Jharkhand,\u00a0Ranchi\u00a0as\u00a0respondent.\u00a0\n<\/p>\n<p>                   In\u00a0this\u00a0writ\u00a0petition,\u00a0the\u00a0petitioner\u00a0has\u00a0prayed\u00a0for\u00a0a\u00a0direction\u00a0<br \/>\n            on \u00a0 the \u00a0 respondents \u00a0 to \u00a0 release \u00a0 family \u00a0 pension, \u00a0 amounts \u00a0 of\u00a0<br \/>\n            gratuity,\u00a0provident\u00a0fund\u00a0and\u00a0death\u00adcum\u00adretiral\u00a0benefits,\u00a0payable\u00a0<br \/>\n            to \u00a0 her, \u00a0 after \u00a0 death \u00a0 of \u00a0 her \u00a0 husband. \u00a0 The \u00a0 petitioner \u00a0 has \u00a0 also\u00a0<br \/>\n            prayed \u00a0 for \u00a0 a \u00a0 direction \u00a0 on \u00a0 the \u00a0 respondents \u00a0 to \u00a0 appoint \u00a0 her \u00a0 on\u00a0<br \/>\n            compassionate\u00a0ground.\u00a0\n<\/p>\n<p>                   It\u00a0has\u00a0been\u00a0stated\u00a0that\u00a0the\u00a0petitioner&#8217;s\u00a0husband,\u00a0namely,\u00a0<br \/>\n            Mangal\u00a0Soren\u00a0died\u00a0in\u00a0harness\u00a0on\u00a02nd\u00a0 June,\u00a01994,\u00a0while\u00a0he\u00a0was\u00a0<br \/>\n            working\u00a0as\u00a0Assistant\u00a0Teacher,\u00a0Primary\u00a0School,\u00a0Hethbandha.\u00a0After\u00a0<br \/>\n            the \u00a0 death \u00a0 of \u00a0 her \u00a0 husband, \u00a0 the \u00a0 petitioner, \u00a0 being \u00a0 the \u00a0 widow, \u00a0 is\u00a0<br \/>\n            entitled\u00a0to\u00a0get\u00a0all\u00a0the\u00a0service\u00a0terminal\u00a0benefits\u00a0and\u00a0death\u00adcum\u00ad<br \/>\n            retiral \u00a0 benefits. \u00a0 She \u00a0 is \u00a0 also \u00a0 entitled \u00a0 to \u00a0 get \u00a0 compassionate\u00a0<br \/>\n            appointment.\u00a0The\u00a0petitioner\u00a0applied\u00a0for\u00a0the\u00a0same,\u00a0but\u00a0in\u00a0spite\u00a0of\u00a0<br \/>\n            her \u00a0 repeated \u00a0 request \u00a0 and \u00a0 representations, \u00a0 the \u00a0 pensionary\u00a0<br \/>\n            benefits\u00a0have\u00a0not\u00a0been\u00a0fully\u00a0paid\u00a0and\u00a0she\u00a0has\u00a0not\u00a0been\u00a0given\u00a0<br \/>\n            compassionate\u00a0appointment\u00a0till\u00a0date.\u00a0\n<\/p>\n<p>                   A \u00a0 counter \u00a0 affidavit \u00a0 has \u00a0 been \u00a0 filed \u00a0 on \u00a0 behalf \u00a0 of \u00a0 the\u00a0<br \/>\n            respondents, \u00a0 stating, \u00a0inter \u00a0 alia, \u00a0 that \u00a0 after \u00a0 the \u00a0 death \u00a0 of \u00a0 the\u00a0<br \/>\n            petitioner&#8217;s\u00a0husband,\u00a0the\u00a0respondents\u00a0made\u00a0all\u00a0efforts\u00a0and\u00a0took\u00a0<br \/>\n            initiative\u00a0for\u00a0disposal\u00a0of\u00a0her\u00a0legitimate\u00a0claim.\u00a0They\u00a0collected\u00a0all\u00a0<br \/>\n            the \u00a0 papers \u00a0 and \u00a0 processed \u00a0 her \u00a0 claim \u00a0 for \u00a0 final \u00a0 payment. \u00a0 They\u00a0<br \/>\n            have\u00a0paid\u00a0the\u00a0amounts\u00a0under\u00a0different\u00a0heads\u00a0and\u00a0sent\u00a0papers\u00a0<br \/>\n            for\u00a0fixation\u00a0of\u00a0final\u00a0pension\u00a0vide\u00a0Letter\u00a0no.635\u00a0dated\u00a09th\u00a0 March,\u00a0<br \/>\n            2011. \u00a0 They \u00a0 had \u00a0 also \u00a0 sent \u00a0 letter \u00a0 to \u00a0 the \u00a0 District \u00a0 Provident \u00a0 Fund\u00a0<br \/>\n            Officer, \u00a0 Pakur \u00a0 for \u00a0 payment \u00a0 of \u00a0 the \u00a0 amount \u00a0 of \u00a0 provident \u00a0 fund.\u00a0<br \/>\n            There\u00a0is,\u00a0thus,\u00a0no\u00a0deliberate\u00a0delay\u00a0on\u00a0the\u00a0part\u00a0of\u00a0the\u00a0respondents\u00a0<br \/>\n            and\u00a0\u00a0the\u00a0\u00a0Accountant\u00a0\u00a0General\u00a0\u00a0has\u00a0\u00a0to\u00a0\u00a0finally\u00a0\u00a0issue\u00a0\u00a0the\u00a0\u00a0pension<br \/>\n                                         \u00ad2\u00ad<br \/>\n\u00a0         payment\u00a0order\u00a0(PPO).\u00a0\n<\/p>\n<p>                 Considering \u00a0 the \u00a0 said \u00a0 submissions, \u00a0 this \u00a0 writ \u00a0 petition \u00a0 is\u00a0<br \/>\n          disposed\u00a0of,\u00a0giving\u00a0liberty\u00a0to\u00a0the\u00a0petitioner\u00a0to\u00a0file\u00a0representation,\u00a0<br \/>\n          along\u00a0with\u00a0a\u00a0copy\u00a0of\u00a0this\u00a0order,\u00a0before\u00a0the\u00a0concerned\u00a0authority,\u00a0<br \/>\n          if\u00a0there\u00a0is\u00a0any\u00a0deficiency\u00a0in\u00a0payment\u00a0of\u00a0the\u00a0dues\u00a0under\u00a0different\u00a0<br \/>\n          heads. \u00a0 On \u00a0 receipt \u00a0 of \u00a0 the \u00a0 representation, \u00a0 the \u00a0 concerned\u00a0<br \/>\n          authority\u00a0shall\u00a0consider\u00a0the\u00a0same\u00a0and\u00a0pass\u00a0appropriate\u00a0order,\u00a0in\u00a0<br \/>\n          accordance\u00a0with\u00a0law,\u00a0within\u00a0a\u00a0period\u00a0of\u00a0six\u00a0weeks\u00a0from\u00a0the\u00a0date\u00a0<br \/>\n          of\u00a0receipt\u00a0of\u00a0the\u00a0representation.\u00a0If\u00a0the\u00a0petitioner\u00a0is\u00a0found\u00a0entitled\u00a0<br \/>\n          to\u00a0one\u00a0or\u00a0the\u00a0other\u00a0benefits,\u00a0the\u00a0admitted\u00a0amount\u00a0thereof\u00a0shall\u00a0<br \/>\n          be\u00a0paid\u00a0to\u00a0the\u00a0petitioner\u00a0within\u00a0a\u00a0period\u00a0of\u00a0six\u00a0weeks\u00a0thereafter\u00a0<br \/>\n          with \u00a0 statutory \u00a0 interest. \u00a0 If \u00a0 the \u00a0 amount(s) \u00a0 found \u00a0 payable \u00a0 to \u00a0 the\u00a0<br \/>\n          petitioner \u00a0 is\/are\u00a0 not \u00a0 paid \u00a0within \u00a0 the \u00a0said \u00a0period, \u00a0the \u00a0 petitioner\u00a0<br \/>\n          shall\u00a0be\u00a0entitled\u00a0to\u00a0get\u00a0additional\u00a0compensatory\u00a0interest\u00a0@\u00a010%\u00a0<br \/>\n          per\u00a0annum\u00a0till\u00a0final\u00a0payment.\u00a0\n<\/p>\n<p>                 The\u00a0Accountant\u00a0General,\u00a0Jharkhand\u00a0shall\u00a0issue\u00a0the\u00a0pension\u00a0<br \/>\n          payment\u00a0order\u00a0(PPO)\u00a0after\u00a0observing\u00a0the\u00a0legal\u00a0formalities\u00a0within\u00a0<br \/>\n          a\u00a0period\u00a0of\u00a0four\u00a0weeks\u00a0from\u00a0the\u00a0date\u00a0of\u00a0receipt\u00a0of\u00a0the\u00a0required\u00a0<br \/>\n          papers,\u00a0if\u00a0the\u00a0same\u00a0are\u00a0not\u00a0already\u00a0received\u00a0and\u00a0the\u00a0PPO\u00a0is\u00a0not\u00a0<br \/>\n          issued.\n<\/p>\n<p>                 The \u00a0 State \u00a0 respondents \u00a0 shall \u00a0 also \u00a0 take \u00a0 decision \u00a0 regarding\u00a0<br \/>\n          the \u00a0 claim \u00a0 of \u00a0 the \u00a0 petitioner \u00a0 for \u00a0 compassionate \u00a0 appointment\u00a0<br \/>\n          within \u00a0 a \u00a0 period \u00a0 of \u00a0 four \u00a0 weeks \u00a0 from \u00a0 the \u00a0 date \u00a0 of\u00a0<br \/>\n          receipt\/production\u00a0of\u00a0a\u00a0copy\u00a0of\u00a0this\u00a0order.\u00a0\n<\/p>\n<p>\u00a0<\/p>\n<p>
