Notice was also issued<br \/>\n\tto the Official Liquidator so far as Transferor Companies are<br \/>\n\tconcerned.\n<\/p>\n<p>The<br \/>\n\tRegional Director has filed his affidavit way back on 07.05.2010<br \/>\n\traising the grievance that in view of non-cooperation as well as<br \/>\n\tnon-compliance of requirements of this office, he is not in a<br \/>\n\tposition to examine the affairs of the Company in context of the<br \/>\n\tpetitions and proposed Scheme so as to conclude as to whether<br \/>\n\tpetitions are in order.  There is no reply filed by the petitioner<br \/>\n\tCompanies to this report of the Regional Director.\n<\/p>\n<p>The<br \/>\n\tOfficial Liquidator has pointed out that pursuant to the notice<br \/>\n\tissued by this Court, matters were referred to the Chartered<br \/>\n\tAccountant for investigating the books of accounts of the Transferor<br \/>\n\tCompanies.  Three different Chartered Accountants were entrusted<br \/>\n\tthis work.  However, it appears that the petitioner Companies are<br \/>\n\tnot co-operating to the Chartered Accountant and grievance is<br \/>\n\tventilated by the Chartered Accountant.  He also wrote letters to<br \/>\n\tthe Transferor Companies requesting them to depute persons for<br \/>\n\tdiscussing the affairs of the Company and for determining the fees<br \/>\n\tto be paid to the Chartered Accountant. The petitioner Companies<br \/>\n\twere also requested to furnish the particulars and information in<br \/>\n\ttriplicate to his office, as per the proforma enclosed with the said<br \/>\n\tletter.  It appears that the petitioner Companies are not responding<br \/>\n\teither to the Chartered Accountant or to the Regional Director.<br \/>\n\tEven before the Court also, the petitions are fixed for hearing.<br \/>\n\tNobody appears on behalf of the petitioners.\n<\/p>\n<p>In<br \/>\n\tthe above view of the matter, it appears that the petitioner<br \/>\n\tCompanies are not interested for obtaining the sanction to the<br \/>\n\tScheme and hence, all the petitions are accordingly dismissed.\n<\/p>\n<p>\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t\t[K.
