The 4th brother, whose legal  represen-\ntatives are the appellants, filed four suits of\t pre-emption\nagainst\t the  vendee-respondent and those  were\t decreed  on\nterms  of payment of pre-emption money on or  before  August\n30, 1970.\n    The plaintiff-pre-emptors-appellants filed four  appeals\nbefore\tthe  District Judge for the reduction  of  the\tpre-\nemption\t money. On an application moved by  the\t pre-emptors\nthe time for deposit of the amount fixed under the decree by\nthe Trial Court was extended till further orders.\n    The\t appeals were rejected under Order 41 Rule 3 of\t the\nCode of Civil Procedure as being insufficiently stamped\t and\nnot properly presented.\n    Before  hand, however on 26.10.1970, the  plaintiff-pre-\nemptors,  deposited  the  pre-emption amount  in  the  Trial\nCourt.\n    The\t pre-emptors  sought execution\tof  the\t pre-emption\ndecrees. The vendee-judgment debtor raised objections  stat-\ning  that the suits stood automatically dismissed  for\tnon-\ndeposit of the pre-emption money within the time identically\nstipulated under the decrees.\nThe objection was sustained by the Trial\/Executing Court.\n704\n    The appeal to the Appellate Court at the instance of the\npreemptors,  was allowed, permitting the execution  to\tpro-\nceed.\n    A  Single  Judge  of the High Court\t in  further  appeal\nupheld\tthe  view of the District Judge,  but  the  Division\nBench of the High Court allowed the Letters Patent  Appeals,\nupholding the objection made by the vendee-respondent,\tthat\nthere were no decrees which could be executed, against which\nthese appeals by special leave to this Court .were filed.\n    The\t appellants contended that the controversy could  be\ndetermined on the anvil of Section 148 of the Code of  Civil\nProcedure by extending time by the Court, as it was  extend-\nable  when any period was fixed or granted by the Court\t for\nthe  doing  of any act prescribed or allowed by\t the  Court,\neven  though  the  period originally fixed  or\tgranted\t had\nalready expired; that this Court should exercise its plenary\npower in the interests of justice to extend the time.\nDismissing the appeals, this Court,\n    HELD:  1.  There is no law of pre-emption  permitting  a\ndecree\tto be drawn in terms of Section 15(1) of the  Punjab\nPre-emption  Act.  Were\t the Court to exercise\tat  all\t the\ndiscretions on the subject, the Court would in any event  be\ncompleting  the\t process of decreeing the suits;  the  suits\nwhich have been held to fall down under Order 20 Rule 14  of\nthe Code of Civil Procedure, tantamounting to their dismiss-\nal, and that too on present day when such decrees cannot  be\npassed. [707C-D]\n    2.\tThe objections of the vendee must  remain  sustained\nand  the pre-emptor-appellants must fail in the\t event,\t not\ngetting their suits for pre-emption decreed. Decretal  money\ndeposited by the appellants may be permitted to be withdrawn\nby them, if not already withdrawn. [707F-G]\n    <a href=\"\/doc\/986432\/\">Atarn  Parkash v. Babu Ram &amp; Ors.,<\/a> [1983] 1 SCR 844 and <a href=\"\/doc\/40121\/\">Jagar\nDhish Bhargava v. Jawahar Lal Bhargava and Others,<\/a> [1961]  2\nSCR 918, referred to.\n\n\n\nJUDGMENT:\n<\/pre>\n<p>    CIVIL APPELLATE JURISDICTION: Civil Appeal Nos.  2266-69<br \/>\nof 1979.\n<\/p>\n<p><span class=\"hidden_text\">705<\/span><\/p>\n<p>    From  the  Judgment\t dated 9.8.1978 of  the\t Punjab\t and<br \/>\nHaryana High Court in L.P.A. Iqbal Singh<br \/>\nfor the Respondent.\n<\/p>\n<p>The following Order of the Court was delivered:<br \/>\n\tThese appeals by special Leave are directed  against<br \/>\nthe  common  judgment and decree of the Punjab\tand  Haryana<br \/>\nHigh Court passed in L.P.A. Nos. 576-79 of 1975.<br \/>\n    Three brothers, by means of four sale deeds executed  on<br \/>\nJune  25,  1968,  sold some parcels  of\t land  to  Harbhajan<br \/>\nSingh-respondent  herein.  The 4th brother by  the  name  of<br \/>\nUjagar Singh, whose legal representatives are the appellants<br \/>\nherein,. filed four suits of preemption ,against the  vendee<br \/>\nand those were decreed on July 15, 1970, on terms of payment<br \/>\nof  pre-emption\t money on or before August  30,\t 1970.\tFour<br \/>\nappeals\t were filed by the plaintiff-pre-emptors before\t the<br \/>\nDistrict  Judge for the reduction of the pre-emption  money.<br \/>\nOn  an\tapplication moved by the pre-emptors  the  time\t for<br \/>\ndeposit\t of the amount fixed under the decree by  the  Trial<br \/>\nCourt was extended till further orders. The appeals  finally<br \/>\nwere  rejected\tunder Order 41 Rule 3 of the Code  of  Civil<br \/>\nProcedure  as  being insufficiently stamped  and  hence\t not<br \/>\nproperly    presented.\t  Before   hand,    however,\t&#8216;the<br \/>\nlaintiff-pre-emptors all the same, deposited the pre-emption<br \/>\namount\tin  the Trial Court, on their own,  on\tOctober\t 26,<br \/>\n1970.\n<\/p>\n<p>    After  the rejection of their appeals,  the\t pre-emptors<br \/>\nsought execution of the pre-emption decrees which  attracted<br \/>\nobjections by the vendee-judgment debtor. The primary objec-<br \/>\ntion raised was that the suits stood automatically dismissed<br \/>\nfor  non-deposit  of the preemption money  within  the\ttime<br \/>\nidentically  stipulated\t under the questioned  decrees.\t The<br \/>\nplea of the vendee was based on the mandate of Order 20 Rule<br \/>\n14, Civil Procedure &#8216;Code whereunder the Court when  decree-<br \/>\ning  the claim to pre-emption is required to specify in\t the<br \/>\ndecree\ton  or before which the pre-emption money  shall  be<br \/>\npaid, if not already paid, and further if it is not so paid,<br \/>\nthe  suit  shall stand dismissed with  costs.  (Whatever  is<br \/>\nrelevant in Order 21 Rule 14 alone has been taken note\tof).<br \/>\nThe  date  specified by the Trial Court as said\t before\t was<br \/>\nAugust\t30, 1970 and under the interim orders of the  Appel-<br \/>\nlate  Court the time for depositing the said money  was\t ex-<br \/>\ntended till<br \/>\n<span class=\"hidden_text\">706<\/span><br \/>\nfurther\t orders. Undeniably the Court never passed any\tfur-<br \/>\nther orders in that regard and thus the time for  depositing<br \/>\nthe said money stood extended without any limit. The. objec-<br \/>\ntion was sustained by the Trial\/ Executing Court. On  appeal<br \/>\nto  the Appellate Court at the instance of the\tpre-emptors,<br \/>\nthe  District  Judge took .a contrary  view  permitting\t the<br \/>\nexecution  to  proceed. A learned Single Judge of  the\tHigh<br \/>\nCourt in appeal upheld the view of the District Judge, but a<br \/>\nDivision Bench of the High Court. In Letters Patent Appeals,<br \/>\nreversed the District Judge as also the Single Judge uphold-<br \/>\ning  the objection by the vendee that there were no  decrees<br \/>\nwhich could be executed.\n<\/p>\n<p>    We\thave heard learned counsel for the appellant for  he<br \/>\nalonewas present.\n<\/p>\n<p>    There has been a sea change in the law of pre-emption in<br \/>\nthe  States of Punjab and Haryana where from  these  appeals<br \/>\nhave  arisen. Whereas in Punjab the Punjab  Pre-emption\t Act<br \/>\nitself\thas been repealed, in Haryana it  has  substantially<br \/>\nbeen  chopped down by justicing. This Court in <a href=\"\/doc\/986432\/\">Atam  Parkash<br \/>\nv. State of Haryana &amp; Ors.,<\/a> [1986] 1 SCR 399 declared  ultra<br \/>\nvires  section 15(1) of the Punjab Pre-emption Act,  as\t ap-<br \/>\nplicable  to  Haryana, whereunder certain relatives  of\t the<br \/>\nvendor had been given the right to pre-empt a sale of immov-<br \/>\nable. property. The view of this Court and the present state<br \/>\nof  law is not by any means insignificant or irrelevant\t for<br \/>\njudging the present matter and for resolving the controversy<br \/>\nin hand. Rather its pervasive thought permeats the mind.<br \/>\n    Learned  counsel for the appellants would have the\tcon-<br \/>\ntroversy determined on the anvil of Section 148 of the\tCode<br \/>\nof Civil Procedure, pleading for time to be extended by\t the<br \/>\nCourt,\tas  it\tis extendable when any period  is  fixed  or<br \/>\ngranted by the Court for the doing of any act prescribed  or<br \/>\nallowed\t by  the Court, even though  the  period  originally<br \/>\nfixed or granted has already expired. He has brought to\t our<br \/>\nnotice that in the main matter when the appeal was  rejected<br \/>\nby  the District Judge as being insufficiently stamped\ttime<br \/>\nwas asked from the District Judge to make good the deficien-<br \/>\ncy  in\tthe stamp duty but that was rejected and  though  he<br \/>\nconcedes that the matter was not taken up in revision before<br \/>\nthe High Court, it is still contended that this Court should<br \/>\nexercise its plenary power to extend the time in the  inter-<br \/>\nests  of justice and have the Court fee made good.  He\talso<br \/>\nconcedes  that when the District Judge was asked  to  extend<br \/>\nand  specify the time for deposit of the pre-emption  money,<br \/>\nhe had declined to exercise his discretion, so as to regula-<br \/>\nrise payment, when the appellants had by themselves<br \/>\n<span class=\"hidden_text\">707<\/span><br \/>\ndeposited the pre-emption money on October 26, 1970  before-<br \/>\nhand,leaving the matter to be agitated before the  executing<br \/>\nCourt.\tLikewise  it is contended that this  Court  can\t and<br \/>\nshould\tspecify the time for deposit so as to regularise  it<br \/>\nin exercise of powers under Section 148 C.P.C. He also high-<br \/>\nlights that the mistake herein was that of the Courtand\t for<br \/>\nboth the propositions he takes aid of <a href=\"\/doc\/72150\/\">Jogdhayan v. Babu\t Ram<br \/>\n&amp; Ors.,<\/a> [1983] 1 SCR 844 and <a href=\"\/doc\/40121\/\">Jagat Dhish Bhargava v. Jawahar<br \/>\nLal  Bhargava and Others,<\/a> [1961] 2 SCR 918. In any event  he<br \/>\nconcedes that for the later wrongful non-exercise of discre-<br \/>\ntion  of  the District Judge, the matter was  not  taken  in<br \/>\nSecond\tAppeal or Revision, as the case may be,\t before\t the<br \/>\nHigh Court.\n<\/p>\n<p>We  have  pondered  over, the matter. Our  view\t may  appear<br \/>\nsome-what slanting but we cannot disassociate ourselves from<br \/>\nthe canvass now spread, showing there is no law of  pre-emp-<br \/>\ntion  permitting  a decree to be drawn in terms\t of  Section<br \/>\n15(1) of the Punjab Pre- emption Act. Were we to exercise at<br \/>\nall the discretions on the subject afore-mentioned we  would<br \/>\nin  any\t event be completing the process  of  decreeing\t the<br \/>\nsuits;\tthe  suits which have been held to fall\t down  under<br \/>\nOrder 20 Rule 14 of the Code of Civil Procedure, tantamount-<br \/>\ning  to\t their dismissal, and that too on present  day\twhen<br \/>\nsuch decrees cannot be passed.\n<\/p>\n<p>The High Court however, took the controversy in a different-<br \/>\nlight.\tIt  took the view that\tthe  insufficiently  stamped<br \/>\nappeals be\/ore the District Judge were no appeals in the eye<br \/>\nof  law, as was contende don behalf of the vendee,  and\t the<br \/>\nview  of the District Judge in not extending time was  right<br \/>\nas  it was rightly considered that the appeals had not\tbeen<br \/>\nentertained at all. Support was also taken for its  view by<br \/>\nthe  High  Court from the circumstance of the order  of\t the<br \/>\nCourt extending time ex-parte, which conferred no obligation<br \/>\non  the vendee to treat the decree operative against him  as<br \/>\nand  when the pre-emptors chose to deposit  the\t pre-emption<br \/>\nmoney.\tThe High COurt on this reasoning restored the  judg-<br \/>\nment  of the Trial\/Executing Court,upholding the  objections<br \/>\nof the vendee. Where the High Court arrived by following one<br \/>\nway, we have been led to arrive by another. The end  result,<br \/>\nhowever,  is  the  same that the objections  of\t the  vendee<br \/>\nmustremain sustained and the pre-emptor-appellants must fail<br \/>\nin  the\t event,not getting their suits for  pre-emption\t de-<br \/>\ncreed. The appeals must thus inevitably fail and are  hereby<br \/>\ndismissed.  Decreetal money deposited by the appellants\t may<br \/>\nbe  permitted to be withdrawn by them, ii not already  with-<br \/>\ndrawn.
