GOPINATHAN, J.\n              - - - - - - - - - - - - - - - - - - - - - - -\n                  Crl.R.P.No. 3427 of 2009\n              - - - - - - - - - - - - - - - - - - - - - - -\n         Dated this the 4th day of November, 2009\n\n                             O R D E R\n<\/pre>\n<pre>     1.   Revision      petitioner         is     the      accused  in\n\nC.C.No.102\/2007 on the file of the                Judicial First Class\n\nMagistrate (Additional Munsiff), Kasaragod.                    The 2nd\n\n<\/pre>\n<p>respondent herein prosecuted the revision petitioner<\/p>\n<p>alleging offence under Section 138 of the Negotiable<\/p>\n<p>Instruments Act. After trial the revision petitioner was<\/p>\n<p>found guilty. Consequently he was convicted and sentenced<\/p>\n<p>to simple imprisonment for six months with direction to pay<\/p>\n<p>Rs.80,000\/- as compensation to the 2nd respondent.                  In<\/p>\n<p>default of payment of compensation the revision petitioner<\/p>\n<p>was ordered to undergo simple imprisonment for three<\/p>\n<p>months.    In Crl. Appl. No.14\/2008 the conviction was<\/p>\n<p>confirmed.    But, the sentence was reduced to simple<\/p>\n<p>imprisonment for 10 days with compensation.<\/p>\n<p>     2.   Assailing the legality, correctness and propriety<\/p>\n<p>of the above conviction and sentence as confirmed in<\/p>\n<p>Crl.R.P.No. 3427 of 2009<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>appeal, this revision petition was filed.<\/p>\n<p>      3.     Having heard the learned counsel for the revision<\/p>\n<p>petitioner and perusing the judgments of the court below, I<\/p>\n<p>find that the 2nd respondent who was examined as PW1<\/p>\n<p>supported by Exts.P1to P6 had succeeded to establish that<\/p>\n<p>the revision petitioner borrowed a sum of Rs.80,000\/- from<\/p>\n<p>the 2nd respondent and in discharge of that liability Ext.P1<\/p>\n<p>cheque dated 28.12.2006, drawn on State Bank of<\/p>\n<p>Travancore, Manjeshwar Branch was issued and that when<\/p>\n<p>Ext.P1 cheque was sent for collection it was returned<\/p>\n<p>dishonoured for want of sufficient funds as evidenced by<\/p>\n<p>Ext.P2 memo dated 29.12.2006 and P3 intimation dated<\/p>\n<p>02.01.2007. Demanding discharge of the liability, a lawyer<\/p>\n<p>notice, copy of which was marked as Ext.P4, was caused.<\/p>\n<p>The notice was returned unclaimed as evidenced by Ext.P6.<\/p>\n<p>The liability was not discharged. Revision petitioner, during<\/p>\n<p>the trial took up a defence that an amount of Rs.10,000\/-<\/p>\n<p>was borrowed from one Murali and as security, a blank<\/p>\n<p>Crl.R.P.No. 3427 of 2009<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>cheque was issued. The amount borrowed was discharged<\/p>\n<p>and that misusing the cheque so given this complaint was<\/p>\n<p>filed.    However the revision petitioner did not care to<\/p>\n<p>adduce any evidence in support of his plea. The evidence of<\/p>\n<p>PW1 supported by Exts.P1 to P6 and the legal presumptions<\/p>\n<p>under Sections 118 and 139 of the Negotiable Instruments<\/p>\n<p>Act remains uncontroverted. I find no reason to disbelieve<\/p>\n<p>the evidence of PW1.       The complaint was filed after<\/p>\n<p>complying the statutory procedures. The courts below<\/p>\n<p>arrived at a correct conclusion that the revision petitioner<\/p>\n<p>committed the offence under Section 138 of the Negotiable<\/p>\n<p>Instruments Act. I find that the conviction under challenge<\/p>\n<p>is unassailable.\n<\/p>\n<p>      4.     Taking note that the revision petitioner is a<\/p>\n<p>person without any employment and an ordinary money<\/p>\n<p>transaction had caused him to face the prosecution, I find<\/p>\n<p>that he is entitled to a little more leniency and that a<\/p>\n<p>sentence of imprisonment till rising of the court with<\/p>\n<p>Crl.R.P.No. 3427 of 2009<br \/>\n<span class=\"hidden_text\">                                4<\/span><\/p>\n<p>Rs.80,000\/- as compensation would meet the ends of justice.<\/p>\n<p>      5.     In the result, the revision petition is allowed in<\/p>\n<p>part.     While confirming the conviction, the sentence is<\/p>\n<p>reduced to imprisonment till rising of the court with<\/p>\n<p>compensation of Rs.80,000\/-.       In default of payment     of<\/p>\n<p>compensation the revision petitioner shall undergo simple<\/p>\n<p>imprisonment for three months. The revision petitioner is<\/p>\n<p>granted six months time for payment of compensation. Till<\/p>\n<p>then, the bail bond executed by him will remain in force.<\/p>\n<p>                                          P.S.
