SANKARAN, J.\n                  ---------------------------\n                   B.A. No. 5164 of 2009\n               ------------------------------------\n           Dated this the 9th day of September, 2009\n\n                          O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under<\/p>\n<p>Section 438 of the Code of Criminal Procedure. The petitioner<\/p>\n<p>is the second accused in Crime No.709\/2009 of Chalakkudy<\/p>\n<p>Police Station.\n<\/p>\n<p>      2.   The offence alleged against the petitioner is under<\/p>\n<p>Section 498 A of the Indian Penal Code.<\/p>\n<p>      3.   The petitioner is the mother-in-law of the defacto<\/p>\n<p>complainant. The husband of the defacto complainant is<\/p>\n<p>working abroad. The counsel for the petitioner submitted that<\/p>\n<p>the disputes between the parties have been settled and<\/p>\n<p>Annexure AII agreement dated 21\/8\/2009 was executed. The<\/p>\n<p>defacto complainant and the petitioner are the signatories to<\/p>\n<p>the agreement.\n<\/p>\n<p>      4.   Taking into account the facts and circumstances of<\/p>\n<p>the case, the nature of the offence and other circumstances, I<\/p>\n<p>am of the view that anticipatory bail can be granted to the<\/p>\n<p>petitioner. There will be a direction that in the event of the<\/p>\n<p>B.A. No.5164\/ 2009<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>arrest of the petitioner, the officer in charge of the police station<\/p>\n<p>shall release her on bail on her executing bond for Rs.10,000\/-<\/p>\n<p>with two solvent sureties for the like amount to the satisfaction<\/p>\n<p>of the officer concerned, subject to the following conditions:<\/p>\n<blockquote><p>         A) The     petitioner  shall    appear    before     the<br \/>\n             investigating officer for interrogation as and<br \/>\n             when required;\n<\/p><\/blockquote>\n<blockquote><p>         B) The petitioner shall not try to influence the<br \/>\n             prosecution   witnesses    or  tamper     with   the<br \/>\n             evidence.\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioner shall not commit any offence or<br \/>\n             indulge in any prejudicial activity while on bail.\n<\/p><\/blockquote>\n<blockquote><p>         D) In case of breach of any of the conditions<br \/>\n             mentioned above, the bail shall be liable to be<br \/>\n             cancelled.<\/p><\/blockquote>\n<p>       The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                   K.T.
