ST WORK UNON - Respondent\n \n\n==============================================\nAppearance : \nMS\nMONALI H BHATT for Petitioner(s) : 1, \nRULE SERVED for\nRespondent(s) : 1, \n==============================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/10\/2008 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>\t\tThough<br \/>\nserved, no body has appeared on behalf of the respondent-workman.\n<\/p>\n<p>2.\t\tThe<br \/>\npetitioner-GSRTC, has preferred this petition under Article 227 of<br \/>\nthe Constitution of India, challenging the award dated 31\/05\/2002<br \/>\npassed by the Industrial Court, Surat in Reference (I.T.) No.46 of<br \/>\n1991, quashing and setting aside the order of punishment dated<br \/>\n18\/12\/1987 and the appellate authority&#8217;s order thereon as illegal and<br \/>\nordered payment of consequential benefits with cost of Rs.2,000\/-.\n<\/p>\n<p>3.\t\tThe<br \/>\nfacts in brief deserves to be set out as under:\n<\/p>\n<p>4.\t\tThe<br \/>\nrespondent-driver in S.T. Corporation received a charge-sheet on<br \/>\n17\/10\/1987 containing imputation that on 04\/09\/1987 due to his<br \/>\nnegligence in driving, accident occurred wherein a pedestrian had<br \/>\ndied on the spot and a scooter rider was seriously injured.  On<br \/>\naccount of such fatal accident occurred for his negligence, the S.T.<br \/>\nCorporation had to sustain severe damages.  After the inquiry,<br \/>\npunishment came to be imposed of five  stage reduction from basic pay<br \/>\nof Rs.732\/- to Rs.573\/-.  This punishment order was passed on<br \/>\n18\/10\/1987 which was assailed in departmental appeal wherein the<br \/>\nfirst appellate authority confirmed the same and the said order was<br \/>\nfurther assailed in second departmental appeal wherein the second<br \/>\nappellate authority reduced it from five stage reduction to that of<br \/>\ntwo stage only.  This order was challenged by raising industrial<br \/>\ndispute which came to be referred to competent Industrial Court which<br \/>\nwas registered as Reference (I.T.) No.46 of 1991 and the learned<br \/>\nIndustrial Court, Surat has quashed and set aside the order impugned<br \/>\nas stated  herein above under its award dated 31\/05\/2002, which has<br \/>\nbeen assailed in the present petition under Article 227 of the<br \/>\nConstitution of India.\n<\/p>\n<p>5.\t\tMs.Bhatt,<br \/>\nlearned Advocate appearing for the petitioner ?  S.T. Corporation<br \/>\nsubmitted that even as such punishment order could not have been said<br \/>\nto be improper looking to the way accident occurred.  The Industrial<br \/>\nCourt ought not to have, therefore, recorded finding contrary to the<br \/>\nevidence on record.  The occurring of accident cannot always be<br \/>\nproved by only eye-witnesses.  In absence of eye-witnesses also,<br \/>\nthere could be a strong evidence available on record leading to the<br \/>\nestablishment of driver&#8217;s negligence and dereliction in duty.  In<br \/>\nview of this, the finding of the Industrial Court being perverse, the<br \/>\nsame deserves to be quashed and set aside. She further contended that<br \/>\nfor initiating departmental proceedings, the competent authority has<br \/>\nto come to the tentative conclusion and formed a prima-facie opinion<br \/>\nthat can never be termed to be biased or pre-decision on his part so<br \/>\nas to hold the proceedings as vitiated.  She submitted that in view<br \/>\nof this, the award deserves to be quashed and set aside.\n<\/p>\n<p>6.\t\tThis<br \/>\nCourt is of the considered view that the Industrial Court has<br \/>\ncommitted error apparent on the face of the record in holding that<br \/>\nthe inquiry was biased.  It deserves to be noted that the workman, as<br \/>\ncould be seen from the recording in paragraph ?  6 of the award has<br \/>\ngiven up his challenge to the validity and legality of inquiry and<br \/>\nconfined his challenge only to findings being perverse.  In light of<br \/>\nthis, giving up of challenge, it was not proper for the Industrial<br \/>\nCourt   to go into the aspect with regard to vitiation of inquiry.<br \/>\nAs could be seen from the award, the Court has heavily dealt with<br \/>\nthat aspect and recorded its finding which has actually gone into<br \/>\npersuading the Court in quashing the order of punishment.  The<br \/>\nCourt&#8217;s finding, therefore, cannot be sustained in the eye of law.<br \/>\nThe finding are based on erroneous appreciation of provisions of law<br \/>\nas well as the fact which has actually resulted into serious<br \/>\nprejudice to the Corporation.\n<\/p>\n<p>7.\t\tIn<br \/>\nthat view of the matter, this petition deserves to be allowed and the<br \/>\naward impugned deserves to be quashed and set aside and accordingly<br \/>\nthe impugned award is quashed and set aside.  The petition is<br \/>\nallowed.  Rule made absolute.
