In \u00a0 response, \u00a0 the \u00a0 CPIO \u00a0 has \u00a0 stated \u00a0 that \u00a0 the\u00a0<br \/>\nCommission&#8217;s\u00a0decision\u00a0was\u00a0conveyed\u00a0to\u00a0NIA\u00a0and\u00a0GIPSA.\u00a0<br \/>\nGIPSA\u00a0was\u00a0asked\u00a0vide\u00a0letter\u00a0dated\u00a05th\u00a0 August,\u00a02010\u00a0to\u00a0<br \/>\nobtain \u00a0 a \u00a0 copy \u00a0 of \u00a0 the \u00a0 answer \u00a0 sheet \u00a0 from \u00a0 NIA \u00a0 and\u00a0<br \/>\nprovide\u00a0the\u00a0same\u00a0to\u00a0the\u00a0CPIO.\u00a0\n<\/p>\n<p>3.     Vide \u00a0 letter \u00a0 dated \u00a0 13th\u00a0 August, \u00a0 2010 \u00a0 GIPSA\u00a0<br \/>\ninformed \u00a0 the \u00a0 Personnel \u00a0 Department \u00a0 of \u00a0 OIC \u00a0 regarding\u00a0<br \/>\nthe \u00a0 inability \u00a0 to \u00a0 comply \u00a0 with \u00a0 the \u00a0 Commission&#8217;s \u00a0 order\u00a0<br \/>\ndue \u00a0 to \u00a0 not \u00a0 having \u00a0 a \u00a0 mandate \u00a0 from \u00a0 the \u00a0 member\u00a0<br \/>\ncompanies.\u00a0\n<\/p>\n<p>4.     The \u00a0order \u00a0of\u00a0the\u00a0 CIC\u00a0was\u00a0 then\u00a0sent \u00a0by\u00a0Oriental\u00a0<br \/>\nInsurance \u00a0 Co. \u00a0 Ltd. \u00a0 to \u00a0 National \u00a0 Insurance \u00a0 Academy\u00a0<br \/>\n(NIA) \u00a0 with \u00a0 a \u00a0 request \u00a0 to \u00a0 provide \u00a0 a \u00a0 copy \u00a0 of \u00a0 the \u00a0 said\u00a0<br \/>\nanswer\u00a0sheet\u00a0of\u00a0the\u00a0applicant.\u00a0 \u00a0As\u00a0per\u00a0 \u00a0letter\u00a0dated\u00a0<br \/>\n4.10.2010 \u00a0 from \u00a0 OIC, \u00a0 &#8220;NIA, \u00a0 Pune \u00a0 has \u00a0 \u00a0 replied \u00a0 vide\u00a0<br \/>\nletter \u00a0 dated \u00a0 9.9.2010 \u00a0 (Ref \u00a0 our \u00a0 letter \u00a0 dated\u00a0<br \/>\n20.8.2010) \u00a0 stating \u00a0 that \u00a0 as \u00a0 per \u00a0 the \u00a0 Professional\u00a0<br \/>\nService \u00a0 Agreement \u00a0 between \u00a0 GIPSA \u00a0 and \u00a0 NIA \u00a0 (dated\u00a0<br \/>\n01.02.2007) \u00a0 &#8211; \u00a0 Article \u00a0 2 \u00a0 : \u00a0 NIA&#8217;s \u00a0 obligations, \u00a0 point\u00a0<br \/>\n 2.7 \u00a0 clearly \u00a0 states \u00a0 that \u00a0 &#8220;GIPSA \u00a0 will \u00a0 retain \u00a0 the\u00a0<br \/>\nownership\u00a0of\u00a0the\u00a0copyright\u00a0and\u00a0all\u00a0other\u00a0intellectual\u00a0<br \/>\nproperty \u00a0 rights \u00a0 (&#8220;IPR&#8221;) \u00a0 \u00a0 vested \u00a0 in \u00a0 Deliverables&#8221;.\u00a0<br \/>\nIn\u00a0view\u00a0of\u00a0the\u00a0forgoing\u00a0we\u00a0are\u00a0unable\u00a0to\u00a0obtain\u00a0the\u00a0<br \/>\nrequired \u00a0 information \u00a0 in \u00a0 spite \u00a0 of \u00a0 our \u00a0 best \u00a0 efforts\u00a0<br \/>\neither\u00a0from\u00a0GIPSA\u00a0or\u00a0from\u00a0NIA.&#8221;\u00a0\n<\/p>\n<p>                         Decision\u00a0<\/p>\n<p>5.     After \u00a0 perusing \u00a0 the \u00a0 facts \u00a0 on \u00a0 record \u00a0 the\u00a0<br \/>\nCommission\u00a0can\u00a0not\u00a0agree\u00a0with\u00a0a\u00a0view\u00a0that\u00a0\u00a0evaluation\u00a0<br \/>\nof \u00a0 answer \u00a0 scripts \u00a0 is \u00a0 a \u00a0 &#8216;Deliverable&#8221; \u00a0 since \u00a0 no\u00a0<br \/>\neconomic \u00a0 value \u00a0 can \u00a0 be \u00a0 attributed \u00a0 to \u00a0 answer \u00a0 scripts.\u00a0<br \/>\nTherefore, \u00a0 the \u00a0 plea \u00a0 on \u00a0 which \u00a0 the \u00a0 answer \u00a0 scripts \u00a0 is\u00a0<br \/>\nbeing \u00a0 denied \u00a0 is \u00a0 bad \u00a0 in \u00a0 law \u00a0 and \u00a0 will \u00a0 not \u00a0 stand\u00a0<br \/>\njudicial \u00a0 scrutiny. \u00a0 \u00a0 Furthermore \u00a0 in \u00a0 view \u00a0 of \u00a0 NIA&#8217;s\u00a0<br \/>\nletter\u00a0dated\u00a023.12.2009\u00a0addressed\u00a0to\u00a0Chief\u00a0Executive,\u00a0<br \/>\nGIPSA \u00a0 proposes \u00a0 \u00a0 that \u00a0 the \u00a0 custody \u00a0 of \u00a0 questions \u00a0 and\u00a0<br \/>\nanswer \u00a0 sheets \u00a0 \u00a0 should \u00a0 be \u00a0 with \u00a0 the \u00a0 GIPSA \u00a0 since \u00a0 on\u00a0<br \/>\naccount \u00a0 of \u00a0 constraint \u00a0 of \u00a0 space, \u00a0 NIA \u00a0 was \u00a0 having\u00a0<br \/>\ndifficulty \u00a0 in \u00a0 maintaining \u00a0 the \u00a0 same, \u00a0 it \u00a0 can \u00a0 not \u00a0 be\u00a0<br \/>\nheld \u00a0 by \u00a0 GIPSA \u00a0 that \u00a0 they \u00a0 are \u00a0 not \u00a0 the \u00a0 holders \u00a0 of\u00a0<br \/>\ninformation. \u00a0 Similarly \u00a0 no \u00a0 professional \u00a0 Service\u00a0<br \/>\nAgreement\u00a0between\u00a0GIPSA\u00a0(which\u00a0is\u00a0a\u00a0public\u00a0authority)\u00a0<br \/>\nand\u00a0NIA\u00a0can\u00a0over\u00a0ride\u00a0the\u00a0provisions\u00a0of\u00a0the\u00a0RTI\u00a0Act\u00a0<br \/>\nand \u00a0 GIPSA \u00a0 is \u00a0 obliged \u00a0 to \u00a0 satisfy \u00a0 the \u00a0 orders \u00a0 \u00a0 of \u00a0 the\u00a0<br \/>\nCommission \u00a0 by \u00a0 providing \u00a0 answer \u00a0 sheet \u00a0 to \u00a0 the\u00a0<br \/>\nappellant.\u00a0\u00a0Through\u00a0\u00a0this\u00a0order\u00a0the\u00a0Commission\u00a0issues\u00a0<br \/>\nnotice \u00a0 to \u00a0 the \u00a0CPIO,\u00a0GIPSA\u00a0 to \u00a0 show \u00a0 cause \u00a0 why \u00a0 penalty\u00a0<br \/>\nshould\u00a0not\u00a0be\u00a0imposed\u00a0upon\u00a0him\u00a0for\u00a0not\u00a0having\u00a0carried\u00a0<br \/>\nout\u00a0his\u00a0mandated\u00a0functions\u00a0 \u00a0as\u00a0per\u00a0the\u00a0provisions\u00a0of\u00a0<br \/>\nthe \u00a0 RTI \u00a0 Act, \u00a0 2005. \u00a0 \u00a0 Opportunity \u00a0 of \u00a0 personal \u00a0 hearing\u00a0<br \/>\nis \u00a0 provided \u00a0 to \u00a0 him \u00a0 on \u00a0 4.2.2011 \u00a0 dated \u00a0 12.30 \u00a0 PM \u00a0 for\u00a0<br \/>\nwhich \u00a0 he \u00a0 is \u00a0 directed \u00a0 to \u00a0 present \u00a0 himself \u00a0 before \u00a0 the\u00a0<br \/>\nCommission\u00a0.\u00a0\u00a0Appellant\u00a0may\u00a0attend\u00a0the\u00a0hearing\u00a0if\u00a0she\u00a0<br \/>\nso\u00a0desires.\u00a0\n<\/p>\n<p>                                        (Smt.\u00a0Deepak\u00a0Sandhu)<br \/>\n                               Information\u00a0Commissioner\u00a0(DS)<br \/>\nAuthenticated\u00a0true\u00a0copy:\n<\/p>\n<p>(T.K.Mohapatra)<br \/>\nUnder\u00a0\u00a0Secretary\u00a0&amp;\u00a0Dy.\u00a0Registrar<\/p>\n<p>Copy\u00a0to:\u00ad\n<\/p>\n<p>1.
