Nos.1060 and 1063 of 2008\n                 ------------------------------\n\n            Dated this, the 2nd day of November, 2009\n\n\n                          JUDGMENT\n<\/pre>\n<p>Balakrishnan Nair, J.\n<\/p>\n<p>           These appeals are directed against the judgment of<\/p>\n<p>the learned Single Judge in O.P.No.38429 of 2002 filed by the<\/p>\n<p>first respondent, Smt.Josephine Sherly Paul. W.A.No.1060 of<\/p>\n<p>2008 is treated as the main case for the purpose of referring<\/p>\n<p>to the parties and the exhibits.\n<\/p>\n<\/p>\n<p>           2. The first respondent is at present working as<\/p>\n<p>Lower Grade Hindi Teacher in the C.M.S. Higher Secondary<\/p>\n<p>School at Mallappally.    There was    dispute concerning her<\/p>\n<p>posting at Kalavankode in Cherthala, her re-transfer to<\/p>\n<p>Mallappally and the alleged non-joining duty etc. But, in view<\/p>\n<p>of the judgment of the learned Single Judge, which is under<\/p>\n<p>appeal, the only dispute that survives for consideration by the<\/p>\n<p>Division Bench is concerning the claim of the first respondent<\/p>\n<p>WA Nos.1060 and 1063 of 2009\n<\/p>\n<p>                              &#8211; 2 &#8211;\n<\/p>\n<p>for transfer to CMS High School at Pallom. The claim of the<\/p>\n<p>first respondent for payment of salary for the period from<\/p>\n<p>12.2.2002 to 4.3.2003 has been resolved to the satisfaction of<\/p>\n<p>the first respondent. Since the Government did not file any<\/p>\n<p>appeal against the judgment, we need not go into the said<\/p>\n<p>part of the decision of the learned Single Judge. But, in the<\/p>\n<p>judgment under appeal, there is a direction to accommodate<\/p>\n<p>the first respondent\/writ petitioner at CMS High School,<\/p>\n<p>Pallom, if necessary by transferring the 6th respondent. In<\/p>\n<p>view of the said direction, W.A.No.1060 of 2008 is preferred<\/p>\n<p>by the Manager of the Corporate Educational Agency and the<\/p>\n<p>Principal of CMS Higher Secondary School, Mallappally and<\/p>\n<p>W.A.No.1063 of 2008 by the 6th respondent.<\/p>\n<p>           3. According to the first respondent\/writ petitioner,<\/p>\n<p>she is senior and therefore, by virtue of Rule 10(1) of Chapter<\/p>\n<p>XIV-A of Kerala Education Rules, she is entitled to get posting<\/p>\n<p>at Pallom. The above said rule permits deviation from the<\/p>\n<p>seniority rule to the extent of 25%. The deviation can be<\/p>\n<p>WA Nos.1060 and 1063 of 2009\n<\/p>\n<p>                                &#8211; 3 &#8211;\n<\/p>\n<p>made to make the transfer on compassionate grounds. The<\/p>\n<p>sixth respondent was transferred to Pallom overlooking the<\/p>\n<p>seniority of the first respondent on compassionate grounds.<\/p>\n<p>The learned Single Judge interfered with the transfer based on<\/p>\n<p>the finding that transfer order does not spell out the reason<\/p>\n<p>for transferring the sixth respondent.       The learned Single<\/p>\n<p>Judge also took the view that presence of aged parents cannot<\/p>\n<p>be a ground for overlooking the seniority rule, as aged<\/p>\n<p>parents are there in all families. Attacking the above finding<\/p>\n<p>of the learned Single Judge, the learned counsel for the<\/p>\n<p>appellants, submitted that the father of the sixth respondent<\/p>\n<p>is critically ill with heart disease and her mother is physically<\/p>\n<p>challenged. Therefore, it is not a case of presence of aged<\/p>\n<p>parents alone, but there are special grounds for showing<\/p>\n<p>compassion.       So, the learned Single Judge should not have<\/p>\n<p>interfered with the said order, it is submitted.    The learned<\/p>\n<p>counsel for the first respondent\/writ petitioner, on the other<\/p>\n<p>hand, pointed out that, the sixth respondent though junior has<\/p>\n<p>been continuing at Pallom for the last several years whereas<\/p>\n<p>WA Nos.1060 and 1063 of 2009\n<\/p>\n<p>                              &#8211; 4 &#8211;\n<\/p>\n<p>first respondent has got only two years for retirement and so,<\/p>\n<p>at the fag end of her service, she is entitled to be given a<\/p>\n<p>posting in her native place. The first respondent also pointed<\/p>\n<p>out that she has also parents who are more aged than the<\/p>\n<p>parents of the sixth respondent.\n<\/p>\n<\/p>\n<p>           4. The Manager is bound to issue transfer orders<\/p>\n<p>having regard to the seniority of the incumbents involved,<\/p>\n<p>ordinarily. If special grounds are available, the Manager can<\/p>\n<p>deviate from the seniority rule, upto an extent of 25%.<\/p>\n<p>Regarding the said deviation, an aggrieved teacher has a right<\/p>\n<p>of appeal before the Director of Public Instruction. This Court<\/p>\n<p>while exercising the power of judicial review, can examine<\/p>\n<p>whether the order was within jurisdiction.       Normally, this<\/p>\n<p>Court should not have entertained a writ petition filed against<\/p>\n<p>a communication issued by the Manager. Not that no writ will<\/p>\n<p>lie against a Manager, but there are other forums to consider<\/p>\n<p>the grievance raised by the petitioner. This Court, grappling<\/p>\n<p>with the issue of pendency of cases, should not normally<\/p>\n<p>WA Nos.1060 and 1063 of 2009\n<\/p>\n<p>                               &#8211; 5 &#8211;\n<\/p>\n<p>entertain matters which could be effectively considered by<\/p>\n<p>statutory authorities and forums and should confine itself<\/p>\n<p>dealing   with matters which this Court alone can handle. Of<\/p>\n<p>course, if the learned Single Judge has found that the transfer<\/p>\n<p>order was effected by the Manager without jurisdiction, then<\/p>\n<p>the interference may be sustained.        Broadly there is no<\/p>\n<p>dispute that Manager has jurisdiction to order transfer as the<\/p>\n<p>one ordered in this case. But, while exercising that power, he<\/p>\n<p>may stray out of jurisdiction by considering irrelevant matters<\/p>\n<p>or omitting to consider relevant matters. But, we find there is<\/p>\n<p>no jurisdictional error in this case. Therefore, the direction of<\/p>\n<p>the learned Single Judge to post the first respondent in the<\/p>\n<p>place of sixth respondent was not warranted having regard to<\/p>\n<p>the limited scope of the power of judicial review exercised by<\/p>\n<p>this Court.    But, whether the decision of the Manager in<\/p>\n<p>favour of the sixth respondent is justifiable on facts can be<\/p>\n<p>considered by the appellate authority. The said authority can<\/p>\n<p>look into the factual disputes involved in the case and weigh<\/p>\n<p>the relevant merits of the contentions of the parties and issue<\/p>\n<p>WA Nos.1060 and 1063 of 2009\n<\/p>\n<p>                              &#8211; 6 &#8211;\n<\/p>\n<p>appropriate orders. So, the remedy of the first respondent<\/p>\n<p>against the refusal of the Manager to post her at Pallom and<\/p>\n<p>the decision to retain there the sixth respondent who is<\/p>\n<p>relatively junior to her, can be challenged by filing an appeal<\/p>\n<p>under Rule 10(5) of Chapter XIV-A, of the K.E.R. before the<\/p>\n<p>D.P.I.   Since the matter was pending before this Court for a<\/p>\n<p>long time, it is ordered that, if the first respondent files an<\/p>\n<p>appeal within one month from today, against the omission of<\/p>\n<p>the Manager to post her at Pallom, the D.P.I. shall hear and<\/p>\n<p>dispose of the appeal as expeditiously as possible,       after<\/p>\n<p>affording an opportunity of being heard to the first<\/p>\n<p>respondent, the Manager and the sixth respondent, without<\/p>\n<p>being influenced by anything said in the judgment of the<\/p>\n<p>learned Single Judge.\n<\/p>\n<\/p>\n<p>         5. The first respondent has got a case that because of<\/p>\n<p>the interim order passed by this Court, the monetary benefits<\/p>\n<p>payable to her as per the judgment under appeal have<\/p>\n<p>not so far been released. If that be so, the respondents 4 and<\/p>\n<p>WA Nos.1060 and 1063 of 2009\n<\/p>\n<p>                                &#8211; 7 &#8211;\n<\/p>\n<p>5 shall take necessary steps to release the monetary benefits<\/p>\n<p>payable as per the judgment under appeal to the first<\/p>\n<p>respondent within two months from the date of production of<\/p>\n<p>a copy of this judgment. If the pay revision benefits have not<\/p>\n<p>so far been released, the said respondents shall also take<\/p>\n<p>steps to release the pay revision arrears due to her.<\/p>\n<p>           With the above directions, the Writ Appeals are<\/p>\n<p>disposed of.\n<\/p>\n<\/p>\n<p>                                              Sd\/-\n<\/p>\n<p>                                      K.
