SIRI JAGAN, J.\n                 ------------------------------------\n                   W.P.(C)No.24390 OF 2008\n               ----------------------------------------\n               Dated this the 21st day of August, 2008\n\n                            JUDGMENT\n<\/pre>\n<p>      The petitioner challenges Ext.P5 order, whereby the<\/p>\n<p>petitioner has been directed to pay the amounts recovered by the<\/p>\n<p>petitioner from the customers towards the differential cost of<\/p>\n<p>kerosene, as a licenced dealer of the Civil Supplies Department of<\/p>\n<p>the Government of Kerala.      The petitioner&#8217;s contention is that in<\/p>\n<p>view of Ext.P15 judgment, the Government has no power to<\/p>\n<p>realise the differential cost of kerosene as there is no principal-<\/p>\n<p>agent relationship between the Government and the petitioner.<\/p>\n<p>      2.    In view of the two Division Bench decisions in <a href=\"\/doc\/952094\/\">All<\/p>\n<p>Kerala Retail Ration Dealers Association V. Union of India<\/a><\/p>\n<p>[2001(2) KLT 1] and <a href=\"\/doc\/1939873\/\">State of Kerala and others V.<\/p>\n<p>Mathunni Mathew &amp; Sons<\/a> [ILR 2007(2) Kerala 475], that<\/p>\n<p>issue is no more res integra and therefore the petitioner cannot<\/p>\n<p>now contend that the petitioner is not an agent of the<\/p>\n<p>Government. As such, if the petitioner has realised any<\/p>\n<p>differential cost for kerosene from the customers, the petitioner<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.24390\/08                2<\/span><\/p>\n<p>cannot contend that the petitioner will not refund the same to<\/p>\n<p>the Government on the ground that the petitioner is not an<\/p>\n<p>agent of the Government. However, the petitioner has got a<\/p>\n<p>case that the petitioner has not realised any differential cost at<\/p>\n<p>all and further that the quantification in Ext.P5 was without<\/p>\n<p>notice to the petitioner or a hearing.\n<\/p>\n<p>      3.    The learned Government Pleader points out that as<\/p>\n<p>is clear from Ext.P5 itself, the petitioner has been served with<\/p>\n<p>a notice dated 30.4.2008. The petitioner would contend that<\/p>\n<p>the petitioner has not received that notice at all.<\/p>\n<p>      4.    I am of opinion that without going into that<\/p>\n<p>controversy, the matter can be disposed of by directing<\/p>\n<p>another opportunity of being heard to the petitioner.<\/p>\n<p>Accordingly, while upholding the right of the Government to<\/p>\n<p>realise the differential cost recovered by the petitioner from<\/p>\n<p>the customers, I dispose of this writ petition with the following<\/p>\n<p>directions:\n<\/p>\n<p>      Ext.P5 shall be treated as a show cause notice.        The<\/p>\n<p>petitioner shall file objections to the same within a period of<\/p>\n<p>one week.        The petitioner shall appear before the 5th<\/p>\n<p>respondent on 2nd September 2008 on which date or on a<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.24390\/08             3<\/span><\/p>\n<p>subsequent date fixed for the purpose, the 5th respondent shall<\/p>\n<p>hear the petitioner and pass appropriate orders in the matter.<\/p>\n<p>While disposing of the same, the petitioner&#8217;s grievance in Exts.<\/p>\n<p>P12 to P14 shall also be considered and orders passed. Till<\/p>\n<p>orders are so passed, the recovery proceeding shall be kept in<\/p>\n<p>abeyance.\n<\/p>\n<\/p>\n<p>                                        S.
