1.   Leave granted.\n<\/p>\n<\/p>\n
2.   The appellant was convicted under Section 20(b)<\/p>\n
(ii)(B)     of    the   Narcotic   Drugs      and    Psychotropic<\/p>\n
Substances Act, 1985 (hereinafter referred to as<\/p>\n
`the NDPS Act’), and sentenced to undergo rigorous<\/p>\n
imprisonment for three years and to pay a fine of<\/p>\n
Rs.30,000\/-       and   in    default    of   such    payment   to<\/p>\n
undergo simple imprisonment for three months.
\n                                                                      2<\/span><\/p>\n
3.     On 9th December, 2004, the appellant was found<\/p>\n
in   possession       of   1.61    Kgs.   of    Ganja.       Under   the<\/p>\n
provisions of the NDPS Act, 1 Kg. of Ganja has been<\/p>\n
defined    to    be    “small     quantity”     and     20    Kgs.   and<\/p>\n
above has been defined as “commercial quantity”.<\/p>\n
When the seized Ganja was analyzed on 15th December,<\/p>\n
2004, the weight thereof together with jute bag and<\/p>\n
plastic carrying bag was found to be 1.595 Kgs. The<\/p>\n
Ganja    alone,       without     the    jute   bag     and    plastic<\/p>\n
carrying bag, weighed 1.31 Kgs.                  Before the High<\/p>\n
Court, it was contended on behalf of the appellant<\/p>\n
that once the moisture content of the seized Ganja<\/p>\n
was excluded, the actual weight of the contraband<\/p>\n
would    weigh    less     than    1    Kg.,    which    would       have<\/p>\n
attracted a punishment of imprisonment for a term<\/p>\n
which could extend to six months or fine, which<\/p>\n
could extend to Rs.10,000\/-, or with both. It was<\/p>\n
also    submitted      that     the     expression      `Ganja’,       as<\/p>\n
defined in Section 2(i)(b) of the NDPS Act, does<\/p>\n
not include seeds and leaves when not accompanied<\/p>\n
by the tops. It was also submitted that the expert
\n                                                                   3<\/span><\/p>\n
(PW.1) Mahesh Kaissare had not been able to specify<\/p>\n
the weight of the flowery part alone or the leaves<\/p>\n
separately.         It was prayed before the High Court<\/p>\n
that in the circumstances since the appellant had<\/p>\n
already undergone two months and six days out of<\/p>\n
the     sentence,      the     same    be     considered     as    the<\/p>\n
substantive sentence and that the appellant would<\/p>\n
deposit the fine in case the same has not been<\/p>\n
deposited.\n<\/p>\n<\/p>\n
4.    The High Court rejected the submission made on<\/p>\n
behalf     of    the    appellant,          but   considering      the<\/p>\n
quantity    involved         which    was    little   over    1   Kg.,<\/p>\n
reduced    the    sentence      from    three     years’     rigorous<\/p>\n
imprisonment to one year’s rigorous imprisonment.<\/p>\n
The fine was, however, not reduced.<\/p>\n
5.    Not being satisfied with the order of the High<\/p>\n
Court reducing the sentence from three years to one<\/p>\n
year,     the    appellant      has    moved      this   Court    for<\/p>\n
further relief.\n<\/p>\n

6.     In the present appeal, the same submission has<\/p>\n
been advanced on behalf of the appellant.<\/p>\n
7.     Learned     counsel    for     the    appellant      submitted<\/p>\n
that having regard to the definition of “Ganja” in<\/p>\n
Section 2(iii)(b) of the NDPS Act, the seeds and<\/p>\n
leaves     ought     not     to     have    been    included      while<\/p>\n
weighing the seized contraband since the same was<\/p>\n
not     accompanied     by    tops.         It     was    urged     that<\/p>\n
excluding the seeds and leaves the actual weight of<\/p>\n
the seized Ganja would be below 1 Kg. which would<\/p>\n
attract a much lesser punishment of imprisonment<\/p>\n
for a term which could extend to six months or with<\/p>\n
fine, which could extend to Rs.10,000\/-, or with<\/p>\n
both.\n<\/p>\n<\/p>\n
8.     Learned     counsel    for     the    appellant      submitted<\/p>\n
that    the   order    of     the    High    Court       reducing    the<\/p>\n
period of sentence to one year was erroneous since<\/p>\n
the seized Ganja would be less than 1 Kg. and could<\/p>\n
not,    therefore,     be     taken    to    comprise      commercial<\/p>\n
quantity.\n<\/p>\n
                                                                    5<\/span><\/p>\n
9.     Despite several opportunities, the State did<\/p>\n
not appear to contest the matter and the same was<\/p>\n
taken up for final disposal in the absence of the<\/p>\n
State.\n<\/p>\n<\/p>\n
10. Section        2(iii)(b)      of    the    NDPS    Act   defines<\/p>\n
“Ganja” as follows :-\n<\/p>\n<\/p>\n
       “‘ganja’,      that     is,     the      flowering     or
\n       fruiting     tops     of      the      cannabis     plant
\n       (excluding the seeds and leaves when not
\n       accompanied by the tops), by whatever name
\n       they may be known or designated;”<\/p><\/blockquote>\n
       An   attempt   has    been      made    on   behalf   of    the<\/p>\n
appellant to convince us that the seized Ganja was<\/p>\n
not accompanied by flowering or fruiting tops and<\/p>\n
hence the weight of the seeds and the leaves would<\/p>\n
have     to   be    excluded      on    account       of   the     said<\/p>\n
definition, which would reduce the weight of the<\/p>\n
seized Ganja considerably so as to exclude it from<\/p>\n
the definition of commercial quantity and attract a
\n                                                                     6<\/span><\/p>\n
much lesser sentence than when the seized commodity<\/p>\n
was treated to be of commercial quantity.<\/p>\n
11. The submissions made by learned counsel for the<\/p>\n
appellant      are   not     convincing         since    from     the<\/p>\n
evidence on record it has been established that the<\/p>\n
seized Ganja consisted of a greenish brown colour<\/p>\n
leafy   and    flowery     parts     of   the   plant   (in     moist<\/p>\n
condition) which, in terms of the definition of the<\/p>\n
expression     “Ganja”,      would      include   the   seeds     and<\/p>\n
leaves of the cannabis plant since the seized Ganja<\/p>\n
was accompanied by the flowery parts of the plant.<\/p>\n
As far as exclusion of the moisture content of the<\/p>\n
seized Ganja is concerned, there is nothing in the<\/p>\n
NDPS    Act   to   suggest    that      when    the   weight    of       a<\/p>\n
quantity      of   Ganja     is    to     be    ascertained,     the<\/p>\n
moisture content has to be separately ascertained<\/p>\n
and excluded.        On the other hand, we are of the<\/p>\n
view that the weight of the contraband would be the<\/p>\n
weight taken at the time of seizure.
\n                                                 7<\/span><\/p>\n
12. We, therefore, see no reason to interfere with<\/p>\n
the judgment and order passed by the High Court and<\/p>\n
dismiss the appeal accordingly.\n<\/p>\n<\/p>\n
