Addl.\tCommissioner, Tribal<br \/>\nDevelopment<\/a>[(1964)  6SCC   241],  this\t Court\thad   issued<br \/>\nguidelines for\tthe officers  to issue caste certificates to<br \/>\nthe scheduled Castes and scheduled Tribes for the purpose of<br \/>\nadmission to educational institutions and also employment to<br \/>\na post\tor office  under the state. When the similar matter,<br \/>\nviz, <a href=\"\/doc\/7075\/\">Director of Tribal Welfare, Government of A.P v. Laveti<br \/>\nGiri &amp;\tAnr.<\/a> [(1995)4  sec 32] had come up before the Court,<br \/>\nthie  court   reiterated  the\tguidelines  in\tparagraph  7<br \/>\nindicating  the\t  manner  in  which  the  applications\twere<br \/>\nrequired to  be disposed  of. In  paragraph 8,\talso it\t was<br \/>\nindicated that\tthe Government\tof India  would come forward<br \/>\nwith   uniform\t  legislation\tand   necessary\t  guidelines<br \/>\nprescribing penal  action against  persons who\tviolate such<br \/>\nguidelines or  obtain false  caste certificates,  which is a<br \/>\nfraud on  the constitution  and\t defeat\t the  constitutional<br \/>\nobjectives.\n<\/p>\n<p>     The Andhra\t Pradesh State\tLegislature has\t enacted the<br \/>\nAndhra\tPradesh(   scheduled  Castes  Scheduled\t Tribes\t and<br \/>\nBackward  Classes)   Regulation\t of   Issue  of\t  Community-<br \/>\nCertificates Act,  1993 (16  of 1993) (for short, the &#8216;Act&#8217;)<br \/>\nwhich came  into force with effect from september8,1993. The<br \/>\nabove Act  came to be made pursuant to a direction issued by<br \/>\nthe Andhra  Pradesh High Court. The Act regulates isuance of<br \/>\ncommunity certificates\tto the\tScheduled Castes,  Scheduled<br \/>\nTribes and  Backward Classes  (for  short,  the\t &#8216;Dalits&#8217;  ,<br \/>\n&#8216;Tribes&#8217; and  &#8216;OBC&#8217;). Section  3  prescribes  procedure\t for<br \/>\nmaking\tapplication.   Section\t4   prescribes\t   competent<br \/>\nauthority to  issue such certificataes, section 5 prescribes<br \/>\nprocedure  for\tcanceellation  of  the\tfalse  certificates.<br \/>\nSection 6 lays the burden of proof of status of caste on the<br \/>\nclaimant. Section 7 provides for right of appeal and review.<br \/>\nSection 8  gives power\tof revision to the Government in the<br \/>\nprescribed manner.Section  9 gives  power to  the  competent<br \/>\nauthority to avail the appropriate provisions in C.P.C while<br \/>\nconducting the\tenquiry. Sections  10 to  16 deal  with\t the<br \/>\npenalties,  offences   and  also  the  trial  and  cosequent<br \/>\npunishment etc.\t thereoof . Section 17 bars the jurisdiction<br \/>\nof the\tCivil Court to take cognizance of the matters coming<br \/>\nunder the  Act or  the power  to issue any injuction in that<br \/>\nrespection. Section 18 prorects the officers who act in good<br \/>\nfaith. Section 19 gives overriding power over other laws and<br \/>\nsection\t 20  gives  the\t rule  making  power  to  the  state<br \/>\nGovernment.\n<\/p>\n<p>     The petitioner  has filed\tthe present  application for<br \/>\ndirections  or\t clarifications,  since,  according  to\t the<br \/>\npetitioner,  the  guidelines  issued  by  this\tcourt\t are<br \/>\nrequired to  be worked out within the framework of the above<br \/>\nAct .  Accordingly, by\torder dated  August 20,\t 1996,\tthis<br \/>\nCourt  directed\t  the  state  Goverment\t to  make  rules  in<br \/>\nconformity with\t the Act  and the  guidelines issued by this<br \/>\nCourt ,\t as far\t as  possible,\tthey  need  to\tbe  in\tline<br \/>\ntherewith. If  they are\t not in conformity , then the matter<br \/>\ncan be\tlooked into  after the\trules are  made part  of the<br \/>\nrecord. In  frutherance thereof,  the A.P  Scheduled Castes,<br \/>\nScheduled Tribes  and Backword\tclasses Rules  for Issue  of<br \/>\nCommunity Certificates,\t 1997 (Draft  Rules) have been made.<br \/>\nRules 1\t to19 deal  with the  manner, method and issuance of<br \/>\nthe  certificates,   cancellation  of\tfalse  certificates,<br \/>\ncancellation   of    false   certificates,   procedure\t for<br \/>\nverification, burden  of proof\tof the\tclaims, scrutiny and<br \/>\nreview by  the committees.  Rules 7  and 8  are relevant for<br \/>\nthis purpose .\n<\/p>\n<p>     Rule 7 provides for constitution of Scrutiny and Review<br \/>\nCommittee at  the State level and Rule 8 deals with Scrutiny<br \/>\nCommittee at the District Level.\n<\/p>\n<p>     They are as under:\n<\/p>\n<p>     &#8220;7. Scrutiny and Review Committee (state level):<br \/>\n     A Scrutiny and Review Committee shall be constituted at<br \/>\nthe  stated level with the following officers:\n<\/p>\n<p>a).1) Principal secretary to Government\t\t&#8212; Chairman\n<\/p>\n<p>2)    Commissioner, social Welfare\t\t&#8212; Member\n<\/p>\n<p>3)    Commissioner, Tribal welfare\t\t&#8212; Member\n<\/p>\n<p>4)    Commissioner,<br \/>\n      Welfare of Backward Classes\t\t&#8212; Member\n<\/p>\n<p>5)    Inspector General of police,<br \/>\n       C.B.C.I.D.(P.C.R &amp; Vigilance Cell)      &#8212; Member\n<\/p>\n<p>6)   Additional Secretary \/ Joint Secretary\/<br \/>\n     Deputy Secretary to the Government social welfare<br \/>\n     Department\t\t\t\t     &#8211; Member\n<\/p>\n<p>b).  This Scrutiny and Review Committee shall meet once in<br \/>\nthere months or as often, depending on the necessity.\n<\/p>\n<p>c).  Presence of three members will form the required quorum<br \/>\n     for the meeting of the Committee.\n<\/p>\n<p>d).  This Committee shall review and monitor the functioning<br \/>\n     of\t  the\t Scrutiny   Committees\t at   the   District<br \/>\n     level(constituted\tunder\tRule  8),  it  shall  render<br \/>\n     necessary advice  to the  Government on  various policy<br \/>\n     decisions to  be taken  for streamlining the procedures<br \/>\n     or on  any other  issues  related\tto  the\t issuing  of<br \/>\n     Community Certificates as Per Act 16 Of 1993.\n<\/p>\n<p>e).  The Committee  may also  render necessary\tguidance and<br \/>\n     advice to the Government on cases referred to it, where<br \/>\n     divergent and  conflicting enquiry reports are received<br \/>\n     by the Government, in respect of the community claims.\n<\/p>\n<p>8.   SCRUTINY COMMITTEE (DISTRICT LEVEL)\n<\/p>\n<p>a).  In\t every\tDistrict,  a  Scrutiny\tCommittee  shall  be<br \/>\n     constituted with the following officers:-\n<\/p>\n<pre>     1. Joint collector\t\t\t  -- Chairman\n     2. District Revenue Officer\t    -- Member\n\t\t\t\t\t      (Convenor)\n     3. Deputy Director\t\t\t   -- Member\n      (social Welfare)\n     Deputy Director\n     (Tribal Welfare)\/ District Tribal\n     Welfare officer.\n     Deputy Director\t\t\t  -- Member\n     (Backward Classes welfare)\/\n     District Backward Classes\n     Welfare officer\n     4. Officer of the Research\t\t-- Member\n     Organisation in the\n     Commissionerate of SW\/TW\n     nominated by the concerned\n     Heads of the Department.\n<\/pre>\n<p>     5.\t  Officer representing the PCR\/\t &#8212; Member<br \/>\n     Vigilance Cell in the District\n<\/p>\n<p>(b)  The Scrutiny Committee shall meet at least once in a<br \/>\nmonth or as often, depending the case referred to it.\n<\/p>\n<p>(c)  Presence of three members will from the required quorum<br \/>\nfor the meeting of the committee.\n<\/p>\n<p>(d) (1)\t The Scrutiny  Committee, on  receipt of  the  cases<br \/>\nreferred to  it by  the Competent Authority under Rule 5(i),<br \/>\nshall conduct  enquiry regarding  the  doubtful\t within\t the<br \/>\nperiod specified  in the  notice. This\tperiod should not be<br \/>\nless than 15  (fifteen) days from the date of service of the<br \/>\nnotice on  the\t applicant and\tin no case, on request, more<br \/>\nthan 30\t (thirty) days\tshould be allowed. This notice shall<br \/>\nbe served  on the  applicant through the Competent Authority<br \/>\nwho referred the case to the committee.\n<\/p>\n<p>(2)  The notice\t referred to  in Form &#8211; V shall be served on<br \/>\nthe parent\/guardian in case the applicant is a minor.<br \/>\n(3)  Where the\tperson on  whom a notice in Form-V is served<br \/>\nby the\tscrutiny Committee  fails to  respond\ton the\tdata<br \/>\nmentioned in the notice, the Scrutiny Committee May finalise<br \/>\nits recommendations based on the material\/documents\/evidence<br \/>\nmade available to the Committee by the Competent Authority.<br \/>\n(4)  The Scrutiny  Committee shall  cause enquiry, following<br \/>\nthe due\t process  of  law,  to\tverify\tthe  genuineness  or<br \/>\notherwise of the information furnished or recorded from such<br \/>\npersons as  called in  enquiry as  per Form V. It shall also<br \/>\ncause to  collect documentary evidence\/ or any other related<br \/>\nevidence  about\t  the  correctness   or\t otherwise   of\t the<br \/>\ninformation furnished  or objections  raised by\t any  person<br \/>\nduring the enquiry.\n<\/p>\n<p>(5)  The Scrutiny  Committee may examine the school records,<br \/>\nbirth registration  certificates, if  any, furnished  by the<br \/>\npersons during\tthe enquiry.  It may  also examine any other<br \/>\nperson who  may have  knowledge\t of  the  community  of\t the<br \/>\napplicant .  With  reference  to  the  claims  of  Scheduled<br \/>\nTribes, it  may examine the anthripolotical and ethnological<br \/>\ntraits, deity,\trituals, customs,  mode of  marriage,  death<br \/>\nceremonies\/method of  burial of\t dead bodies  etc., of\tthat<br \/>\nparticular tribe,  to finalise\tits recommendations  to\t the<br \/>\nCompetent Authority.\n<\/p>\n<p>(6)  The   Scrutiny   Committee\t  should   give\t  reasonable<br \/>\nopportunity to\tthe applicate to produce evidence in support<br \/>\nof their  claim. A  public notice by the beat of drum or any<br \/>\nother convenient  mode, may  be published  in the village or<br \/>\nlocality of  the applicant and if any person or association,<br \/>\nopposes such a claim, opportunity produce evidence in person<br \/>\nbefore the  committee may  be given  to him  or\t her.  After<br \/>\ngiving such  an opportunity  to that  person, the  Committee<br \/>\nmay made such enquiry as it deems expedient and finalise its<br \/>\nrecommendations, with  brief reasons  in support thereof, to<br \/>\nthe Competent Authority.\n<\/p>\n<p>(7)  The  Scrutiny  Committee  may  examine  the  report  of<br \/>\nenquiry conducted  by the Revenue Department furnished to it<br \/>\nby the\tCompetent  Authority.  it  may\talso  obtain  expert<br \/>\nopinion\t from  the  Commissionerate  if\t SW\/TW\tthrough\t the<br \/>\nofficers   of\t the   Research\t  organisations\t  of   these<br \/>\nCommissionerates  who\tare  the  members  of  the  Scrutiny<br \/>\nCommittee, if deemed necessary. These enquiry reports may be<br \/>\ncompared and  then recommendations of the Scrutiny Committee<br \/>\nmay be\tfinalised as  to whether the community claim of that<br \/>\napplicant is found to be false or genuine.\n<\/p>\n<p>e)   The Chairman  of the  Scrutiny Committee  claim of\t the<br \/>\nperson in  question or\this or\ther children,  is genuine or<br \/>\nfalse with  reasons thereof, within 45 days from the date of<br \/>\nthe receipt  of the  case referred  to it  by the  Competent<br \/>\nAuthority.&#8221;\n<\/p>\n<p>     Provisions have  ben made\tfor appeals  and review etc.<br \/>\nRule 15\t Prescribes action in case of false claims. Validity<br \/>\nof Integrated  Community Certificate  has been dealt with in<br \/>\nRule 16.  In case  of loss of the original, Rule 17 empowers<br \/>\nthe officers  to issue\tduplicate caste certificate. Rule 19<br \/>\ndeals with  Provisional admission or appointment pending the<br \/>\nissuance of  the caste\tcertificates. Rule  20\trepeals\t the<br \/>\nexisting  Rules.   Rule\t 21  saves  the\t action\t taken\tetc.<br \/>\nSchedules have been appended to supplement the rules.\n<\/p>\n<p>     A reading\tof the Rules would indicate that except some<br \/>\nvariation, in  the matter of the constitution of Committees,<br \/>\nin Rules  7 &amp;  6  from\tthe  guidelines\t issued,  all  other<br \/>\nprovisions are\tin conformity  with the guidelines issued by<br \/>\nthis court.\n<\/p>\n<p>     Though Shri  Rao seeds  to contend\t that notice  may be<br \/>\nissued to the central Government and other state Governments<br \/>\nto make\t rules on  par with  above for\tfinalisation of\t the<br \/>\nrules so  as to\t  be  uniformly\t applicable  throughout\t the<br \/>\ncountry, we think that we need not undertake such exercises.<br \/>\nIt would be for the Central Government to appropriately deal<br \/>\nwith the  matter  by  giving  some  leverage  to  the  State<br \/>\nGovernment to  modulate the  rules conformable\tto the above<br \/>\nlaw and\t the guidelines,  as far  as possible,\tto suit\t the<br \/>\nconditions prevailing\tthe  state concerned  so  that\tthey<br \/>\ncould  be  worked  out\tin  systematic\tmanner\twithout\t any<br \/>\ndifficulty in implementation.\n<\/p>\n<p>     Under the\tcircumstances, we  are of  the view that the<br \/>\ndraft rules  placed before  us are substantially conformable<br \/>\nto the\tdirections issued  by this  Court .  We,  therefore,<br \/>\ndirect the  State Government  to have  them published in the<br \/>\nState Gazette and enforce the Act and the Rules in the light<br \/>\nof the law laid down by this Court.\n<\/p>\n<p>     The application is accordingly ordered.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India The Director Of Tribal Welfare vs Laveti Giri &amp; Ors on 10 March, 1997 Bench: K.
