Savitri Devi\n                                   -----------\n<\/pre>\n<p>2.   25.07.2011               Heard learned counsel for the petitioner.<\/p>\n<p>                                    This M.J.C. application has been filed for restoration of<\/p>\n<p>                      First Appeal No. 140 of 2010 which was dismissed for non-compliance<\/p>\n<p>                      of the order dated 16.03.2011. The learned counsel for the petitioner<\/p>\n<p>                      submitted that because the record was misplaced inadvertently, the<\/p>\n<p>                      order could not be complied with within the period.<\/p>\n<p>                                    Considering the above facts and circumstances of this case<\/p>\n<p>                      and the explanation given in the M.J.C. application, I am satisfied that<\/p>\n<p>                      the petitioner was prevented by sufficient cause from not complying the<\/p>\n<p>                      peremptory order passed by this Court.              Therefore, the M.J.C.<\/p>\n<p>                      application is allowed and the First Appeal No. 140 of 2010 is restored<\/p>\n<p>                      to its original file.\n<\/p>\n<p>                                    It is made clear that the petitioner who is the appellant of the<\/p>\n<p>                      First Appeal must comply the order dated 16.03.2011 within 10 days<\/p>\n<p>                      failing which the First Appeal shall again stands dismissed without<\/p>\n<p>                      further reference to Bench.\n<\/p>\n<\/p>\n<pre>         Saif                                  (Mungeshwar Sahoo, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Yogendra Nath Mishra vs Smt.
