 of\u00a0<br \/>\nIncome\u00a0Tax,\u00a0Ludhiana\u00a0and\u00a0that\u00a0any\u00a0appeal\u00a0on\u00a0the\u00a0appellate\u00a0order\u00a0passed\u00a0<br \/>\nby \u00a0 the \u00a0 Commissioner \u00a0 of \u00a0 Income \u00a0 Tax \u00a0 straightaway \u00a0 lies \u00a0 to \u00a0 Central\u00a0<br \/>\n Information \u00a0 Commission \u00a0 and \u00a0 the \u00a0 CCIT \u00a0 does \u00a0 not \u00a0 act \u00a0 as \u00a0 an \u00a0 appellate\u00a0<br \/>\nauthority\u00a0on\u00a0such\u00a0order.\n<\/p>\n<p>5.    Consequently, \u00a0 appellant \u00a0 preferred \u00a0 second \u00a0 appeal \u00a0 before \u00a0 the\u00a0<br \/>\nCommission. \u00a0 The \u00a0 matter \u00a0 was \u00a0 heard \u00a0 today \u00a0 through \u00a0 videoconferencing.\u00a0<br \/>\nBoth\u00a0parties\u00a0were\u00a0present\u00a0as\u00a0above\u00a0and\u00a0made\u00a0submissions.\n<\/p>\n<p>6.    Appellant\u00a0stated\u00a0that\u00a0the\u00a0information\u00a0provided\u00a0to\u00a0him\u00a0by\u00a0the\u00a0CIT\u00a0was\u00a0<br \/>\nvague\u00a0and\u00a0incomplete.\n<\/p>\n<p>7.        Commission\u00a0notes\u00a0the\u00a0averments\u00a0of\u00a0the\u00a0appellant\u00a0that\u00a0the\u00a0CPIO,\u00a0<br \/>\nJalandhar\u00a0&#8211;\u00a0II\u00a0has\u00a0in\u00a0fact\u00a0not\u00a0responded\u00a0to\u00a0his\u00a0RTI\u00a0application\u00a0and\u00a0that\u00a0it\u00a0is\u00a0<br \/>\nthe \u00a0 first\u00a0 appellate\u00a0 authority\u00a0 namely,\u00a0 the \u00a0 Commissioner\u00a0 Of \u00a0 Income\u00a0 Tax,\u00a0<br \/>\nJalandhar \u00a0 &#8211; \u00a0 II \u00a0 who \u00a0 has \u00a0 provided \u00a0 information \u00a0 which \u00a0 is \u00a0 not \u00a0 as \u00a0 per \u00a0 the\u00a0<br \/>\nprovisions\u00a0of\u00a0the\u00a0RTI\u00a0Act,\u00a02005.\n<\/p>\n<p>                                       Decision<\/p>\n<p>8.     At\u00a0the\u00a0outset\u00a0Commission\u00a0take\u00a0serious\u00a0note\u00a0of\u00a0the\u00a0fact\u00a0that\u00a0the\u00a0first\u00a0<br \/>\nappellate\u00a0authority\u00a0and\u00a0not\u00a0CPIO\u00a0has\u00a0provided\u00a0information\u00a0in\u00a0response\u00a0to\u00a0<br \/>\nthe\u00a0RTI\u00a0application.\u00a0This\u00a0is\u00a0not\u00a0in\u00a0conformity\u00a0with\u00a0the\u00a0provisions\u00a0of\u00a0section\u00a0<br \/>\n7\u00a0(1)\u00a0of\u00a0the\u00a0Act.\u00a0First\u00a0appellate\u00a0authority\u00a0is\u00a0warned\u00a0to\u00a0educate\u00a0himself\u00a0on\u00a0<br \/>\nthe\u00a0provisions\u00a0of\u00a0the\u00a0Act\u00a0and\u00a0to\u00a0implement\u00a0the\u00a0same\u00a0without\u00a0any\u00a0dilution.\n<\/p>\n<p>9.       While\u00a0accepting\u00a0the\u00a0averments\u00a0and\u00a0arguments\u00a0of\u00a0the\u00a0respondent\u00a0<br \/>\nfurnished\u00a0in\u00a0a\u00a0written\u00a0submission\u00a0that\u00a0personal\u00a0information\u00a0of\u00a0a\u00a0citizen\u00a0is\u00a0to\u00a0<br \/>\nbe\u00a0protected,\u00a0Commission\u00a0reminds\u00a0the\u00a0respondent\u00a0that\u00a0&#8221;\u00a0mere\u00a0existence\u00a0<br \/>\nof \u00a0 an \u00a0 investigation \u00a0 process \u00a0 cannot \u00a0 be \u00a0 a \u00a0 ground \u00a0 for \u00a0 refusal \u00a0 of \u00a0 the\u00a0<br \/>\ninformation;\u00a0the\u00a0authority\u00a0withholding\u00a0information\u00a0must\u00a0show\u00a0satisfactory\u00a0<br \/>\nreasons\u00a0 as \u00a0 to \u00a0 why \u00a0 the \u00a0 release \u00a0 of \u00a0 such \u00a0 information \u00a0 would \u00a0 hamper\u00a0 the\u00a0<br \/>\ninvestigation\u00a0process.&#8221;\u00a0(WP\u00a0(C)\u00a0no.\u00a03114\/2007\u00a0in\u00a0the\u00a0case\u00a0of\u00a0Bharat\u00a0Singh\u00a0<br \/>\nversus \u00a0 CIC \u00a0 and \u00a0 others \u00a0 &#8211; \u00a0 S \u00a0 Ravindra \u00a0 Bhat \u00a0 J \u00a0 3 \u00a0 December \u00a0 2007).\u00a0<br \/>\nRespondent \u00a0 has \u00a0 not \u00a0 provided \u00a0 any \u00a0 reasons \u00a0 while \u00a0 denying \u00a0 information\u00a0<br \/>\nregarding\u00a0status\u00a0of\u00a0the\u00a0ongoing\u00a0enquiry\u00a0and\u00a0the\u00a0conclusions\u00a0there\u00a0of.\n<\/p>\n<p>10.    Accordingly\u00a0it\u00a0is\u00a0directed\u00a0that\u00a0CPIO\u00a0will\u00a0provide\u00a0information\u00a0to\u00a0the\u00a0<br \/>\nappellant\u00a0as\u00a0follows:\n<\/p>\n<blockquote><p>        Points\u00a01\u00a0and\u00a02:\u00a0provide\u00a0status\u00a0of\u00a0the\u00a0ongoing\u00a0enquiry\u00a0and\u00a0broad\u00a0<br \/>\n        conclusions\u00a0arrived\u00a0at.\n<\/p><\/blockquote>\n<blockquote><p>        Points\u00a03,\u00a08\u00a0and\u00a09:\u00a0no\u00a0information\u00a0has\u00a0been\u00a0sought\u00a0by\u00a0the\u00a0appellant<br \/>\n         Points\u00a04,\u00a05,\u00a06,\u00a07\u00a0&#8211;\u00a0Information\u00a0to\u00a0be\u00a0provided\u00a0to\u00a0Appellant\u00a0as\u00a0 \u00a0it\u00a0<br \/>\n        concerns\u00a0and\u00a0has\u00a0bearing\u00a0on\u00a0the\u00a0revenues\u00a0of\u00a0the\u00a0State.\n<\/p><\/blockquote>\n<p>11.
