Radhakrishnan, J.\n        ==================================\n              W.P.(C)No.24428 of 2008\n                         &amp;\n               I.A.No.12194 of 2008\n        ==================================\n     Dated this the 23rd day of September, 2008.\n\n\n                     JUDGMENT\n<\/pre>\n<p>    Learned  Government   Pleader  appears  for  the<\/p>\n<p>Returning  Officer  impleaded   as   per  order   on<\/p>\n<p>I.A.12193 of 2008.   Service complete.    This writ<\/p>\n<p>petition is filed seeking a direction to have the<\/p>\n<p>election conducted.  As of now, election has been<\/p>\n<p>notified  and  therefore  there  is   no  reason  to<\/p>\n<p>apprehend that the election will not be conducted,<\/p>\n<p>in accordance with law.       Be that as it may,<\/p>\n<p>I.A.No.12194 of 2008 is filed on the premise that<\/p>\n<p>persons  at  Sl.Nos.82    and  87   to  147   except<\/p>\n<p>Sl.Nos.125 and 140 in Ext.P9 list are not members<\/p>\n<p>admitted to membership, in accordance with law and<\/p>\n<p>by the competent authority, in terms of law.     The<\/p>\n<p>objection appears to be that the Secretary of the<\/p>\n<p>Society had included their names as members without<\/p>\n<p> WPC24428\/08<\/p>\n<p><span class=\"hidden_text\">                        -:2:-<\/span><\/p>\n<p>proper authority.   Having regard to the facts and<\/p>\n<p>circumstances, this writ petition and I.A. are<\/p>\n<p>ordered directing that, the election shall be duly<\/p>\n<p>conducted and the votes, if any, cast by persons at<\/p>\n<p>Sl.No.82 and 87 to 124 (both inclusive), 126 to 139<\/p>\n<p>(both inclusive) and 141 to 147 (both inclusive)<\/p>\n<p>shall be polled in a separate ballot box and<\/p>\n<p>counted     separately    and     results    declared<\/p>\n<p>accordingly.   The identity of those votes shall be<\/p>\n<p>recorded separately to exclude any inconvenience to<\/p>\n<p>any party, who may challenge the election.
