Justice K.K.DENESAN\n\n Dated :28\/02\/2007\n\n O R D E R\n                            K.K.DENESAN, J.\n\n                   -----------------------------\n\n                         WP(C)No. 6058 OF 2007\n\n                   -----------------------------\n\n                Dated this the 28th February, 2007.\n\n\n\n                                 JUDGMENT\n<\/pre>\n<p>      The   petitioner   while   working   as   Survey   Srang   Gr.II<\/p>\n<p>retired   from   service.     He   filed   a   representation   stating<\/p>\n<p>that   the   department   had   failed   to   give   him   the   benefit   of<\/p>\n<p>the third higher grade.   When he approached this Court with<\/p>\n<p>the   above   grievance,   this   Court   directed   the   Government   to<\/p>\n<p>look into his grievance and take appropriate decision.   The<\/p>\n<p>Government   directed   the   second   respondent   to   take   decision<\/p>\n<p>regarding   the   claim   of   the   petitioner   and   to   report<\/p>\n<p>compliance   to   the   Government.     In   pursuance   thereof   the<\/p>\n<p>second   respondent   has   passed   Ext.P6   order   on   18.1.2007<\/p>\n<p>fixing   the   pay   of   the   petitioner   in   the   time   scale   of<\/p>\n<p>Rs.8390-13270.     The   petitioner   submits   that   his   pay   ought<\/p>\n<p>to have been fixed in the pre-revised scale on granting him<\/p>\n<p>the  third  higher  grade  and  since  that  has  not  been  done  by<\/p>\n<p>the   second   respondent   the   petitioner   is   subjected   to<\/p>\n<p>pecuniary loss.\n<\/p>\n<p>      2.     Having   heard   counsel   for   the   petitioner   and   Govt.\n<\/p>\n<p>Pleader   for   the   respondents,   I   feel   that   the   above<\/p>\n<p>grievance  of   the   petitioner   will   have   to   be   brought   to   the<\/p>\n<p>notice   of   the   first   respondent   which   has   got   the   authority<\/p>\n<p>to   pass   appropriate   orders   after   taking   into   consideration<\/p>\n<p><span class=\"hidden_text\">WPC 6058\/2007                        2<\/span><\/p>\n<p>the   materials   provided   by   the   petitioner   and   the   relevant<\/p>\n<p>Government   orders   on   the   subject.     Rule   24   of   the   Kerala<\/p>\n<p>Civil   Services   (Classification,   Control   &amp;   Appeal)   Rules<\/p>\n<p>1960   confers     powers   on   the   Government   and   a   corresponding<\/p>\n<p>right in the Government servant to bring such grievances to<\/p>\n<p>the   notice   of   the   Government.     Hence,   there   shall   be   an<\/p>\n<p>order   directing   the   first   respondent   to   pass   appropriate<\/p>\n<p>orders   on   representation   filed   by   the   petitioner   as   early<\/p>\n<p>as   possible.     If   the   representation   is   filed   within   three<\/p>\n<p>weeks  from  the  date  of  receipt  of  a  copy  of  this  judgment,<\/p>\n<p>the   same   shall   be   considered   by   the   first   respondent   and<\/p>\n<p>disposed   of   in   accordance   with   law   within   two   months<\/p>\n<p>thereafter.
