Smt.Dhopali &amp; Ors.)\n\n\n\n            Date of Order       ::     04.03.2010\n\n\n    HON'BLE MR. JUSTICE A.M. KAPADIA\n HON'BLE MR. JUSTICE GOPAL KRISHAN VYAS\n\n\nMr.R.K. Mehta, for the appellant.\nMr.Narpat Singh, for the respondents.\n\n\n\n            This special appeal has been filed under\nSection 18 of the Rajasthan High Court Ordinance,\n1949 against the judgment of learned Single Judge\ndated 22nd May, 2002 passed in Civil Misc. Appeal\nNo.636\/1996,      by   which,    the    appeal   filed    by   the\ninsurance    company      has        been   allowed      and   the\njudgment and award impugned was modified to the\nextent of liability of the appellant.\n            The learned Single Judge has passed the\nfollowing order:-\n             \"In view of the above discussion, this\n             appeal is allowed. The judgment and\n             award impugned is modified in that the\n             liability of the appellant insurance\n             company is held to be limited to the\n             extent of Rs.15,000\/- and interest\n             thereon.     The appellant insurance\n             company is, however, directed to pay\n             the entire amount of compensation\n             alongwith interest to the respondent-\n             claimants within a period of three\n             months from today but shall be entitled\n             to recover the excess amount from the\n             owner of the insured vehicle paid\n             beyond its liability.     There shall,\n             however, be no order as to costs.\"\n\n\n\n            Learned counsel appearing on behalf of\nrespondents has invited attention of this Court towards\nthe judgment reported in 2007 (1) DNJ (Raj.) p. 569\n(R.S.R.T.C. &amp; Ors. Vs. Vaibhav Kumar &amp; 29 Ors.), in\nwhich, the Division Bench of Rajasthan High Court at\nJaipur Bench has held in para 27 that no further appeal\n                                           !! 2 !!\n\n                 (by whatever name called, letters patent appeal or\n                 special appeal) shall lie to the Division Bench of the\n                 same High Court. Para 27 reads as follows:-\n                            \"The Supreme Court in the case of\n                            Kamal Kumar Dutta has expounded the\n                            legal position with reference to Section\n                            100-A in unambiguous terms that where\n                            appeal has been decided from an\n                            original order by a Single Judge, no\n                            further appeal has been provided and\n                            that power which used to be there\n                            under the Letters Patent of the High\n                            Court     has     been     subsequently\n                            withdrawn. Applying this ratio, it would\n                            be seen that the order\/award passed by\n                            the Motor Accident Claims Tribunal is an\n                            original order and against that an\n                            appeal has been provided before the\n                            High Court under Section 173 of the\n                            Motor Vehicles Act, that is, an appeal\n                            from the original order. In this view of\n                            the matter, no further appeal (by\n                            whatever name called, letters patent\n                            appeal or special appeal) shall lie to the\n                            Division Bench of the same High Court.\"\n\n\n\n                            In th is view of the matter,     this special\n                 appeal is dismissed as not maintainable.\n\n\n\n                 (GOPAL KRISHAN VYAS), J.
