JUSTICE S.D.ANAND.\n\nPresent:    Mr. A.K.Tyagi, Advocate for the petitioner\n\n            Mr. Rajiv Sharma, Advocate for the respondents.\n\n\nS.D.ANAND, J.\n<\/pre>\n<p>            The impugned order does not at all notice that the vendor is<\/p>\n<p>mother of the plaintiff-petitioner. It also does not notice the allegation by<\/p>\n<p>the plaintiff-petitioner that the land in suit was ancestral in the hands of<\/p>\n<p>vendor qua them and she could not have sold it off without any legal<\/p>\n<p>necessity. These two facets had a very relevant bearing on the disposal of<\/p>\n<p>the controversy pertaining to the levy or otherwise of the ad-valorem court<\/p>\n<p>fee.\n<\/p>\n<p>            The impugned order is set aside. The matter is remanded to<\/p>\n<p>the learned Trial Court to dispose of the matter afresh after noticing the<\/p>\n<p>above quoted and other relevant pleas of the parties.<\/p>\n<p>            The parties. through their learned counsel, are directed to<\/p>\n<p>appear before the learned Trial Court on 10.6.2009.
