Request for extracts\/certified copies of documents, if required, will be made\n      after inspection of the File\/s. Date and time and name\/designation of official of\n      official to be contacted for the purpose.\n   2. Following information\/copies of documents regarding various appointments of\n      Shri Hari Suman :\n           a) Date and name of post on which he initially joined Hindi Academy\n           b) Whether a sanctioned post (on which he initially joined) existed on the\n              date of his appointment in Hindi Academy\n           c) A copy of the sanction for the post on which he initially joined.\n           d) A copy of appointments order in respect of his initial appointments.\n           e) Mode of his appointment i.e. whether the post was advertised in\n              newspapers obtained from other Department\/Organisation.\n   3. If his services were obtained from any Department\/Organisation, following\n      information\n           a) Name of Department\/Organisation from which his services were obtained.\n            b) Duration and terms and conditions of deputation or any other basis on\n               which his services were obtained by Hindi Academy.\n           c) Copies of correspondence exchanged regarding his initial appointment\n               between Hindi Academy and concerned Department\/Organisation from\n               which his services were obtained.\n    4. Following information regarding his subsequent appoinment\/promotions (other\n       than initial appointment) in Hindi Academy\n           a) Name of each post (after his initial appointment) to which he was\n               appointed\/promoted and date on which he was appointed to each post.\n           b) Copies of sanctions in respect of each post to which he was appointed\n               (other than initial appointment)\n    5. Following information whether subsequent appointments\/promotion involved any\n       change of cadre:\n           a) Names and posts to which his appointment\/promotion involved change of\n               cadre\n           b) Whether appointment\/promotion involving change of cadre is permissible\n           c) Name of the competent authority to permit\/allow change of cadre in such\n               cases. A copy of rule\/bye-law under which the said authority is authorized\n               to permit\/allow appointment\/promotion involving change of cadre.\n           d) Whether his appointment\/promotion involving change of cadre was\n               approved the said competent authority. If so, a copy of approval of\n               competent authority.\n    6. Following information if he has been permanently absorbed in Hindi Academy.\n           a) Name of the competent authority to approve permanent absorption of\n               officials whose services were initially obtained from any other\n               Department\/Organisation.\n           b) Whether approval of competent authority was obtained for his permanent\n               absorption in Hindi Academy. If so, a copy of document\/minutes\n               containing approval granted by competent authority may for his\n               permanent absorption in Hindi Academy.\n\nReply of the PIO:\nThe PIO replied that the information fall under Section 8 (e)\/(j) of the RTI Act hence it\ncould not be provided.\n\nGround of First Appeal:\nDenial of information from the PIO.\n\nOrder of the FAA:\nThe FAA in its order directed the PIO to give information to the Appellant within twenty\ndays of issue of the order.\n\nGround of the Second Appeal:\nIncomplete information received from the PIO after the order of the FAA\n\n.\n<\/pre>\n<p> Relevant Facts emerging during Hearing:<br \/>\nThe following were present<br \/>\nAppellant: Absent<br \/>\nRespondent: Dr. Ravindra Srivastava (PIO\/Hindi Academy)<br \/>\nThe Appellant had not been given clear answer with respect to four of his queries which<br \/>\nhas been done subsequently by the PIO vide his letter 10\/09\/2009 which has been sent<br \/>\nonly to the Commission and not to the Appellant.
