B.K.Gopalakrishnan, the learned counsel appearing<\/p>\n<p>for the petitioners and Sri. T.A.Shaji, the learned standing counsel<\/p>\n<p>appearing for the Mahatma Gandhi University.\n<\/p>\n<p>      2.  The petitioners appeared for the 8th semester B.Tech<\/p>\n<p>examination in different branches of Engineering held in May-June<\/p>\n<p>2009 by the Mahatma Gandhi University. The results were declared<\/p>\n<p>in August 2009. They failed in some papers. The petitioners have<\/p>\n<p>therefore applied for revaluation of their answer scripts by submitting<\/p>\n<p>Exts.P1 to P10 applications.      It is submitted that the applications<\/p>\n<p>were submitted in time and that the requisite fee has also been paid.<\/p>\n<p>The details of the papers in which the petitioners have sought<\/p>\n<p>revaluation are furnished in the form of a table at page 4 of this writ<\/p>\n<p>petition. The petitioners submit that if their answer scripts are<\/p>\n<p>revalued, they are sure to secure a pass and that unless their<\/p>\n<p>answer scripts are revalued expeditiously, their career prospects will<\/p>\n<p>be adversely affected. In this writ petition the petitioners seek a writ<\/p>\n<p>W.P.(C) No. 26034\/09<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>in the nature of mandamus commanding the respondents to revalue<\/p>\n<p>their answer scripts and to communicate the results expeditiously<\/p>\n<p>and within a time limit to be fixed by this Court.<\/p>\n<p>      3. Sri.T.A.Shaji, the learned Standing Counsel appearing for<\/p>\n<p>the Mahatma Gandhi University submits that petitioners&#8217; applications<\/p>\n<p>cannot be singled out and revalued as it will lead to loss of<\/p>\n<p>confidentiality. He also submits that as per the Examination Manual,<\/p>\n<p>the University requires 81 clear days from the date of publication of<\/p>\n<p>the results to complete the revaluation process. He further submits<\/p>\n<p>that the petitioners&#8217; applications for revaluation will be considered<\/p>\n<p>and the answer scripts revalued, if their applications are in order,<\/p>\n<p>within the aforesaid period.\n<\/p>\n<p>      4. The Examination Manual is not a statutory regulation. It is a<\/p>\n<p>Manual prepared by the University for its guidance. The stipulations<\/p>\n<p>in the Examination Manual cannot, in my opinion, operate to the<\/p>\n<p>detriment of students.       A Division Bench of this Court has in<\/p>\n<p><a href=\"\/doc\/1085668\/\">University of Kerala v. Sandhya P. Pai<\/a> (1991 (1) KLT 812) held that<\/p>\n<p>the University should hurry with applications for revaluation without<\/p>\n<p>wasting any time and that unless applications for revaluation are<\/p>\n<p>W.P.(C) No. 26034\/09<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>expeditiously disposed of, it will cause serious prejudice to the<\/p>\n<p>students. I am therefore of the considered opinion that University<\/p>\n<p>should not wait for the expiry of 81 clear days from the date of<\/p>\n<p>publication of the results to complete the revaluation process.<\/p>\n<p>        I accordingly dispose of this writ petition with a direction to the<\/p>\n<p>respondents to complete the revaluation of the answer scripts<\/p>\n<p>described in Exts. P1 to P10 applications and to communicate the<\/p>\n<p>results to the petitioners within six weeks from the date on which the<\/p>\n<p>petitioners produce a certified copy of this judgment before the<\/p>\n<p>Controller of Examinations, Mahatma Gandhi University.
