MUKHOPADHAYA)<\/p>\n<p>1.\t\tThe<br \/>\nState Government issued  scheme known as Pandit Din Dayal Grahak<br \/>\nBhandar Yojna by Resolution dated 2nd August, 2004, wherein it was<br \/>\ndecided to grant licences of Fair Price Shops in favour of educated<br \/>\nunemployed persons, who, otherwise fulfil other conditions. Pursuant<br \/>\nto an advertisement for such allotment dated 21st December, 2004,<br \/>\nthe appellant submitted  application on 1st January,2005 and the<br \/>\nlicence for Fair Price shop was allotted on 3rd\/4th May, 2005. The<br \/>\n3rd respondent on challenging the same, the allotment in favour of<br \/>\nthe appellant was cancelled and the matter was remanded to the<br \/>\nCollector on 27th November, 2006. The said order was challenged by<br \/>\nthe appellant in Special Civil Application No. 26364 of 2008 which<br \/>\nwas disposed of on 30th April, 2007 directing the 2nd respondent to<br \/>\ndecide the matter taking into consideration all aspects of the case.<br \/>\nThereafter, the 2nd respondent decided to invite fresh applications<br \/>\nand cancelled the allotment made in favour of the appellant which was<br \/>\nchallenged before the Appellate Authority, who, again remanded the<br \/>\nmatter, wherein, after taking into consideration all records, the<br \/>\napplication of the appellant was rejected which was affirmed by the<br \/>\nAppellate Authority on 6th August, 2009. Learned Single Judge, having<br \/>\nupheld the said order, present Letters Patent Appeal has been<br \/>\npreferred.\n<\/p>\n<p>2.\t\tIt<br \/>\nis not in dispute that the appellant was the owner of an auto<br \/>\nrickshaw registered as taxi. That was the ground noticed by the<br \/>\nauthorities to cancel the licence holding that he was not educated<br \/>\nunemployed, as held by the learned Single Judge.\n<\/p>\n<p>3.\t\tLearned<br \/>\ncounsel appearing on behalf of the appellant submitted that the<br \/>\nappellant was not running the auto rickshaw. In fact, it was taken by<br \/>\nhis maternal uncle, but those factual aspects cannot be noticed for<br \/>\ndetermination of issue whether the appellant had actual earning out<br \/>\nof the auto rickshaw or not.\n<\/p>\n<p>4.\t\tUnder<br \/>\ndefinition clause 2(9), educational unemployed means a person having<br \/>\nminimum qualification of S.S.C. or equivalent and having no job or<br \/>\nemployment or no any income whatsoever in nature, subject to age<br \/>\nlimit of 35 years. The question of gainful employment came for<br \/>\nconsideration before Supreme Court in the case of North-East<br \/>\nKarnataka Road Transport Corporation vs. M.Nagangouda, in (2007) 10<br \/>\nSCC, 765  where the Supreme Court held as follows:\n<\/p>\n<p>&#8220;17.\t\tOn<br \/>\nthe said question, we are unable to accept the reasoning of the<br \/>\nLabour Court that the income received by the respondent from<br \/>\nagricultural pursuits could not be equated with income from gainful<br \/>\nemployment in any establishment. In our view, &#8220;gainful<br \/>\nemployment&#8221; would also include self-employment wherefrom income<br \/>\nis generated. Income either from employment in an establishment or<br \/>\nfrom self-employment merely differentiates the sources from which<br \/>\nincome is generated, the end use being the same. Since the respondent<br \/>\nwas earning some amount from his agricultural pursuits to maintain<br \/>\nhimself, the Labour Court was not justified in holding that merely<br \/>\nbecause the respondent was receiving agricultural income, he could<br \/>\nnot be treated to be engaged in &#8220;gainful employment&#8221;.\n<\/p>\n<p>Same view was taken by the Supreme Court in Niranjan<br \/>\nCinema vs. Prakash Chandra Dubey and another, reported in (2007) 14<br \/>\nSCC 349, wherein the Court held that gainful employment<br \/>\nalso includes self-employment as income is generated from that<br \/>\nsource.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe present case, on hearing parties, as we find that the appellant<br \/>\nis the owner of a taxi i.e. auto rickshaw, he cannot be held<br \/>\nunemployed being self-employed in the eye of law. We find no<br \/>\nillegality in the order passed by the Appellate Authority or the<br \/>\nlearned Single Judge.\n<\/p>\n<p>6.\t\tSo<br \/>\nfar as the 3rd respondent is concerned, he having  not challenged the<br \/>\norder of the Appellate Authority, or order passed by the learned<br \/>\nSingle Judge, we are not deliberating on the question whether his<br \/>\ncase was rightly rejected or not. There is no merit. The appeal is<br \/>\ndismissed.
