Advocate\n\nHon'ble Rajesh Dayal Khare,J.\n<\/pre>\n<p>Sri Rajendra Singh, learned counsel, has put in appearance on behalf of the<br \/>\napplicants by filing Parcha, today in the Court, which is taken on record.\n<\/p>\n<p>Heard Sri Rajendra Singh, learned counsel for the applicants and learned<br \/>\nA.G.A. for the State.\n<\/p>\n<p>The present 482 Cr.P.C. petition has been filed for quashing the summoning<br \/>\norder dated 18.03.2010 passed by learned Chief Judicial Magistrate, District<br \/>\nChandauli, in Complaint Case No. 613 of 2010 (Eklakh Vs. Chhotak and<br \/>\nanother), under Section 323, 5604, 392, 452 I.P.C..\n<\/p>\n<p>The contention of the counsel for the applicants is that no offence against the<br \/>\napplicants is disclosed and the present prosecution has been instituted with a<br \/>\nmalafide intention for the purposes of harassment. He pointed out certain<br \/>\ndocuments and statements in support of his contention. It is further contended<br \/>\nthat no incident as alleged had ever occurred, the applicant has no criminal<br \/>\nhistory and has been falsely implicated in the present case.<br \/>\nFrom the perusal of the material on record and looking into the facts of the<br \/>\ncase at this stage it cannot be said that no offence is made out against the<br \/>\napplicants. All the submission made at the bar relates to the disputed question<br \/>\nof fact, which cannot be adjudicated upon by this Court under Section 482<br \/>\nCr.P.C. At this stage only prima facie case is to be seen in the light of the law<br \/>\nlaid down by Supreme Court in cases of R.P. Kapur Vs. State of Punjab,<br \/>\nA.I.R. 1960 S.C. 866, State of Haryana Vs. Bhajan Lal, 1992 SCC (Cr.) 426,<br \/>\nState of Bihar Vs. P.P.Sharma, 1992 SCC (Cr.) 192 and lastly Zandu<br \/>\nPharmaceutical Works Ltd. Vs. Mohd. Saraful Haq and another (Para-10)<br \/>\n2005 SCC (Cr.) 283. The disputed defence of the accused cannot be<br \/>\nconsidered at this stage. Moreover, the applicants have got right of discharge<br \/>\nunder Section 239 or 227\/228 Cr.P.C. as the case may be through a proper<br \/>\napplication for the said purpose and they are free to take all the submissions in<br \/>\nthe said discharge application before the Trial Court.<br \/>\n The prayer for quashing the summoning order is refused.<br \/>\nHowever, it is directed that the applicants shall appear and surrender before<br \/>\nthe court below within 30 days from today and apply for bail, their prayer for<br \/>\nbail shall be considered and decided in view of the settled law laid by this<br \/>\nCourt in the case of Amrawati and another Vs. State of U.P. reported in 2004<br \/>\n(57) ALR 290 as well as judgement passed by Hon&#8217;ble Apex Court reported in<br \/>\n2009 (3) ADJ 322 (SC) Lal Kamlendra Pratap Singh Vs. State of U.P. For a<br \/>\nperiod of 30 days from today or till the disposal of the application for grant of<br \/>\nbail whichever is earlier, no coercive action shall be taken against the<br \/>\napplicants.
