Section 282(1) of the Karnataka Municipal Corporation
\nAct (hereinafter referred to as ‘The Act’ for <\/p>\n
also under Section 9 of CPC.\n<\/p>\n
2. The suit is one for” perman_er1t- _i”njun’ctior’;<\/p>\n
restraining the defendanteeor anybody cla.i.;nii1g <\/p>\n
the defendant from interfering_ with lftheirll\ufb02g peaceful<\/p>\n
possession and enjoyrrient of  ‘\ufb01chedtilellproperty.<\/p>\n
3. The case  the northern
\nportion of” ‘0’Lglr.No.5\/l of I-IASB
\nKatha.’  Hobli has been
\nallotted’  the R.K.Padma;iah, husband of<\/p>\n
plaintiff no’.  father of plaintiffs nos.2 and 3 under<\/p>\n
  partition deed dated 2.2.2002 and<\/p>\n
I   dated 24.9.2003. Katha was mutated<\/p>\n
in”–the’. liia\ufb01rrae of Padmaiah. Padmaiah obtained a<\/p>\n
  sanctioned plan for construction of a residential<\/p>\n
 He entered into an agreement with M\/s<\/p>\n
  Builders and also executed a general power of<\/p>\n

attorney in favour of one M \/ s Team Builders. After
\nsanction of licence, plaintiff died on 3.2.2003 leaving<\/p>\n
behind lsi plaintiff his wife and plaintiffs 2 <\/p>\n
children. Plaintiffs became the absolute  <\/p>\n
the death of Padmaiah. They hadentered”.iI3to’~:a”joint”” <\/p>\n
development agreement on  vv,Z.th <\/p>\n
Builders. However, on  ith.e_  <\/p>\n
BMP attempted to dernolishu.the’=bui1ding  threatened
\nthe employees and   vacate the suit<\/p>\n
schedule property.  at*terript;.V\u00a5.}vas without even<\/p>\n
notice,  thelnreasons and without any
\njusti\ufb01cationnt   the plaintiffs sought for the
\ndecrgee for  injunction.\n<\/p>\n
 4:? fiefendants on service of summons appeared<\/p>\n
A   statement interalia stating that the suit<\/p>\n
is not inaizitainable as the plaintiff has not issued notice<\/p>\n
it   as,_\u00a7;oIi’t’emplated under Section 482(1) of the Act and the<\/p>\n

\nsuit is also not maintainable in View of the provisions<\/p>\n
under Section 321(1) and (2) of the Act.<\/p>\n
5. The trial Court framed a preliminary vipssuepas<\/p>\n
regards to the maintainability and on consideration ;_.of<\/p>\n
the matter, it dismissed the suit on V. <\/p>\n
