1.\tHeard
\nMr. Dave, learned advocate for the applicant and Mr.Dabhi, learned
\nAPP for the respondent-State.\n<\/p>\n
2.\tThis
\napplication seeking regular bail under Section 439 of the Code of
\nCriminal Procedure, 1973 has been preferred by applicant in
\nconnection with the offence registered with Godhara
\nTaluka Police Station bearing
\nProhibition CR No.-59
\nof 2011 for
\nthe offence punishable under Sections 66(B), 65(A)(E), 116-B, 81 of
\nthe Bombay Prohibition Act.\n<\/p>\n
3.\tMr.\n<\/p>\n
Dave, leaned advocate for the applicant has submitted that the name
\nof the applicant is not mentioned in the FIR as an accused person. He
\nfurther submitted that the applicant was not present at the time of
\nthe incident. Therefore, he has requested to release the present
\napplicant on regular bail.\n<\/p>\n
4.\tThe
\napplication is opposed by Mr.Dabhi, learned APP, who has submitted
\nthat the applicant committed the alleged offence which is serious in
\nnature and that therefore the application deserves to be rejected.\n<\/p>\n
5.\tHaving
\nheard the learned counsel for both the sides and considering the
\nfacts and circumstances of the case as well as the documents and
\nother material produced on record of this case, the gravity of the
\noffence, the quantum of punishment, the allegations against the
\napplicant, the manner in which the applicant is allegedly involved in
\nthe case as per the allegation of the prosecution, coupled with the
\nfact that prima facie there is no direct evidence to connect the
\napplicant with the alleged crime and he has been arrested after one
\nmonth, I am of the view that the applicant deserve to be released on
\nregular bail, I am inclined to allow this application and release the
\napplicant.\n<\/p>\n

\n\tHence,
\nthis application is allowed. It is directed that the present
\napplicant  in connection with Prohibition CR
\nNo.59 of 2011 registered
\nwith Godhara
\nTuluka Police Station,
\nbe released on bail, in respect of the offences alleged against him
\nin this application, on his executing and furnishing a bond of
\nRs.10,000\/- (Rupees: Ten Thousand Only) with one solvent surety of
\nlike amount, by the concerned Police Officer, and on condition that
\nhe shall:-\n<\/p>\n
\t(a)
\nnot take undue advantage of or abuse the \tliberty.\n<\/p>\n
(b)
\nnot act in manner injurious to the interest of the prosecution.\n<\/p>\n
(c)
\nmaintain law and order.\n<\/p>\n
(d)
\nnot leave the State of Gujarat without prior permission of the
\nSessions Court concerned.\n<\/p>\n
(e)
\nfurnish the address of his residence at the time of execution of bond
\nand shall not change the residence without prior permission of the
\nSessions Court\/this Court.\n<\/p>\n
(f)
\nsurrender his passport, if any, to the lower court within 4 days from
\nthe date of this order.\n<\/p>\n
(g)
\nmark his presence at the Godhara
\nTuluka Police Station,
\ninitially
\non 12th
\nMay, 2011 and
\nthereafter on every first and fifteenth day of every
\nmonth, between
\n11.00 a.m. to
\n3.00 p.m.<\/p>\n
(h)
\nnot enter the revenue limit of Ghoghamba Taluka till the trial is
\nover and for 6 months shall not enter revenue limits of Panchmahal
\nDistrict without prior permission of the Sessions Court, but for
\nmarking his presence and attending the Court in connection with this
\ncase the applicant will be free to enter the limits for a period to
\nthe extent necessary and will leave the limits of Panchmanal District
\nimmediately after the case is adjourned.\n<\/p>\n
7.\tThe
\nauthorities will release the applicant only if he is not required in
\nany other offence for the time being.\n<\/p>\n
8.\tIf
\nbreach of any of the above conditions is committed the Sessions Judge
\nconcerned will be free to issue warrant or take any appropriate
\naction in the matter.\n<\/p>\n
9.\tBail-bond
\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n
10.\tAt
\nthe trial, the trial Court shall not be influenced by the
\nobservations, which are purely prima facie, tentative and preliminary
\nnature and have been made only for the purpose of examining prayer
\nfor bail pending the trial. The Court shall arrive at its own
\nconclusion independently on the basis of the evidence and other
\naspects of the case.\n<\/p>\n
11.\tRule
\nis made absolute to the aforesaid extent. Direct service is
\npermitted.\n<\/p>\n
