Aggrieved by Exts.P1 &amp; P2 orders of assessment<\/p>\n<p>pertaining to the year 2005-06 &amp; 2007-08 petitioner had<\/p>\n<p>filed appeals before the 2nd respondent as evidenced from<\/p>\n<p>Exts.P3 &amp; Ext.P4, respectively.              The petitioner had also<\/p>\n<p>preferred Exts.P5 &amp; P6 stay petitions along with the appeals<\/p>\n<p>seeking stay of collection of tax amount in dispute, pending<\/p>\n<p>disposal of the appeals. It is submitted that appeals as well<\/p>\n<p>as the accompanying petitions are pending consideration<\/p>\n<p>and disposal before the 2nd respondent.<\/p>\n<p>     2.   Contention of the petitioner is that the returns<\/p>\n<p>filed with respect to the years concerned were rejected only<\/p>\n<p>on the ground that the petitioner had declared low gross<\/p>\n<p>profit. The petitioner is relying a decision of this court in<\/p>\n<p>Classic Marbles Vs. State of Kerala ( (2009) 25 VST 295),<\/p>\n<p>wherein this court held that mere ipse dixit of the assessing<\/p>\n<p>W.P.(C)No. 30190 of 2009<br \/>\n<span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>authority that in the line of business in which the assessee<\/p>\n<p>is carrying on, the gross profit must be on a higher side, is<\/p>\n<p>not a reason for rejecting the books of accounts, without<\/p>\n<p>there being any convincing material to show that the<\/p>\n<p>assessee had in fact suppressed actual profit. Under such<\/p>\n<p>circumstances the petitioner is seeking direction for early<\/p>\n<p>disposal of the appeal and to keep in abeyance further steps<\/p>\n<p>of recovery till then.\n<\/p>\n<p>      3.    Having considered facts and circumstances of the<\/p>\n<p>case, I am of the opinion that the writ petition can be<\/p>\n<p>disposed of directing the appellate authority to consider and<\/p>\n<p>dispose of the appeals as well as stay petitions, taking note<\/p>\n<p>of all contentions raised by the petitioner including the<\/p>\n<p>contention based on the ruling of this court.<\/p>\n<p>      4.    Therefore the 2nd respondent is directed to<\/p>\n<p>consider and pass orders on Exts.P5 &amp; P6 stay petitions<\/p>\n<p>after affording an opportunity of hearing to the petitioner,<\/p>\n<p>and after adverting all the contentions raised by the<\/p>\n<p>petitioner against the assessment. The orders in this regard<\/p>\n<p>W.P.(C)No. 30190 of 2009<br \/>\n<span class=\"hidden_text\">                                -3-<\/span><\/p>\n<p>shall be passed as early as possible, at any rate within a<\/p>\n<p>period of one month from the date of receipt of copy of this<\/p>\n<p>judgment.        The respondents are directed to keep in<\/p>\n<p>abeyance all further steps for realization of the amounts<\/p>\n<p>covered under Ext.P1 &amp; P2 order of assessments till the<\/p>\n<p>2nd respondent passes orders on the stay petitions.<\/p>\n<p>      5.    It is further directed that the 2nd respondent shall<\/p>\n<p>also take all earnest efforts for an early disposal of the<\/p>\n<p>appeals as early as possible, thereafter.<\/p>\n<p>                                           C.K.
