APP for Opponent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/10\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npresent appellant has preferred this appeal under sec. 374(2) of the<br \/>\nCode of Criminal Procedure, against the judgment and order of<br \/>\nconviction and sentence  dated 20.7.2006 passed by the learned Addl.<br \/>\nSessions Judge, Fast Track Court no. 2, Bharuch in Sessions Case No.<br \/>\n21\/2006, whereby, the learned Judge has convicted the appellant no. 1<br \/>\nunder sec. 304-II of IPC and sentenced to undergo R\/I for five years<br \/>\nand to pay a fine of Rs. 1000\/-, in default, to undergo further S\/I<br \/>\nfor three months. The appellant no. 2  is also convicted under sec.<br \/>\n304-II  of IPC and sentenced to undergo R\/I for a period of three<br \/>\nyears and to pay a fine of Rs 1000\/-, in default, to undergo further<br \/>\nS\/I for three months, which is impugned in this appeal.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>Kashyap R. Joshi learned advocate appearing for the appellants has<br \/>\nmade a statement at the bar that the appellant no. 1 has been<br \/>\nreleased on his completion of sentence by the Jail Authority and,<br \/>\ntherefore, he is arguing this appeal qua appellant no. 2.\n<\/p>\n<p>2.\tThe<br \/>\nbrief facts of the prosecution case is as under:\n<\/p>\n<p>3.\tThat<br \/>\non 21.10.2005, when the nephew of complainant named Dhaval was<br \/>\ncracking fire crackers in front of the house of complainant. The<br \/>\naccused no. 1 Bharat Vashrambhai, who is residing near the house of<br \/>\ndeceased, came and asked Dhaval that why he is cracking the fire<br \/>\ncrackers and abused him. At that time, the elder brother of the<br \/>\ncomplainant namely Ashwinbhai told that accused no. 1 that due to<br \/>\nDiwali festival and therefore, he is cracking the fire crackers, so<br \/>\nwhy are you abusing ?  Being aggrieved by the said utterance, the<br \/>\naccused no. 1 had been provoked and went in his house and called his<br \/>\nfather, that is, accused no. 2. He came with knife and assaulted on<br \/>\nthe deceased Ashwinbhai and stabbed the same on the left side of his<br \/>\nchest. At that time, accused no. 1 was armed with stick and had given<br \/>\nstick blow on the back side of Ashwinbhai, due to which, he fell down<br \/>\nand there was a bleeding. The other family members including the<br \/>\ncomplainant and his sister, brother-in-law and father-mother of<br \/>\nAshwinbhai tried to free the deceased from the accused persons. They<br \/>\nhad also been beaten by the accused persons. Thereafter, Ashwinbhai<br \/>\nbecame unconscious and both the accused persons went away from the<br \/>\nplace of offence and then, Ashwinbhai was taken to Government<br \/>\nReferral Hospital in a Tempo of one Rafiqbhai, where, he had been<br \/>\ndeclared dead after examined by the Doctor.\n<\/p>\n<p>4.\tTherefore<br \/>\na complaint came to be filed by the complainant. The panchnama of the<br \/>\nscene of offence place was prepared in the presence of panch witness,<br \/>\ninquest panchnama was also prepared and statements of witnesses were<br \/>\nrecorded and on completion of the investigation, charge-sheet was<br \/>\nfiled in the Court of learned JMFC, Zaghadia. Thereafter, as the case<br \/>\nwas exclusively triable by the Court of Sessions, the learned<br \/>\nMagistrate has committed the case to the Court of Sessions, which was<br \/>\ngiven number as Sessions Case No. 21\/2006.\n<\/p>\n<p>5.\tThereafter,<br \/>\nthe charge was framed at Ex. 1 against the appellants. The appellants<br \/>\n  accused have pleaded not guilty and claimed to be tried.\n<\/p>\n<p>6.\tIn<br \/>\norder to bring the home the charge levelled against the appellants-<br \/>\naccused, the prosecution has examined the witnesses and also produced<br \/>\ndocumentary evidence before the trial Court.\n<\/p>\n<p>7.\tThereafter,<br \/>\nafter examining the witnesses, further statement of the<br \/>\nappellants-accused under sec. 313 of CrPC was recorded in which the<br \/>\nappellant-accused has denied the case of the prosecution.\n<\/p>\n<p>8.\tAfter<br \/>\nconsidering the oral as well as documentary evidence and after<br \/>\nhearing the parties, learned vide impugned judgment and order dated<br \/>\n20.7.2006 held the appellants   accused guilty to the charge<br \/>\nlevelled against them under sec. 304-II of IPC and convicted and<br \/>\nsentenced the appellants accused, as stated above.\n<\/p>\n<p>9.\tBeing<br \/>\naggrieved by and dissatisfied with the impugned judgment and order of<br \/>\nconviction and sentence passed by the learned Addl. Sessions Judge,<br \/>\nFast Track Court no. 2, Bharuch, the present appellants have<br \/>\npreferred this appeal.\n<\/p>\n<p>10.\tHeard<br \/>\nMr. Kashyap Joshi learned advocate for the appellants and Mr HH<br \/>\nParikh  learned APP for the respondent-State.\n<\/p>\n<p>11.\tMr.\n<\/p>\n<p>Joshi  learned advocate for the appellants has fairly admitted that<br \/>\nhe is only arguing the matter on the point of quantum of punishment<br \/>\nand not arguing the matter on merits. Mr Joshi has further submitted<br \/>\nthat the present appellant no. 2 is a father of original accused no.<br \/>\n1 and it was a case of free fight  and self defence, but the learned<br \/>\nJudge has not considered the said issue and due to the fatal injury<br \/>\ncaused by original accused no. 1, the present appellant no. 2 is also<br \/>\nconvicted for the offence under sec. 304-II of IPC. He has also<br \/>\ncontended that looking to the age of the present appellant no. 2, a<br \/>\nvery harsh conviction has been imposed upon him by the learned Judge,<br \/>\nwhich is required to be reduced.   In that view of the matter, the<br \/>\nperiod of sentence is very harsh and looking to the age of the<br \/>\nappellant no.2, the sentence may be reduced. He has further contended<br \/>\nthat the appellant no. 2 is a very poor person and he is the only<br \/>\nbread earner member in the family, and therefore, the sentence<br \/>\nimposed upon the present appellant no. 2 by the learned Judge may be<br \/>\nreduced in the interest of justice.\n<\/p>\n<p>12.\tOn<br \/>\nthe otherside, learned APP Mr HH Parikh has read the impugned<br \/>\njudgment and order of conviction and sentence passed by the learned<br \/>\nJudge and contended that the impugned judgment and order is required<br \/>\nto be confirmed. He has also contended that the stick is concerned,<br \/>\nit is a ring coated stick and present appellant no. 2 is bye caste<br \/>\nRabari and ring coated stick is a deadly weapon and, therefore,<br \/>\nlooking to the conduct of the present appellant and the role, which<br \/>\nis proved beyond reasonable doubt before the learned Judge, the same<br \/>\nis just and proper  and requires to be confirmed.\n<\/p>\n<p>13.\tI<br \/>\nhave gone through the oral as well as documentary evidence produced<br \/>\non the record. I have read the oral evidence of prosecution<br \/>\nwitness-complainant and also perused the charge framed against the<br \/>\nappellant. Looking to the allegations levelled against the present<br \/>\nappellant, they are very serious in nature, but looking to the<br \/>\nconduct of the present appellant no. 2 is concerned, it is covered<br \/>\nwithin the meaning of sec. 114 of IPC and the ring coated stick blow<br \/>\nwas given by the appellant no. 2 after the injured has received knife<br \/>\ninjury. No doubt, it is a request of the learned advocate for the<br \/>\nappellant no. 2 that is a bread winner for the family and he was on<br \/>\nbail during the trial and he also submitted that he is an old man and<br \/>\nthe sentence imposed upon him by the learned Judge is very harsh in<br \/>\nnature and therefore, only on the ground of mercy the sentence may be<br \/>\nreduced. In that view of the matter, when the learned advocate Mr<br \/>\nJoshi appearing for the appellant no. 2 is not arguing the matter on<br \/>\nmerits but arguing the matter on the point of quantum of sentence, I<br \/>\nam of the opinion that this is a fit case to reduce the sentence.\n<\/p>\n<p>14.\tIn<br \/>\nthe result, this appeal is partly allowed. The impugned judgment and<br \/>\norder of conviction dated 20.7.2006 passed in Sessions Case No.<br \/>\n21\/2006 by the learned Addl. Sessions Judge, Fast Track Court no. 2,<br \/>\nBharuch convicting the appellant no. 2   ori. Accused no. 2 under<br \/>\nsec. 304-II of IPC is hereby confirmed. However, the order of<br \/>\nsentence sentencing the appellant no. 2 to undergo R\/I for 3 years<br \/>\nfor the aforesaid offence under sec. 304-II of IPC, is hereby<br \/>\nreduced to the extent that instead  the appellant no. 2 is hereby<br \/>\nsentenced to undergo the  sentence for a period of  2 years. Rest of<br \/>\nthe impugned judgment and order is confirmed.\n<\/p>\n<p>17.\tThe<br \/>\npresent  appellant no. 2   Vashrambhai Mashrubhai Rabari  is<br \/>\ndirected to surrender before the Jail Authority within a period of<br \/>\nfour weeks from the date of this order,  failing which, the<br \/>\nconcerned Sessions Court shall issue non-bailable warrant to effect<br \/>\nthe arrest of the appellant-ori.
