1.\tRule.\n<\/p>\n
Mr. Dabhi, learned APP waives service of Notice of Rule on behalf of
\nthe respondent-State.\n<\/p>\n
2.\tHeard
\nMr. Manav, learned advocate for the applicant and Mr.Dabhi, learned
\nAPP for the respondent-State.\n<\/p>\n
3.\tThis
\napplication seeking regular bail under Section 439 of the Code of
\nCriminal Procedure, 1973 has been preferred by applicant in
\nconnection with the offence registered with Shaher Kotda Police
\nStation, Ahmedabad bearing I CR No.325 of 2010 for the offence
\npunishable under Sections 457, 380 and 114 of I.P.C.\n<\/p>\n
4.\tMr.\n<\/p>\n
Manav, leaned advocate for the applicant has submitted that the
\npresent applicant was arrested only from the statement of co-accused,
\nhowever, during the course of remand, any mudamal article has not
\nbeen recovered or discovered from the applicant. Mr. Manav has
\nfurther submitted that there is no eye-witness to the incident and
\nthe applicant has been arrested only on doubt. He has also submitted
\nthat the other co-accused have already been released on bail and
\ntherefore, present applicant may be released on bail.\n<\/p>\n
5.\tThe
\napplication is opposed by Mr.Dabhi, learned APP, who has submitted
\nthat still the investigation is going on and since the applicant
\nappears to be involved in the alleged offence, which is serious in
\nnature, the application deserves to be rejected.\n<\/p>\n
6.\tHaving heard
\nthe learned counsel for both the sides and considering the facts and
\ncircumstances of the case as well as the fact that there is no
\neye-witness to the incident and the applicant is arrested only on the
\nbasis of doubt and since other co-accused have already been released
\non bail and having regard to the documents and other material
\nproduced on record of this case, the gravity of the offence, the
\nquantum of punishment, the allegations against the applicant, the
\nmanner in which the applicant is allegedly involved in the case, I am
\nof the view that the applicant deserve to be released on bail.
\nTherefore, I am inclined to allow this application and release the
\napplicant.\n<\/p>\n

\n\tHence,
\nthis application is allowed. It is directed that the present
\napplicant in connection with I CR No.325 of 2010 registered with
\nSheher Kotda Police Station, Ahmedabad be released on bail, in
\nrespect of the offences alleged against him in this application, on
\nhis executing and furnishing a bond of Rs.10,000\/- (Rupees: Ten
\nThousand Only) with one solvent surety of like amount, by the
\nconcerned Police Officer, and on condition that he shall:-\n<\/p>\n
\t(a) not take
\nundue advantage of or abuse the \tliberty.\n<\/p>\n
(b) not act in
\nmanner injurious to the interest of the prosecution.\n<\/p>\n
(c) maintain
\nlaw and order.\n<\/p>\n
(d) not leave
\nthe State of Gujarat without prior permission of the Sessions Court
\nconcerned.\n<\/p>\n
(e) furnish the
\naddress of his residence at the time of execution of bond and shall
\nnot change the residence without prior permission of the Sessions
\nCourt\/this Court.\n<\/p>\n
(f) surrender
\nhis passport, if any, to the lower court within 4 days from the date
\nof this order.\n<\/p>\n
(g)
\nmark his presence at the Shaher Kotda Police Station, Ahmedabad on
\n13th
\nMay, 2011 and
\nthereafter on every first and fifteenth day of every month,
\nbetween
\n11.00
\na.m. to 3.00 p.m.<\/p>\n
(h) not enter
\nthe revenue limit of  Ahmedabad taluka till the trial is over and for
\n6 months shall not enter revenue limits of Ahmedabad District without
\nprior permission of the Sessions Court, but for marking his presence
\nand attending the Court in connection with this case, the applicant
\nwill be free to enter the limits for a period to the extent necessary
\nand will leave the limits of Ahmedabad District immediately after the
\ncase is adjourned.\n<\/p>\n
8.\tThe
\nauthorities will release the applicant only if he is not required in
\nany other offence for the time being.\n<\/p>\n
9.\tIf breach of
\nany of the above conditions is committed the Sessions Judge concerned
\nwill be free to issue warrant or take any appropriate action in the
\nmatter.\n<\/p>\n
10.\tBail-bond
\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n
11.\tAt the
\ntrial, the trial Court shall not be influenced by the observations,
\nwhich are purely prima facie, tentative and preliminary nature and
\nhave been made only for the purpose of examining prayer for bail
\npending the trial. The Court shall arrive at its own conclusion
\nindependently on the basis of the evidence and other aspects of the
\ncase.\n<\/p>\n
12.\tRule is
\nmade absolute to the aforesaid extent. Direct service is permitted.\n<\/p>\n
