Collector, Stamp Duty Valuation Department,<br \/>\n\tBharuch.\n<\/p>\n<p>\tThis Court has issued<br \/>\n\tnotice on 7.4.2010. The Court has also asked the respondent to<br \/>\n\tclarify as to whether order dated 26.5.2006 produced at Annexure-B<br \/>\n\tat page-17 has been served on the petitioner and if it is served,<br \/>\n\tnecessary proof thereof, be produced on the record of this petition.\n<\/p>\n<p>\tPursuant to the said<br \/>\n\torder affidavit-in-reply is filed by the Dy. Collector on 18.5.2010.<br \/>\n\t It is inter alia stated in the said affidavit that the first notice<br \/>\n\twas issued to the petitioner on 16.2.2006 and, thereafter, another<br \/>\n\tnotice was sent to the petitioner on 22.3.2006 through Registered<br \/>\n\tPost A.D. Since the petitioner did not remain present the order was<br \/>\n\tpassed on 26.5.2006.  It is further stated that since the petitioner<br \/>\n\tdid not pay duty as per order dated 26.5.2006 another notice under<br \/>\n\tthe Amnesty Scheme 2007 was sent to the petitioner on 22.9.2007<br \/>\n\twhereby it was made clear that if the petitioner pays the duty<br \/>\n\tbetween 1.9.2007 to 31.10.2007 the petitioner would not be liable to<br \/>\n\tpay interest on the duty. Since the petitioner did not pay the<br \/>\n\tdeficit stamp duty, on 12.3.2008 Boja, Entry was made by the<br \/>\n\tMamlatdar.  While looking at the entire affidavit-in-reply filed by<br \/>\n\tthe Dy. Collector, it is nowhere mentioned as to on which date the<br \/>\n\torder was served on the petitioner.  The question raised by the<br \/>\n\tCourt was, therefore, not answered by the respondent.\n<\/p>\n<p>\tMr.M.M.Saiyed, learned<br \/>\n\tadvocate appearing for the petitioner submits that the order was not<br \/>\n\treceived by the petitioner and unless and until the said order is<br \/>\n\treceived the petitioner would not be in a position to challenge the<br \/>\n\tsaid order either before the Appellate Authority or before this<br \/>\n\tCourt.  He has further submitted that the petitioner has applied for<br \/>\n\tthe certified copy of the order only in March, 2010 and on receipt<br \/>\n\tof the said order petition was filed before this Court on 25.3.2010.<br \/>\n\t He has further submitted that the impugned order passed by the<br \/>\n\tauthority is non-speaking and is cyclostyle order and as per the<br \/>\n\tsettled legal position the said order is non est at law. He has,<br \/>\n\ttherefore, submitted that the petition may be allowed and the<br \/>\n\timpugned order may be quashed and matter may be remanded back to the<br \/>\n\tDy. Collector for deciding the whole matter afresh after giving an<br \/>\n\topportunity of being heard to the petitioner.\n<\/p>\n<p>\tMs.Manisha Narsinghani,<br \/>\n\tlearned Assistant Government Pleader, on the other hand, has<br \/>\n\tsubmitted that as per affidavit-in-reply filed by the Dy. Collector,<br \/>\n\tseveral particulars were given to the petitioner.  Even after<br \/>\n\tpassing of the order notices were issued and still the petitioner<br \/>\n\thas not taken any action. Even Boja Entry was effected in 2008 still<br \/>\n\tthe petitioner has not bothered to ask for certified copy of the<br \/>\n\torder and only in 2010 the petitioner has made an application and,<br \/>\n\tthereafter, present petition is filed.  She has, therefore,<br \/>\n\tsubmitted that the petition is not entertainable either on the<br \/>\n\tground of delay and latches or even on the ground of alternative<br \/>\n\tremedy available to the petitioner.  She has, therefore, submitted<br \/>\n\tthat the petition deserves to be dismissed.\n<\/p>\n<p>\tHaving heard learned<br \/>\n\tadvocate appearing for the petitioner and learned Assistant<br \/>\n\tGovernment Pleader appearing for the respondent and having gone<br \/>\n\tthrough the contents of the petition as well as documents and<br \/>\n\taffidavit-in-reply the Court is of the view that it is an admitted<br \/>\n\tposition that there is no evidence produced on record of this<br \/>\n\tpetition when the impugned order was served on the petitioner.  It<br \/>\n\tis true that subsequently notices were issued and Boja Entry was<br \/>\n\tmade. However, at that point of time also the impugned order was not<br \/>\n\tserved on the petitioner.  The petitioner got the order only in 2010<br \/>\n\twhen he made an application for certified copy and, thereafter,<br \/>\n\tpresent petition is filed. There is also no dispute about the fact<br \/>\n\tthat the impugned order is an appealable order and there is<br \/>\n\tefficacious remedy available to the petitioner.  The petitioner can<br \/>\n\tchallenge this order before the Chief Controlling Revenue Authority<br \/>\n\tafter making payment of 25% of the deficit stamp duty. If the Appeal<br \/>\n\tand\/or Revision is not filed in time it is open for the petitioner<br \/>\n\tto make an application for condonation of delay alongwith Appeal<br \/>\n\twhich shall be considered in accordance with law.\n<\/p>\n<p>\tIn the above view of the<br \/>\n\tmatter, without going into merits of the matter the Court hereby<br \/>\n\tdisposes of this petition reserving liberty to the petitioner to<br \/>\n\tfile Appeal and\/or Revision against the impugned order before the<br \/>\n\tChief Controlling Revenue Authority alongwith delay condonation<br \/>\n\tapplication explaining the circumstances causing such delay. If such<br \/>\n\tan Appeal and\/or Revision is filed alongwith delay condonation<br \/>\n\tapplication within a period of 15 days from today the same shall be<br \/>\n\tconsidered by the authority in accordance with law on their own<br \/>\n\tmerits.\n<\/p>\n<p>\tSubject to the aforesaid<br \/>\n\tdirections and observations this petition is accordingly disposed<br \/>\n\toff. Rule is made absolute to the above extent without any order as<br \/>\n\tto costs. Direct service is permitted.\n<\/p>\n<p>       (K. A.
