Justice M.C.HARI RANI\n\n Dated :21\/07\/2010\n\n O R D E R\n              R.BASANT &amp; M.C.HARI RANI, JJ.\n                     * * * * * * * * * * * * *\n                      W.P.(Crl) No.282 of 2010\n                    ----------------------------------------\n                Dated this the 21st day of July 2010\n\n\n                         J U D G M E N T\n<\/pre>\n<p>Basant,J<\/p>\n<p>      The petitioner, a woman, has come to this Court with this<\/p>\n<p>petition for issue of a writ of habeas corpus to search for, trace<\/p>\n<p>and produce her daughter Suja.S, aged 26 years (date of birth :<\/p>\n<p>05\/05\/194). She is educated. She holds a Diploma and has been<\/p>\n<p>working as a Laboratory Technician for a period of about 1=<\/p>\n<p>years. She was allegedly found to be missing from 08\/07\/2010.<\/p>\n<p>The uncle of the alleged detenue had preferred a complaint and<\/p>\n<p>the police had registered a crime. As the alleged detenue was<\/p>\n<p>not traced by the police, the petitioner came to this Court with<\/p>\n<p>this petition on 13\/7\/2010.            The petition was admitted on<\/p>\n<p>14\/7\/2010. The case was posted to this date for appearance of<\/p>\n<p>the parties.\n<\/p>\n<p>      2.   Today when the case is called, the petitioner is<\/p>\n<p>present.   She is represented by a counsel.                  Along with the<\/p>\n<p>petitioner, her brother and son have also come to Court.<\/p>\n<p><span class=\"hidden_text\">W.P.(Crl) No.282\/10              : 2 :<\/span><\/p>\n<p>     3.      The 2nd respondent is present. Along with him, the<\/p>\n<p>alleged detenue Ms.Suja has also come to Court. As the alleged<\/p>\n<p>detenue comes to Court along with\/in the custody of the second<\/p>\n<p>respondent, who is allegedly detaining her, we permitted the<\/p>\n<p>alleged detenue to remain alone in the chamber with no<\/p>\n<p>opportunity for the second respondent to influence her.         We<\/p>\n<p>granted permission to the petitioner, her brother and son to<\/p>\n<p>interact with the alleged detenue.\n<\/p>\n<p>     4.      After lunch recess, we interacted with the alleged<\/p>\n<p>detenue alone initially and later in the presence of the petitioner,<\/p>\n<p>her brother and son.      Later, we interacted with the alleged<\/p>\n<p>detenue in the presence of the second respondent and the<\/p>\n<p>mother of the second respondent, who has come to Court along<\/p>\n<p>with him. The learned counsel for the petitioner and the 2nd<\/p>\n<p>respondent and the learned Government Pleader were also<\/p>\n<p>present.\n<\/p>\n<p>     5.      The alleged detenue states before us categorically<\/p>\n<p>that she is not under any illegal confinement or detention. She<\/p>\n<p>was in love with the second respondent and they had decided to<\/p>\n<p>get married.       Their relationship was not approved by the<\/p>\n<p><span class=\"hidden_text\">W.P.(Crl) No.282\/10               : 3 :<\/span><\/p>\n<p>relatives of the alleged detenue.        Another marriage for the<\/p>\n<p>alleged detenue was contemplated. It was at this stage that the<\/p>\n<p>alleged detenue and the second respondent decided to get<\/p>\n<p>married and went away. Their marriage, in accordance with the<\/p>\n<p>Hindu Customary rights has been solemnised on 14\/7\/2010<\/p>\n<p>between 9.30 a.m and 9.50 a.m at the Kaithakkal Kanjikkal<\/p>\n<p>(Varikkolil) Devi Kshethra Seva Samithi. We are informed that<\/p>\n<p>steps have been taken to get the marriage registered with the<\/p>\n<p>Secretary of the Gramma Panchayath, Pallikkal. The certificate<\/p>\n<p>dated     14\/7\/2010    addressed      to the   Secretary,  Gramma<\/p>\n<p>Panchayath        by the Secretary, Kshethra Seva Samithi is<\/p>\n<p>produced.\n<\/p>\n<p>      6.     In a petition for issue of a writ of habeas corpus, we<\/p>\n<p>are primarily concerned with the question whether the alleged<\/p>\n<p>detenue is under any illegal detention or confinement.      We are<\/p>\n<p>satisfied that she is not. We are further satisfied that she is<\/p>\n<p>married to the second respondent. The petitioner, her brother<\/p>\n<p>and son, after interactions with the alleged detenue, now state<\/p>\n<p>that they are now satisfied that she is not under any illegal<\/p>\n<p>confinement or detention and that the alleged detenue can be<\/p>\n<p><span class=\"hidden_text\">W.P.(Crl) No.282\/10                : 4 :<\/span><\/p>\n<p>permitted to go along with the second respondent. They accept<\/p>\n<p>the fait accompli and do not want to resist the attempt of the<\/p>\n<p>alleged detenue and the second respondent to live together as<\/p>\n<p>husband and wife.\n<\/p>\n<p>     7.      We are satisfied that no further directions are<\/p>\n<p>necessary in this writ petition.<\/p>\n<pre>\n\n     8.
