No. I   53 of 2010<br \/>\nfiled before Langnaj Police Station for the offence punishable under<br \/>\nSections 379, 114 of the Indian Penal Code, Section 3 and 7 of the<br \/>\nDamage to Public Property Act and Section 3 and 7 of the Essential<br \/>\nCommodities Act.\n<\/p>\n<p>\tMr. Barot, learned<br \/>\nadvocate for the applicant submitted that the applicant is an<br \/>\ninnocent person and a false case is foisted on him. The allegations<br \/>\nlevelled against the applicant are general in nature. On perusal of<br \/>\nthe FIR, it reveals that at 11:00 p.m. when the original complainant<br \/>\nreached the spot, oil was getting leaked from the well and therefore,<br \/>\nit clearly transpires that the present applicant was not present at<br \/>\nthe spot and on the suspicion, the applicant has been implicated in<br \/>\nthe offence. He submitted that considering the role attributed to the<br \/>\napplicant and reflected in the FIR at Annexure &#8216;A&#8217; to the<br \/>\napplication, this is a fit case to enlarge the applicant on regular<br \/>\nbail.\n<\/p>\n<p>\tAs against the aforesaid,<br \/>\nlearned APP Mr. Jani, submitted that considering the role played by<br \/>\nthe applicant and seriousness of the offence, no discretionary relief<br \/>\ncan be granted to the applicant and the application deserves to be<br \/>\ndismissed.\n<\/p>\n<p>\tHaving heard the rival<br \/>\nsubmissions of learned advocates and having considered the role<br \/>\nattributed to the applicant as reflected in the FIR at Annexure A,<br \/>\nthe quantum of punishment, gravity of the offence etc., I am of the<br \/>\nview that there is no any direct evidence against the applicant and,<br \/>\ntherefore, now at this bail stage, the applicant is required to be<br \/>\nenlarged on regular bail on stringent conditions, without entering<br \/>\ninto the merits of the case and  without discussing the evidence in<br \/>\ndetail.\n<\/p>\n<p>\tThe parties do not press<br \/>\nfor further reasoned order.\n<\/p>\n<p>\tIn the facts and<br \/>\ncircumstances of the case, the petition is allowed and the applicant<br \/>\nis ordered to be enlarged on bail in connection with  C.R. No. I &#8211; 53<br \/>\nof 2010 registered with Langanj Police Station on his executing a<br \/>\nbond of Rs.10,000\/- [Rupees Ten thousand only] with one surety of the<br \/>\nlike amount to the satisfaction of the trial court and subject to the<br \/>\nconditions that he shall:\n<\/p>\n<p>[a].\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b].\tnot act in a manner<br \/>\ninjurious to the interest of the prosecution;\n<\/p>\n<p>[c].\tsurrender his<br \/>\npassport, if any, to the lower court within a week;\n<\/p>\n<p>[d].\tnot leave the State<br \/>\nof Gujarat without the prior permission of the Sessions court<br \/>\nconcerned;\n<\/p>\n<p>(e).\tmark his presence at<br \/>\nthe concerned police station twice in a month i.e. on 15th<br \/>\nand 30th of every English Calender month between 9:00 a.m.<br \/>\nand 2:00 p.m. till the trial is over.\n<\/p>\n<p>(f).\tfurnish the present<br \/>\naddress of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change his residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>[f].\tmaintain law and<br \/>\norder.\n<\/p>\n<p>\tIf breach of any of the<br \/>\nabove conditions is committed, the Sessions Judge concerned will be<br \/>\nfree to issue warrant or to take appropriate action in the matter.\n<\/p>\n<p>\tBail bond to be executed<br \/>\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tAt the trial, the trial<br \/>\nCourt shall not be influenced by the observations of preliminary<br \/>\nnature, qua the evidence at this stage, made by this Court while<br \/>\nenlarging the applicant on bail.\n<\/p>\n<p>\tRule is made absolute to<br \/>\nthe aforesaid extent.
